UCC release of lien filing - bank says they submitted but nothing showing up

Really frustrated here. Our company paid off a equipment loan back in October and the bank assured us they filed the UCC termination statement right away. It's now January and I'm still seeing the original UCC-1 active when I search the state database. The bank keeps telling me "it's processing" but shouldn't a release of UCC show up within a few weeks max? We're trying to refinance with another lender and they're flagging this active lien. Has anyone dealt with banks dragging their feet on UCC releases? The original filing was for $180K in manufacturing equipment and we need this cleared ASAP. Starting to think they never actually filed the termination paperwork despite what they claim.

Banks can be terrible about this unfortunately. Did you get any kind of confirmation number or filing receipt when they supposedly submitted the UCC-3 termination? Most states give you an immediate confirmation if filed electronically.

That's the thing - they never gave me any confirmation number or receipt. Just keep saying "we submitted it" when I call. Should have been a red flag.

Definitely a red flag. Legitimate termination filings generate immediate confirmation numbers in most states.

Check your loan payoff paperwork. Sometimes banks include language about UCC release timing but a lot of times they're just lazy about actually doing it promptly. You might need to pressure them more.

Good point. Looking at the payoff letter now and it just says "lien release will be filed as required by law" - no specific timeframe mentioned.

That vague language is probably intentional so they can drag it out. Most states require termination within 30 days but enforcement is weak.

Banks are THE WORST about UCC releases. I swear they do it on purpose to create problems for borrowers. File a complaint with your state banking commission - that usually gets them moving real quick.

This! Banking commission complaints are magic. Had a similar issue and filed a complaint on Monday, termination was filed by Wednesday.

Make sure you document all your calls and emails first. Banking commission wants to see you tried to resolve it directly before they get involved.

Just went through this nightmare myself. Bank claimed they filed UCC termination but search showed nothing for 2 months. Turns out they filed it under slightly wrong debtor name so it didn't properly terminate the original lien. Had to get them to file an amended termination.

Have you tried calling the Secretary of State office directly? Sometimes they can tell you if any termination filings are pending or if there were any rejected filings that might not show up in your search.

Yeah SOS offices are usually pretty helpful about checking filing status. They can see stuff that doesn't show up in public searches yet.

Some states have a delay between filing and when it shows up online too. Could be sitting in processing queue.

I'd demand written proof from the bank that they actually filed it. Bank saying "we submitted it" over the phone means nothing. Get them to email you the filing confirmation or send a copy of the submitted UCC-3 form.

UPDATE: Called the bank this morning and finally got transferred to someone who admitted they had a "processing error" and the termination was never actually submitted. They're filing it today and giving me the confirmation number. Unbelievable.
