Washington ESD unemployment if fired for not having babysitter - can I still qualify?
So I got terminated last week because I missed too many days when my daycare kept closing unexpectedly. My boss said it was job abandonment but I tried to explain I had no one to watch my 3 year old. I've been working there for 2 years and never had attendance issues before this. Does Washington ESD consider this misconduct? I really need to know if I can even file for unemployment benefits or if I'm screwed. Has anyone dealt with something like this before?

This is actually a complicated situation for Washington ESD. Missing work without permission can be considered misconduct, but if you can prove you had no reasonable childcare alternatives and made good faith efforts to resolve the situation, you might still qualify. You'll need to document everything - daycare closure notices, your attempts to find backup care, any communication with your employer about the situation.

•I do have the emails from the daycare about their closures and I did text my supervisor each time. Should I gather all that before filing?

•Yes, absolutely gather everything. Also include any documentation of your attempts to find alternative childcare. Washington ESD will want to see you made reasonable efforts to maintain your job.

You should definitely file for unemployment. The worst they can say is no, and childcare issues are often considered beyond your control. I had a similar situation in 2023 and Washington ESD approved my claim after adjudication. Just be completely honest on your application about why you were terminated.

•How long did the adjudication take? I'm worried about how long I'll be waiting for a decision.

•Mine took about 3 weeks. They called me and my former employer to get both sides of the story. Just make sure you answer their calls!

ugh this is so frustrating!! I've been trying to call Washington ESD for days about my own claim and can never get through. The phone system is horrible and I keep getting disconnected after waiting for hours. How are you supposed to explain your situation if you can't even talk to anyone?

•I was having the same problem until someone told me about claimyr.com - it's a service that calls Washington ESD for you and gets you connected to an actual person. I used it last month and finally got through to resolve my adjudication issue. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

I think you have a good chance of getting approved. Washington state generally recognizes that childcare emergencies are beyond an employee's control. The key is proving you didn't just quit showing up - you had legitimate reasons each time.

•That's exactly what happened. I never just didn't show up without calling. I always tried to let them know as soon as possible.

•Documentation is everything. Keep records of all your attempts to communicate with your employer about the childcare situation.

File immediately and don't wait. Even if your claim gets denied initially, you have the right to appeal. Sometimes Washington ESD's initial decision isn't the final word, especially in cases involving childcare emergencies.

•Good point. I was worried about filing if I thought I'd get denied but you're right - I can always appeal.

Luca Greco
•Exactly. The appeal process gives you a chance to present your case in detail to a hearing officer who can consider all the circumstances.

This happened to my sister in law last year. She got fired for missing work due to childcare issues and Washington ESD approved her claim. They said since she made good faith efforts to resolve the situation and communicated with her employer, it wasn't misconduct. Just make sure you can prove you tried to work with your employer.

•That's encouraging! I did try to work with them but they weren't very understanding.

•Unfortunately some employers aren't flexible about childcare emergencies, but that doesn't mean you should be penalized for circumstances beyond your control.

Whatever you do, don't lie or leave anything out on your application. Washington ESD will investigate and talk to your employer anyway. Being honest about the childcare situation is your best bet.

•I definitely won't lie. I'm just nervous about how they'll interpret everything.

•They deal with these situations all the time. Just present the facts clearly and let them make the decision.

The waiting is the worst part. I'm in adjudication right now for a different issue and it's been 4 weeks. At least you have documentation of your situation which should help speed things up.

•4 weeks?! How are people supposed to survive that long without income?

•It's brutal. I've been applying for emergency assistance programs to help cover bills while I wait.

I would also suggest looking into childcare assistance programs while you're job searching. DSHS has programs that can help with childcare costs so this doesn't happen again with your next job.

•That's a great idea. I should have looked into that before this became a problem.

•Don't blame yourself. Childcare is expensive and hard to find. The important thing is planning ahead for your next job.

I had to use Claimyr too when I couldn't get through to Washington ESD. It really works - they called me back within a few hours and I was connected to an agent who helped me understand my adjudication status. Way better than spending days trying to call yourself.

•Ok I'm definitely going to try that. I can't keep taking time off work to sit on hold all day.

•Wait, you're working while dealing with unemployment? I thought you couldn't work while on benefits.

•I'm doing gig work while my claim is pending. You can work part time and still get partial benefits as long as you report it.

The job search requirements are something to keep in mind too. Even if your claim gets approved, you'll need to be actively looking for work and meeting the weekly requirements. Just something to prepare for while you're waiting for your adjudication decision.

•Good point. I should start applying for jobs now even before I know if I'll get benefits.

•Yes, and make sure any job you apply for has childcare compatibility. No point in getting a job you can't actually keep.

honestly the whole system is broken. single parents get screwed over constantly and then the government acts like we're the problem. but you should still file because you deserve help

•I know, it's so frustrating. Childcare shouldn't be this hard to figure out.

•It's definitely a systemic issue but individual claims can still be approved when there are legitimate circumstances like this.

File ASAP and request your adjudication interview as soon as possible. The sooner you can explain your side of the story to Washington ESD, the sooner you'll get a decision. Don't wait around hoping it resolves itself.

•How do I request an interview? Is that something I do when I file or after?
0 coins
Luca Greco
•They'll schedule an interview automatically if your claim goes to adjudication. You don't need to request it specifically.

Same thing happened to me in 2022. Got fired for missing work due to my kid being sick repeatedly. Washington ESD approved my claim because I had doctor's notes and showed I tried to work with my employer. Your situation sounds similar - you have documentation and made good faith efforts.

•Every situation is different but childcare emergencies are generally viewed more favorably than other attendance issues.

Make sure you understand the difference between misconduct and just being unable to meet job requirements. Childcare emergencies often fall into the second category which is much better for your unemployment claim.

Zara Malik
•I didn't know there was a difference. Can you explain more?

NeonNomad
•Misconduct is deliberate wrongdoing or negligence. Inability to meet job requirements due to circumstances beyond your control is different and less likely to disqualify you from benefits.

Just wanted to add that you should also file for other assistance programs like SNAP and WIC if you qualify. Don't rely on just unemployment while you're waiting for your claim to be processed.

•Good idea. I should look into what other programs might help while I'm waiting.

•DSHS has a good website that explains all the different assistance programs available. Definitely worth checking out.
