Washington ESD unemployment after broken leg - am I eligible?

I fractured my tibia in two places last week and my doctor says I'll be off work for at least 8-10 weeks. I'm a warehouse worker so there's no way I can do my job with crutches and a cast. My employer doesn't offer disability insurance and I can't afford to go without income this long. Can I file for Washington ESD unemployment benefits while I'm recovering? I'm able to look for other work that doesn't require standing/walking but I'm confused about the requirements. Do I need to be physically able to perform my old job or just any job? Really stressed about this situation.

Unfortunately unemployment in WA requires you to be able and available for work. If you can't perform your regular duties due to injury, Washington ESD will likely deny your claim.

But I can do desk work or phone work, just not physical labor. Doesn't that count as being available?

It's complicated. You have to be available for suitable work, which Washington ESD determines based on your work history and skills.

Actually you might have options here. The key is proving you're able and available for work that accommodates your temporary disability. I had a similar situation with a back injury and got approved after providing documentation.

What kind of documentation did you need? My doctor gave me a note saying I can work but with restrictions.

•

That's exactly what you need! Make sure it specifies what work you CAN do, not just what you can't do. Washington ESD needs to see you're actively seeking appropriate employment.

Wait, so you can get UI benefits even if you can't do your old job? I thought you had to be ready to go back to your exact same position.

The able and available requirement is nuanced. You need to demonstrate you can perform some type of work and are actively seeking employment within your restrictions. File your claim and explain your situation clearly in the additional information section.

Should I mention the injury when I file or wait until they ask? I don't want to hurt my chances but I also don't want to lie.

Be upfront about it. Hiding information will cause bigger problems later. Explain that you're temporarily unable to perform physical labor but available for other work.

I tried calling Washington ESD about something similar but could never get through. Spent hours on hold just to get disconnected. Recently found this service called Claimyr (claimyr.com) that actually gets you connected to ESD agents. There's a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Might be worth checking out since you'll probably need to speak with someone directly about your specific situation.

Is that legit? I'm skeptical of anything that charges money to help with unemployment stuff.

I was skeptical too but it actually worked. They don't ask for personal info, just help you navigate the phone system to reach a real person at Washington ESD.

I've heard of Claimyr from other people on here. Seems like a decent option when you really need to talk to someone at ESD.

This is so confusing! Why can't Washington ESD just have clear guidelines about injuries and temporary disabilities? Every situation seems different.

Because every case IS different. They have to evaluate individual circumstances to prevent abuse while helping legitimate claimants.

I guess that makes sense but it's frustrating when you need help and don't know if you qualify.

broke my ankle few years back and got denied because they said I wasnt actively looking for work. make sure you apply to jobs every week even if theyre remote or desk jobs

Sophie Duck

•

How many jobs do you have to apply for each week? And do they actually check?

0 coins

Ruby Blake

•

think its 3 jobs per week minimum but check the current requirements. and yes they can audit your job search log anytime

Anita George

•

It's actually 3 job contacts per week in Washington. Keep detailed records because they do random audits.

The real issue is whether your employer will contest the claim. If they say you quit or were terminated for misconduct, you'll have bigger problems than the injury question.

My employer is pretty understanding. I told them about the injury and they said they'd hold my position but can't pay me while I'm out.

0 coins

That's good. Make sure you get that in writing - it'll help your case if Washington ESD questions whether you left voluntarily.

omg this happened to my brother last year! he broke his leg skiing and was out of work for months. took forever to get approved but he eventually did get benefits

How long did it take? I'm worried about going weeks without any income.

0 coins

like 6 weeks I think? there was some back and forth about his medical documentation but it worked out

•

Key points for your claim: 1) Get medical documentation stating what work you CAN do 2) Start job searching immediately for positions within your restrictions 3) Be prepared to explain your situation during the eligibility interview 4) Keep records of everything. The injury itself doesn't disqualify you if you can prove availability for suitable work.

This is really helpful, thank you! Should I wait until my cast comes off to file or start the process now?

Logan Chiang

•

File as soon as possible. There's a one-week waiting period anyway, and delays only hurt your potential benefit amount.

Anita George

•

Definitely file now. Even if there are complications, you want your claim date to be as early as possible.

Update: I called Washington ESD using that Claimyr service someone mentioned and actually got through! The agent said my situation sounds like it could qualify but I need to provide medical documentation and start my job search right away. Filing my claim tomorrow.

Glad Claimyr worked for you too! It's crazy how hard it is to reach ESD without some kind of help.

Good to hear you got clarity. Make sure to keep copies of all medical documentation and job applications for your records.

0 coins

That's awesome! I might try Claimyr myself, I've been trying to reach ESD about my own claim for days.

Just want to add that temporary total disability through L&I might also be an option if your injury happened at work. Worth looking into both programs.

It happened at home unfortunately, not work-related. But good point for others reading this.

0 coins

Ah gotcha. Still, unemployment should work for your situation based on what others have said here.

The system is so backwards. You get hurt and suddenly you're jumping through hoops just to survive financially. Hope it works out for you OP.

Tell me about it. Adding stress about money to an injury recovery is the last thing anyone needs.

I get the frustration but the requirements exist to prevent fraud. Most legitimate cases do get approved eventually.
