Washington ESD appeal denied - can I appeal again and how many days do I have?

My unemployment appeal was just denied by the appeals tribunal and I'm freaking out. The decision doesn't make sense to me at all - they said I was fired for misconduct but I have evidence that contradicts their findings. Can I file another appeal after getting denied? And if so, how many days do I have to do it? I really need these benefits and don't know what my next step should be.

Yes, you can file a second appeal to the Board of Appeals after an Administrative Law Judge denies your first appeal. You have 30 days from the date of the tribunal decision to file with the Board of Appeals. This is your final level of appeal within the Washington ESD system.

Thank you! Do I need new evidence or can I use the same stuff I submitted before?

0 coins

You can submit new evidence, but you'll need to explain why it wasn't available during the first appeal. The Board mainly reviews whether the law was applied correctly rather than re-examining all the facts.

I went through this exact same thing last year. The 30 day deadline is STRICT - don't miss it. I almost did because I was so upset about the denial that I put off dealing with it for weeks.

Did you end up winning your second appeal? I'm trying to figure out if it's worth the effort.

0 coins

I did win, but it took another 3 months. The Board overturned the ALJ decision because they found legal errors in how my case was handled.

Before you file another appeal, have you considered using a service like Claimyr to get through to Washington ESD directly? Sometimes there are errors in how cases are processed that can be resolved without going through the full appeals process again. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

I've tried calling Washington ESD so many times but never get through. How does Claimyr work exactly?

0 coins

It automatically calls and gets you connected to an actual person at Washington ESD. Way better than sitting on hold for hours or getting disconnected.

I used Claimyr last month when my claim was stuck in adjudication. Got through to someone in about 20 minutes instead of spending days trying to call.

The Board of Appeals is really your last shot within the unemployment system. After that, your only option would be to file in superior court, which gets expensive fast with lawyer fees.

0 coins

How much does it cost to file with the Board of Appeals?

0 coins

The Board of Appeals filing is free, just like the first appeal. It's only if you go to court that you start paying filing fees and potentially lawyer costs.

0 coins

What exactly did they say about the misconduct? Sometimes the ALJ makes mistakes in interpreting the evidence or applying the law. I've seen cases where the Board reverses decisions because the judge didn't follow proper procedures.

0 coins

They said I was insubordinate and violated company policy, but I have emails showing my supervisor approved what I did. The ALJ seemed to ignore that evidence completely.

0 coins

That sounds like a potential legal error. The Board looks for things like whether all evidence was properly considered. You should definitely file that second appeal.

0 coins

ugh the whole appeals process is such a nightmare. I'm going through my first appeal right now and already dreading the possibility of having to do it again if I lose.

0 coins

It really is stressful. The waiting is the worst part - you need the money but everything takes forever.

0 coins

The second appeal actually moved faster for me than the first one. The Board of Appeals seems more efficient than the tribunal level.

0 coins

Make sure you understand what you're appealing when you file with the Board. You need to be specific about what legal errors you think the ALJ made, not just that you disagree with the outcome.

0 coins

Do I need a lawyer for the Board of Appeals or can I represent myself like I did for the first appeal?

0 coins

You can represent yourself, but the Board level is more technical and focused on legal arguments. Some people do hire lawyers at this stage, especially if there's a lot of money involved.

0 coins

I lost my first appeal too and was devastated. But I talked to someone at Washington ESD who helped me understand what went wrong. Turns out there was a procedural issue that the Board later agreed was a problem.

0 coins

How did you manage to talk to someone at Washington ESD? I can never get through on the phone.

0 coins

I used that Claimyr service someone mentioned earlier. It was actually pretty easy once I figured out how it worked.

0 coins

Just want to emphasize again - that 30 day deadline is absolutely crucial. Count from the date on the decision, not when you received it. And if day 30 falls on a weekend or holiday, you get until the next business day.

0 coins

Good point about the date counting. I got the decision 3 days ago so I still have time to get everything together.

0 coins

What kind of evidence do you have that they ignored? If it's clear documentation that contradicts their findings, that could be grounds for reversal.

0 coins

I have email chains showing my supervisor knew about and approved my actions. Plus witness statements from coworkers. The ALJ barely mentioned any of it in the decision.

0 coins

That definitely sounds like they failed to properly consider material evidence. That's exactly the kind of thing the Board looks for.

0 coins

Don't give up! I know it's discouraging but the Board of Appeals does overturn ALJ decisions when they find legal errors. Focus on what the judge got wrong legally, not just the facts of your case.

0 coins

Thanks for the encouragement. I'm going to file the appeal tomorrow and see what happens.

0 coins

Another thing to consider - are you still filing weekly claims while going through appeals? You should keep certifying even during the appeals process.

0 coins

Yes, I've been keeping up with my weekly claims. Wasn't sure if I should but figured it was better to be safe.

0 coins

Good call. If you eventually win your appeal, you'll get back pay for all those weeks you were denied.

0 coins

The Board of Appeals form is different from the first appeal form. Make sure you're using the right paperwork - it should be available on the Washington ESD website.

0 coins

I'll look for that. Do I submit it online or have to mail it in?

0 coins

You can do either, but I'd recommend mailing it certified mail so you have proof it was received on time.

0 coins

This whole system is so frustrating. Why can't they just get things right the first time instead of making people go through multiple levels of appeals?

0 coins

I know, right? It's exhausting having to keep fighting for benefits you should have gotten in the first place.

0 coins

The appeals process exists for a reason though. Sometimes the initial decisions are wrong and people need a way to challenge them.

0 coins

If you do win your Board of Appeals case, how long does it typically take to start getting your benefits? I'm curious because I might be in the same situation soon.

0 coins

In my case, it took about 2 weeks after the Board decision to start getting payments. They also issued back pay for all the weeks I had been denied.

0 coins

That's good to know. At least if I win, I'll get everything I should have gotten all along.

0 coins

One more thing - when you file with the Board, be really clear about what specific legal errors you think the ALJ made. Don't just rehash all the facts from your case.

0 coins

That's helpful advice. I'll focus on how they misapplied the law rather than just arguing about what happened.

0 coins

Good luck with your Board of Appeals case! It's stressful but you're doing the right thing by not giving up. The system isn't perfect but it does work sometimes.

0 coins

Thank you for all the support and advice everyone. I feel a lot more confident about moving forward now.

0 coins

Just remember - even if things don't go your way with the Board of Appeals, you tried everything you could within the system. Sometimes that's all you can do.

0 coins

True. But I'm going to stay optimistic and hope the Board sees what the ALJ missed.
