Filing UI claims in two states sequentially (WA then NV) with unused wages - is this allowed?

I'm in a situation where I filed for unemployment in Washington back in September since most of my wages were reported there. I had two quarters of wages reported in Nevada (where I currently live), but I qualified for the max WA benefit without needing to use those Nevada wages. My Washington benefit year expires in March 2025, and I'm wondering if I can then file a new claim in Nevada using those two quarters of wages that weren't used for my WA claim? Has anyone done something similar or know if this is allowed? The ESD agent I spoke with seemed confused when I asked about it.

No, not trying to double dip at all! I'd be filing in Nevada AFTER my Washington claim is completely finished. These would be separate benefit years, not collecting from both states at the same time.

This is actually a legitimate question about combined wage claims (CWC) and benefit year eligibility. Since your Nevada wages weren't used in your Washington claim calculation, those wages should technically still be available for a new claim after your WA benefit year ends. However, each state has different eligibility requirements for establishing a new claim. In Nevada, you typically need earnings in at least 2 quarters of your base period with a minimum total amount. You should contact Nevada DETR directly to verify if those quarters would qualify you for a new claim after your WA benefit year expires.

OMG the unemployment system is so confusing!!! I had something similar happen when I moved from Oregon to Washington and it took literally 3 months to sort out where I was supposed to file!!! The right hand never knows what the left hand is doing with these agencies!!

I've gone through something similar but in reverse (NV to WA). The key here is that you will need to wait until your WA benefit year completely expires before filing in Nevada. Nevada DETR will do a cross-check with other states, and if you try to file before your WA claim expires, you'll get flagged for potential dual claims which can cause major headaches. The good news is that yes, those wages that weren't used for your WA claim calculation can potentially be used for a NV claim. The thing is, Nevada has its own eligibility requirements, so those two quarters might not be enough to qualify for a new claim, depending on how much you earned during that period. I'd recommend calling Nevada DETR directly. Their phone lines are impossible though - I spent 3 weeks trying to get through before I discovered Claimyr (claimyr.com). They got me through to an agent same day - you might want to check out their video demo: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 since Nevada's phone system is just as bad as Washington's.

Thanks so much for sharing your experience. That's really helpful to know about the cross-check system between states. I'll definitely wait until my WA claim fully expires before doing anything with Nevada. And thanks for the Claimyr tip - Nevada's phone system is absolutely terrible, so I'll check that out!

This is a common question for interstate claimants. The rule is that each state's wages can only be used once for a benefit year, but if the wages weren't used in your first claim's monetary determination, they may be available for a future claim. Here's the factual breakdown: 1. When you filed in WA, they determined your benefit amount using only your WA wages 2. Your NV wages remained "unused" in your benefit calculation 3. After your WA benefit year expires (one year from filing date), those NV wages could potentially be used However, Nevada requires you to have earned at least $400 in each of two quarters, with specific total earnings requirements. Two quarters might be enough if your earnings were substantial. In these cases, timing is critical. You must wait until after the WA benefit year expires, then contact Nevada DETR to file a new claim. They'll need to verify those wages weren't used in your WA claim calculation. This isn't double-dipping - it's properly utilizing wages earned in different states for separate, sequential benefit years.

This is super helpful information! I've been trying to figure this out for my brother who worked in Oregon and Washington last year. So just to clarify, wages can only be used ONCE across ANY state for benefit calculations? Is that like a federal rule or something?

Yes, it's a federal guideline that wages can only be used once for UI benefit calculations across any state. This prevents people from using the same wages to collect benefits multiple times. But importantly, if the wages weren't actually USED in calculating your benefits (as in your case where you qualified for max benefits using just WA wages), then those unused wages may still be available for a future claim. Each state has their own specific implementation of these rules though.

This makes so much sense now! I earned about $8,600 over those two quarters in Nevada, so hopefully that's enough to qualify for something. I'll definitely wait until after my WA benefit year expires in March before contacting Nevada DETR. Really appreciate everyone's help with this!

my cousin tried to file in 2 states at the SAME TIME and ended up getting hit with a fraud investigation!!! make sure ur NOT filing while still receiving benefits from WA or you'll be in BIG trouble!!! they share data now!!

That's correct, but just to clarify for the OP - what you're describing (filing in two states simultaneously) is completely different from what they're asking. They're specifically asking about filing sequentially after their first benefit year expires, which can be perfectly legitimate if done correctly.

The ESD agents themselves are often confused about interstate claims tbh. I had a similar situation between Idaho and Washington and got different answers from FOUR different agents! What a mess. Eventually I got a senior agent who actually understood the rules. Hope you get it sorted!

Update: I called Nevada DETR this morning (took forever to get through) and finally spoke with an agent who confirmed what you all said - I can potentially use those wages for a Nevada claim after my WA benefit year expires in March! She said my two quarters should be enough to qualify for at least a minimal benefit. She also mentioned I'll need to provide proof that those wages weren't used in my WA monetary determination. Thanks everyone for the guidance!

That's great news! Make sure to keep both your WA monetary determination letter and your Nevada wage information for when you file. Documentation is key with these interstate claims. Glad you got through and got confirmation!

Congrats on getting through to Nevada DETR and getting confirmation! That's exactly what I was hoping to hear. Just a heads up - when you do file in March, make sure you have your WA monetary determination letter handy that shows which wages were actually used in calculating your benefits. Nevada will likely want to see that documentation to verify that your NV wages weren't part of the calculation. Also, don't be surprised if there's some back-and-forth between the states to verify everything - interstate claims can take a bit longer to process, but you're definitely on the right track now!

That's really solid advice about having the WA monetary determination letter ready! I hadn't thought about the back-and-forth between states potentially slowing things down, but that makes total sense. I'll make sure to file right after my benefit year expires in March and have all my documentation organized. Thanks for the heads up about the processing time - at least now I know what to expect!
