Expedited my ESD appeal with hardship request - hearing in 2 weeks instead of 6 months!

Finally some good news I wanted to share! I filed my ESD appeal on January 12th after being denied benefits due to a 'quit without good cause' determination (I had documentation proving I was actually laid off). The ESD representative warned me it could take 6-8 months for a hearing date given the current backlog. I've been without any income for almost 3 months and was seriously panicking. I immediately requested a hardship expedite after filing the appeal. I sent in copies of my past-due mortgage statement ($2,875 overdue), utility disconnection notices, and a letter explaining that I'm a single parent with two kids and no other income source. This morning I got a call from OAH saying they've expedited my case and scheduled my hearing for February 28th - less than 3 weeks from now instead of waiting until summer or fall! The person I spoke with said the documentation I provided was exactly what they needed to approve the expedite. For anyone else in a similar situation - DEFINITELY request a hardship expedite if you're facing financial crisis while waiting. The form is on the OAH website and you upload your supporting documents there. I'm still super nervous about the hearing but at least I'll get a resolution soon. Going 12+ weeks without income has completely drained my savings and I've had to borrow from family just to keep the lights on. I'll update after my hearing - wish me luck!

Thats awesome news!! I've been waiting for my appeal hearing for 3 months now with no date in sight. Where exactly did you find the hardship expedite form? I looked all over the OAH website but couldn't find anything specifically for expediting. My landlord is already threatening eviction and I'm down to eating 1 meal a day to stretch my food $$.

It's not super obvious on their website. Go to oah.wa.gov, then click on 'Unemployment Benefits' under case types. There's a section called 'Request for Expedited Hearing' with a downloadable PDF. You fill it out explaining your hardship situation, then upload it along with proof (bills, eviction notices, etc.) through their online portal or you can fax it. I also called the OAH main number to confirm they received everything.

congrats on getting the expedite! fair warning tho - make sure you're SUPER prepared for that hearing. i had mine expedited last year and it came up so fast i wasn't ready. the judge asked me for specific dates and details i couldn't remember and ended up losing my case. definitely have all ur docs organized and practice explaining exactly why you should get benefits. good luck!!!

Did you follow up after submitting your hardship request? In my experience working with the unemployment system, these requests sometimes get overlooked unless you actively follow up. I suggest calling the OAH directly at 360-407-2700 (or toll-free 800-583-8271) to check on the status. Ask specifically what additional documentation they might need to approve your expedite request. Sometimes they need very specific evidence of immediate financial harm that you might not have included in your initial submission. Also, different types of hardships are prioritized differently - immediate eviction or foreclosure tends to get faster action than other types of financial hardship.

has anyone acutally WON their appeal after getting the expedite? or does getting it faster just mean u get denied faster lol. my cousin got his hearing expedited and still lost cuz the employer showed up with a lawyer and he didnt have one.

That's actually something I'm worried about too. My former employer is a large company with an HR department and probably has dealt with these hearings before. I'm wondering if I should try to get a lawyer but I literally have no money to pay for one right now...

Does this actually work? I've spent literally HOURS on hold with ESD and either get disconnected or they tell me they can't help with appeals and to contact OAH instead. But OAH says some documentation has to come from ESD first. It's a never-ending circle of frustration.

Yes, it really worked for me! I was in the same loop - ESD saying talk to OAH, OAH saying they need info from ESD. Update us after your hearing! I have mine next month and I'm TERRIFIED. No idea what to expect or how formal it is. Will the judge interrupt a lot? Can I bring notes? Is it like a real court?? So many questions and ESD gives zero helpful info as usual.

i just had my hearing yesterday and it wasn't as bad as i thought! the judge was actually pretty nice and let me explain everything. the weird part was my old boss seemed totally confused about why i was fired and gave different reasons than what was in my denial letter from ESD lol. hoping that helps my case!

i had screenshots of texts with my manager and a copy of the company handbook to show i didn't violate any policies. judge said i'll get the decision in 2-3 weeks by mail. the waiting is killing me but at least the hearing part is over!
