Employer threatening termination for getting second job while on partial UI - is this legal?

I've been working at a casino for about 2 years, but they recently cut everyone's hours to just 25 per week. I've been collecting partial unemployment benefits since the cut, but it's not enough to cover my bills. I finally found a second part-time job to make ends meet, but when I told my manager at the casino, they said I'd be terminated if I took the second job! How is this even legal? They cut my hours, forcing me onto partial UI, but now they're saying I can't work elsewhere to supplement my income? I'm really confused about my rights here. Has anyone dealt with something similar? I can't survive on 25 hours a week, but I don't want to lose my main job either. Would ESD consider this good cause to quit if they're preventing me from earning enough to live?

Thanks for the info. There's nothing in our handbook about second jobs, and the new job is completely different (retail) with no scheduling conflicts. I made sure the hours wouldn't overlap before accepting it. I'm going to ask for the termination threat in writing so I have documentation.

I didn't even think about them manipulating their UI tax rate! That's actually a really good point. There are about 30 of us all in the same boat with reduced hours. I'll reach out to HR tomorrow to see if this is actually company policy or just my manager being difficult.

Have you tried calling ESD directly to ask about your situation? They can give you the most accurate information about whether this would qualify as good cause to quit. If you call early in the morning right when they open, you might get through. I had to call them about a similar issue last month (employer changing my conditions after I was already on partial UI), and they were actually pretty helpful once I got through to a real person. The trick is actually reaching someone.

Good luck getting through to ESD! I tried calling them 47 times in one day last month and never got past the automated system. wait cant u just not tell ur main job about the 2nd job?? thats what i did when i was in a similar spot. as long as the schedules dont overlap they probly wont even find out

This is TERRIBLE advice! If OP gets caught, that would be legitimate grounds for termination with cause, which would disqualify them from UI benefits entirely. And since they're already on partial UI, ESD would find out about both jobs through wage reporting anyway. Don't risk your benefits by hiding employment!

I thought about that, but since I'm filing partial UI claims every week, both employers would be reporting my wages to ESD. The casino would see I have another job when they get their quarterly UI tax statements. Too risky.

One more important point: when you're on partial UI and add a second job, you need to report ALL earnings from BOTH jobs on your weekly claim. Your benefits will be reduced based on your total earnings, but as long as you're earning less than your weekly benefit amount + 1/3, you should still receive some benefits. Make sure you're reporting everything correctly to avoid an overpayment situation down the road.

Yes, I've been really careful about reporting all earnings! I was actually concerned about that too - if I take the second job and report those earnings, my partial benefits might stop completely. But at least I'd be making more overall with two part-time jobs than with one part-time job plus partial UI.

I went through EXACTLY this with my restaurant job in 2023! They cut my hours from 40 to 22, then tried to control when I could work my second job. I spoke to an L&I investigator who told me that while Washington is an at-will employment state, it could potentially be seen as constructive discharge if they're preventing you from earning a living wage while also not providing sufficient hours. Document everything! If they fire you for having a second job when they're only giving you part-time hours, that would likely be considered wrongful termination. My employer backed down when I mentioned L&I.

If you end up having to quit and file for full UI, make sure you're very specific about the circumstances in your application - that you were forced to choose between termination or economic hardship due to their restrictions on outside employment despite reduced hours.
