ESD approved my overpayment waiver without me applying - anyone received their refund/credit yet?

I'm still in shock after my phone call with ESD today! After being on hold for nearly 3 hours (seriously, my ear was numb), the agent told me something unexpected. They said I don't need to apply for an overpayment waiver because it was ALREADY approved for me automatically! The agent guaranteed "with 100% certainty" that my refund or "overpayment credit" had been approved. This is great news but now I'm confused and impatient. Has anyone else been told they were getting an automatic overpayment credit? If you've actually received yours, how much did you get compared to what you were originally told to pay back? And most importantly - HOW LONG did it take to actually see the money? I was originally hit with a $5,700 overpayment notice back in January, so I'm really hoping to see that money soon. The agent couldn't give me a timeframe which makes me nervous...

Same thing happened to me! They told me in February that my $3,200 overpayment was waived automatically but I STILL haven't seen a penny of it. When I called back they said "it's in processing" whatever that means 🙄 Been waiting 8 weeks now. The whole system is rigged to make us give up.

8 weeks?! That's ridiculous. Did they give you any indication of what "processing" actually means? I can't afford to wait that long.

I received my overpayment credit about 4 weeks after being notified mine was approved. The important thing to understand is that there are two different processes: first the waiver approval, then the actual refund processing. You need to ask specifically about the second part - the refund status, not just the waiver status. In my experience, the refund comes either as a direct deposit (if you have that set up) or as a paper check mailed to your address on file. Make sure your address is current in the system! One tip: if it's been more than 6 weeks since your waiver was approved, you should contact your state representative. They can often get things moving when you're stuck in ESD limbo.

Thank you! That's really helpful to know there are two separate processes. I'll call back tomorrow and specifically ask about the refund status rather than just the waiver. I do have direct deposit set up, so hopefully that speeds things up a bit.

3 MONTHS?? That's insane! Did you have to keep calling them or did it just show up one day?

Consider yourself lucky! Most people have to formally apply for the waiver and provide a ton of documentation to prove financial hardship. ESD must have automatically determined you were eligible based on your income information or other factors in their system. I had an overpayment of $4,200 that was eventually refunded, but it took about 45 days from waiver approval to seeing the money. The most important thing is to keep checking your ESD account online every few days. Mine showed up as a payment with "OVERPAYMENT CREDIT" in the description field before I got any official notification. Also, if you need to speak with ESD again but don't want to wait hours on hold, I had success using Claimyr (claimyr.com). They have a system that holds your place in line and calls you back when an agent is available. Saved me so much time! Their video demo shows how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3

Thanks! I'll check my online account regularly. That's good to know about the "OVERPAYMENT CREDIT" description - at least I'll know what to look for. And I might try that Claimyr service next time because today's 3-hour hold was absolutely brutal.

Is anyone else suspicious that ESD might be saying waivers are approved but then super slow-walking the actual repayments? Seems like a tactic to me. The longer they hold onto our money, the longer they can use it for their own purposes. Just saying what we're all thinking...

This is actually a common misconception. The delay isn't about holding onto funds - ESD doesn't benefit from delayed payments. The backlog is due to staffing shortages and the manual review process required for each case. While frustrating, there's no financial incentive for ESD to delay refunds. The agency actually has performance metrics that encourage faster processing.

Wait I'm confused. I received an overpayment notice too but nobody told me anything about automatic waivers??? Do I need to call them or will mine be automatic too? I owe like $2100 from miscalculated earnings last year. Sorry if this is a dumb question I just don't understand the whole process.

It's not a dumb question at all! The automatic waivers typically only apply to certain types of overpayments - usually ones that were the result of ESD error rather than claimant error. If your overpayment was due to miscalculated earnings that you reported, you'll likely need to formally request a waiver. Go to your ESD account, look for the overpayment section, and check if there's an option to request a waiver. If you can't find it, definitely call them to ask about your specific situation.

EVERYONE LISTEN UP! ESD is under pressure from the state auditor to clear up these overpayment issues by the end of the fiscal year (June 30th). That's why they're suddenly approving waivers left and right. If you're going to call about your overpayment, DO IT BEFORE JUNE 30!! After that the new budget cycle starts and they won't be as motivated to clear cases. Speaking from experience working with state agencies!!!

Whoa, this is really good to know! I'll definitely follow up before June 30th then. Thanks for the insider perspective!

This information isn't entirely accurate. While ESD does have performance goals, there's no special June 30th deadline for overpayment waivers. The agency processes claims throughout the year regardless of the fiscal calendar. Wait times may vary based on claim volume, but the fiscal year end doesn't create a special window for approvals.

my sister got her overpayment credit about a month after they told her it was approved. it was exactly the same amount as what they originally said she owed. but she said it just appeared in her bank account with no warning or explanation lol. typical esd

One month would be amazing compared to what others are saying! Glad your sister got hers. I'll keep an eye on my bank account then, sounds like they don't always notify you when it's coming.
