Can you get Washington ESD unemployment if you are on disability?
I've been getting disability payments for about 8 months now but my condition has improved and my doctor says I can work part-time or maybe even full-time again. I'm wondering if I can apply for unemployment benefits while I'm still technically on disability? I know there's probably some rule about being able and available for work but I'm not sure how that works with disability status. Has anyone dealt with this situation before? I'm worried about losing my disability if I apply for unemployment but I really need to get back to work.

This is actually more complicated than most people think. You can potentially receive both disability and unemployment but Washington ESD has strict requirements about being able and available for work. If you're on disability, you'll need to prove you can work despite your disability status.

•So I would need documentation from my doctor saying I can work? What kind of paperwork do they usually want?

Jasmine Hernandez
•Yes, medical clearance is usually required. Your doctor would need to specify what type of work you can do and any limitations.

I went through this exact situation last year! The key thing is that Washington ESD looks at whether you're currently able to work, not whether you were disabled in the past. If your doctor clears you for work, you should be eligible.

•That's really encouraging to hear! Did you have any issues with your disability payments when you applied for unemployment?

Luis Johnson
•No issues at all. I was transparent with both agencies about my situation and everything worked out fine.

•Wait, you can actually get both at the same time? I thought that was illegal or something.

Getting through to Washington ESD to discuss this kind of complex situation can be really frustrating. I had a similar question about disability and work requirements and couldn't get anyone on the phone for weeks. Finally used claimyr.com to get connected to an actual agent who could explain the rules properly. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Is that like a phone service? I've been trying to call Washington ESD for days and keep getting busy signals.

•Yeah exactly, it basically calls for you and gets you connected to a real person. Saved me hours of frustration.

The whole system is ridiculous. How are you supposed to be available for work if you're on disability? Makes no sense to me.

•Disability doesn't always mean unable to work. Many people on disability can work with accommodations or part-time.

•I guess that makes sense but the paperwork must be a nightmare.

You definitely need to be careful about this. I know someone who got in trouble for collecting both without proper documentation. Make sure you have everything in order before you apply.

•What kind of trouble? Like they had to pay money back?

Alina Rosenthal
•Yeah they had to repay unemployment benefits and there was some kind of penalty. Not sure of all the details.

•That's why it's so important to talk to Washington ESD directly about your specific situation before applying.

The key requirement is that you must be able and available for work each week you claim benefits. If you're receiving disability, Washington ESD will want proof that you can still meet this requirement despite your disability status.

•So it's not automatic disqualification? That's good to know.

Finnegan Gunn
•Correct, it's not automatic. But you'll need strong documentation and may face additional scrutiny during the adjudication process.

•It depends on the type of disability benefits you're receiving and your specific medical situation. Some disability programs allow limited work.

•ok that makes more sense i guess

I'm dealing with something similar right now. Been on disability for chronic pain but my new treatment is working and I want to try working again. Really nervous about losing my benefits though.

•I totally understand that fear. The transition back to work is scary when you've been depending on disability.

Miguel Harvey
•Exactly! What if I try to work and my condition gets worse again?

•That's why many disability programs have trial work periods and protections for people returning to work.

For anyone trying to get clear answers about this from Washington ESD, I really recommend using Claimyr. The phone system is so overloaded right now and this is the kind of question that needs a real conversation with an agent, not just the automated system.

•How much does that service cost? I'm already tight on money.

•It's way cheaper than the stress and potential problems from getting bad information or making mistakes with your claim.

UPDATE: I called my disability case worker today and she said I should definitely talk to Washington ESD before doing anything. She mentioned something about substantial gainful activity rules that could affect my disability if I earn too much from unemployment.

•That's smart to check with both sides. The income limits for disability can be pretty strict.

•Good thinking. It's always better to get official guidance before making moves that could affect your benefits.

This thread is really helpful. I didn't even know this was possible. I've been afraid to look for work because I thought it would automatically disqualify me from disability.

•There are actually programs designed to help people transition from disability back to work. Worth looking into!

•I'll definitely research that. Thanks for the info!

Still think the whole system is backwards. If you're healthy enough to work, why are you on disability? If you're too disabled to work, why are you applying for unemployment? Pick one.

•Disability isn't always black and white. People's conditions change, and many disabilities don't prevent all types of work.

Miguel Harvey
•Exactly. My disability affects my mobility but I can still do desk work. It's not that simple.

My sister went through this process about two years ago. She had to provide a lot of medical documentation but eventually got approved for unemployment while keeping her disability. The key was proving she could do specific types of work.

•That's really encouraging! How long did the whole process take?

Oliver Cheng
•It took about 6 weeks from application to approval, mostly because of all the extra documentation they required.

Just want to add that you should document EVERYTHING during this process. Keep copies of all medical records, letters from doctors, and correspondence with both agencies.

•Good advice. I'm already starting to organize all my medical paperwork.

•Yes, documentation is crucial. It protects you if there are any questions later.

Has anyone here actually had their unemployment claim denied because of disability status? I'm curious what the actual denial rate is for these situations.

•I haven't seen any official statistics, but from what I've observed it seems like most denials are due to insufficient documentation rather than automatic disqualification.

Jasmine Hernandez
•That matches what I've seen too. The key is having proper medical clearance before you apply.

Just to circle back on the Claimyr thing - I used it again yesterday to ask about a different issue and got connected in about 15 minutes. Way better than spending hours on hold or getting disconnected.

•I might have to try that. I've been trying to reach Washington ESD for over a week about my adjudication status.

One thing to consider is timing. If you're planning to return to work anyway, it might make sense to wait until you're actually cleared by your doctor before applying for unemployment. Cleaner paperwork trail that way.

Axel Far
•That's a good point. I have another appointment with my doctor next week so maybe I should wait until after that.

•Yeah, having everything lined up first will probably make the process smoother.

FINAL UPDATE: Talked to Washington ESD today (finally got through!) and they confirmed that I can apply for unemployment as long as I have medical clearance stating I'm able to work. Going to get that documentation from my doctor next week and then file my claim. Thanks everyone for the advice and encouragement!
