Can you be on disability and unemployment at the same time in Washington state?
I'm really confused about this situation. I've been receiving disability benefits for a back injury from my previous job, but my doctor says I might be able to do some light office work soon. A friend told me I could potentially file for unemployment too while I'm looking for suitable work, but I'm not sure if that's even legal? Has anyone dealt with this before? I don't want to get in trouble with Washington ESD or mess up my disability payments.

This is actually a complex situation that depends on your specific circumstances. Generally, to receive unemployment benefits in Washington, you need to be able and available for work. If you're receiving disability benefits because you can't work, that creates a potential conflict. However, there are some scenarios where you might qualify for both - like if your disability is partial or if you're cleared for certain types of work.

•My disability is specifically for manual labor due to my back. I can sit and do computer work fine. Would that make a difference?

•That could definitely help your case. You'd need to show Washington ESD that you're able and available for the type of work you can physically do. Make sure you have documentation from your doctor about your work restrictions.

I went through something similar last year. The key thing is being honest with both agencies about your situation. Washington ESD will want to know about your work limitations, and you need to actively be seeking jobs within those limitations. It's not automatic approval though.

•How did you handle the job search requirements? Did you have to apply to jobs you physically couldn't do?

•No, I only applied to jobs I could actually perform. I kept detailed records showing I was actively looking for suitable work within my restrictions. Washington ESD accepted this approach.

You definitely need to talk to someone at Washington ESD directly about this. The rules can be tricky and they'll need to evaluate your specific situation. I'd recommend using Claimyr.com to get through to an actual agent - their phone system is impossible otherwise. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Never heard of Claimyr before. Is it legit?

•Yeah it's real. They basically help you get through Washington ESD's phone system without waiting on hold forever. Worth it when you need to talk to someone about complex situations like this.

BE VERY CAREFUL with this. I know someone who got in trouble for collecting both without proper approval. Washington ESD takes this stuff seriously and if they think you're gaming the system, they'll come after you for overpayments.

•That's exactly what I'm worried about. I just want to make sure I'm doing everything legally.

•This is why getting official guidance from Washington ESD is so important. Don't rely on assumptions or what worked for someone else.

The main thing they'll look at is whether you're truly able and available for work. If you're on disability because you can't work AT ALL, then you probably can't get unemployment. But if you can work with restrictions, that's different. You need to be actively seeking work though.

•I am definitely able to work with restrictions. My doctor has cleared me for desk jobs and light office work.

•Then you might have a shot. Just make sure you document everything and be completely transparent with both agencies.

I'm dealing with a similar situation right now. Filed for unemployment two weeks ago and disclosed my partial disability status. My claim is currently in adjudication while they review everything. It's nerve-wracking but I'm hopeful since I can work within my limitations.

•How long have you been waiting for a decision? And did you need to provide medical documentation?

•Two weeks so far. Yes, I had to submit a letter from my doctor explaining my work capacity and restrictions. Washington ESD also wanted to see my job search activities.

This whole system is so confusing. Why can't they just have clear guidelines posted somewhere? I swear Washington ESD makes everything more complicated than it needs to be.

•The reason it's complex is because every situation is different. They have to evaluate each case individually to prevent fraud while still helping people who genuinely qualify.

One thing I forgot to mention - make sure you report your disability income when you file your weekly claims. They need to know about all income sources, even if it doesn't disqualify you from benefits.

•Good point. I definitely don't want to leave anything out that could cause problems later.

my cousin was on both for like 6 months before they caught it and made him pay everything back. not worth the risk imo unless you're 100% sure its legal

•Exactly what I was talking about. Washington ESD doesn't mess around with overpayments.

•That's terrifying. This is why I want to make sure I do everything by the book.

Honestly, your best bet is to call Washington ESD and explain your exact situation before filing. Get it in writing if possible. I know their phone system is a nightmare, but that's where Claimyr comes in handy - they'll get you through to an actual person who can give you official guidance.

•I think I'm going to try Claimyr. I've been trying to call Washington ESD for days and can never get through.

The unemployment office told me that being on disability doesn't automatically disqualify you, but you have to prove you're actively seeking work you can actually do. It's all about your availability for suitable employment.

•That makes sense. I'm definitely available for work within my physical limitations.

Whatever you do, don't try to hide the disability benefits. Washington ESD has ways of finding out and it'll look like fraud if you don't disclose it upfront.

•I would never try to hide it. I want to be completely honest about everything.

To summarize for the OP: Yes, it's potentially possible to receive both, but you need Washington ESD's approval first. You must be able and available for work within your restrictions, actively job searching, and completely transparent about your disability status. Get official guidance before proceeding.

Update us when you get through to Washington ESD! And seriously, try Claimyr if you can't get through on your own. It's been a lifesaver for situations like this where you really need to talk to someone.

The bottom line is that Washington ESD wants to make sure you're genuinely looking for work and not just trying to double-dip benefits. If you can prove you're actively seeking employment within your capabilities, you have a good chance of approval.

•That's reassuring. I am definitely serious about finding work within my limitations.

Just wanted to add that the job search log is super important if you get approved. Keep detailed records of every job you apply for and make sure they're all jobs you could actually do with your restrictions.

One last thing - if you do get approved, make sure you understand how your disability payments might affect your weekly benefit amount. Washington ESD might reduce your unemployment based on what you're receiving from disability.

•Good point. I'll ask about that when I talk to them. Thanks!
