Can I file for ESD unemployment a month after being laid off? Will I lose benefits?

I got laid off from my warehouse job almost a month ago but I haven't filed for unemployment yet because I was hoping to get another job quickly. My savings are running out and I'm starting to panic. If I file for ESD benefits now (4 weeks late), will they backdate my claim to when I first lost my job? Or have I permanently lost those weeks of benefits? I've never filed for unemployment before and I'm worried I've messed up big time by waiting this long.

You should file ASAP. ESD can backdate your claim in some situations, especially if you had a good reason for the delay. I waited 3 weeks to file last year and they DID backdate my claim but I had to jump through some hoops. You'll need to file your initial claim first, then after that's processed you'll need to file weekly claims for each of those backdated weeks separately. For each week you'll have to certify whether you were able and available to work, and that you were actively seeking work. Just be 100% honest about your job search activities (or lack thereof) during those weeks because they can check.

I did the EXACT same thing when I got laid off in January!!! waited for like 5 weeks thinking I'd get a new job fast. bad idea lol. yeah it was a NIGHTMARE getting through. I kept calling the main ESD number over and over for like 3 days straight. either busy signals or it would just disconnect me after waiting 2+ hours. I finally got through to someone who fixed it for me but seriously the phone system is the worst.

Be careful with backdating!!! ESD might consider this misrepresentation and could flag your account. My cousin waited 3 weeks and tried to get backdated and they put his whole claim under investigation for "potential fraud" which delayed his benefits for MONTHS. when i applied late they made me do job search requirements retroactively which was impossible cuz i didn't keep track before i knew i needed to. ended up just making up some job applications for those weeks. probably not the best advice but it worked for me lol
