Amazon fighting my Washington ESD unemployment claim - anyone else deal with this?
So I got laid off from Amazon warehouse last month (reduction in force they called it) and filed for unemployment right away. Now I'm getting letters saying Amazon is contesting my claim saying I was terminated for cause or something. This is complete BS - I never got written up or anything and my supervisor even said the layoffs were due to business needs. Has anyone else had Amazon fight their unemployment claim? I'm stressed because I need these benefits to pay rent. The adjudication process is taking forever and Washington ESD isn't giving me any updates.

Ugh yes Amazon contests a lot of claims. They have a whole department for this stuff. You'll probably win if you have any documentation showing it was a layoff not firing.

•I don't have much documentation except my final paycheck stub that says 'reduction in workforce' on it. Is that enough?

•That should definitely help your case! Keep that safe and make copies.

Amazon fights unemployment claims aggressively because it keeps their UI tax rates lower. If you were laid off due to business reasons, you should qualify for benefits. The burden is on them to prove misconduct, not on you to prove innocence.

•That makes me feel better. I was worried I did something wrong.

•Yeah companies do this all the time to save money on their unemployment insurance premiums. It's basically a business strategy.

I had a similar situation with Amazon last year. Took about 6 weeks to resolve but I eventually got approved. The key is responding to any requests for information from Washington ESD immediately. Also if you can't get through to them by phone, I used this service called Claimyr (claimyr.com) that helped me actually talk to someone. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ

•6 weeks?! I can't wait that long for benefits. How does that Claimyr thing work exactly?

•It basically calls Washington ESD for you and gets you connected to an actual person instead of sitting on hold forever. Worth it when you need answers fast.

•Never heard of Claimyr but anything that gets you through to Washington ESD faster sounds good to me. The phone system is a nightmare.

Amazon is known for this crap. They'll claim anything to avoid paying out. Document everything - emails, texts, performance reviews, anything that shows you were a good employee.

•I wish I had kept more records. I deleted most of my work emails when I left.

•That sucks but don't panic. Your pay stub showing RIF should be enough evidence.

wait so even if you get laid off they can still fight it?? I thought unemployment was automatic if you lose your job through no fault of your own

•Employers can contest any claim. It's their right under the system. But if they don't have valid reasons the claim will be approved.

•that's so messed up tho like why make people go through extra stress when they're already dealing with being unemployed

•Because it saves them money on their unemployment insurance taxes. It's all about the bottom line.

Amazon contested mine too when I left in 2023. They claimed I abandoned my job but I had given proper notice. Took 3 weeks but Washington ESD ruled in my favor. The adjudication process is slow but fair.

•Did you have to do a phone interview or anything?

•Yeah they called me and asked about the circumstances. Just be honest and stick to the facts.

This is happening to my cousin right now with Amazon. They're saying he was fired for attendance but he was actually injured on the job and taking workers comp time. These big companies have no shame.

•That's even worse than my situation. Hope he fights it.

•Workers comp and unemployment can get complicated. He should definitely appeal if they deny him.

I used to work in HR and can tell you that Amazon has a policy of contesting most claims as a matter of course. It's not personal, it's just their standard procedure. Most of the time if it was truly a layoff the employee wins.

•That's reassuring coming from someone who knows the system. Thank you.

•Yeah my brother works in HR too and says the same thing. Companies contest claims automatically sometimes.

Just went through this exact situation. Amazon fought my claim for 4 weeks then suddenly dropped their contest. I think they do it to buy time and hope people give up. Don't give up!

If you need to talk to someone at Washington ESD about your adjudication status, I also recommend checking out Claimyr. I was skeptical at first but it actually worked for me when I couldn't get through on my own.

Amazon is the worst for this stuff. They have teams of people whose job is to fight unemployment claims. It's disgusting how they treat workers even after letting them go.

Keep filing your weekly claims even while the adjudication is pending! A lot of people don't know this but you have to keep certifying or you'll lose benefits for those weeks.

Zoe Alexopoulos
•Yes I'm doing that. Washington ESD told me to keep filing even though I'm not getting paid yet.

•Good! That's important. Once it's resolved you'll get back pay for all those weeks.

I had Amazon contest my claim too and won. The key is being prepared for the fact finding interview. They'll ask about the circumstances of your separation so have your story straight and any documentation ready.

•I haven't gotten called for an interview yet. How much notice do they give you?

•Usually just a few days. They'll send a letter with the date and time.

Try calling Washington ESD early in the morning like 7:30am when they open. That's when you have the best chance of getting through.

•Yeah that's why services like Claimyr exist. The phone system is overwhelmed.

Been there done that with Amazon. They'll probably drop the contest once they realize you have documentation. They're just hoping you don't fight back.

Just remember that if Amazon had legitimate grounds to fire you for cause, they would have done it before the layoffs. The timing of their contest shows it's probably BS.

•That's a really good point I hadn't thought of. Why lay me off if I was such a bad employee?

•Exactly. Their own actions contradict their contest. You'll be fine.

Make sure you're documenting all of this for your records. If you have to appeal to a higher level you'll want a paper trail of everything that happened.

I went through something similar with Amazon about 8 months ago. They contested my layoff claim too, saying I had "performance issues" even though I was part of a clear RIF that affected my whole department. The adjudication took about 5 weeks but I eventually won. The key thing that helped me was getting a statement from my former supervisor confirming it was a layoff due to business needs, not performance. If you can reach out to your supervisor or any coworkers who witnessed the layoff situation, that could really strengthen your case. Also, keep checking your Washington ESD account online for any updates - sometimes they post decisions there before you get the letter in the mail.

•That's really helpful advice! Unfortunately I think my supervisor might have been laid off too in the same round of cuts, but I could try reaching out to some coworkers who are still there. Did you have any trouble getting your supervisor to provide that statement, or were they pretty cooperative about it?

Lim Wong
•My supervisor was actually pretty helpful about it. I think she felt bad about the whole situation since she knew it wasn't performance related. I just sent her a LinkedIn message explaining what was happening and asked if she'd be willing to provide a brief written statement. She sent me an email within a couple days that I was able to forward to Washington ESD. Even if your supervisor got laid off too, they might still be willing to help - they probably understand how unfair it is for Amazon to contest legitimate layoff claims.
