Social Security retirement filing mistake - switched from survivor benefits but now stuck in limbo for 2 months
I'm in a real mess with my Social Security benefits and don't know what to do anymore. I turned 72 this month and had filed for my retirement benefits back in May. When I got my determination letter in August, I was shocked to see it was about $525 less per month than I expected. I immediately went to my local SSA office where a rep showed me I'd actually get much more if I delayed my start date by just 3 months due to some earnings rule I didn't understand. The rep had me fill out an SSA-521 form to withdraw my retirement claim and keep my survivor benefits going in the meantime. They said they'd cancel my retirement application and restart my survivor benefits right away. That was 8 weeks ago! I've called at least 6 times. Last week someone told me my case was "transferred to the Payment Processing Center" but couldn't tell me anything else. Meanwhile, NOTHING is happening. My survivor benefits are still suspended, I've received no retirement payments, and Medicare is a complete disaster. I've had to pay $912 out of pocket for both my Medicare premium and my Advantage plan because they're not being deducted anymore. How much longer will this take? Will they automatically pay me the missed survivor benefits? And how do I get reimbursed for these Medicare payments I've had to make? The SSA office just keeps telling me to "be patient" but I'm burning through my savings waiting for this to resolve.

Ugh that's so frustrating! I had something similar happen last year when I switched from SSDI to retirement benefits. It took them 11 weeks to figure it out! The payment center is notoriously slow. Did they give you a confirmation number or anything for your withdrawal request?

•They gave me a receipt with some kind of reference number when I submitted the SSA-521, but when I call and give them that number, they just say it's "in process" and can't tell me anything else. 11 weeks is terrible - I can't wait that long! Did they at least pay you all the back benefits you were owed?

Based on what you've described, you're dealing with three separate issues: 1. The withdrawal of your retirement claim (SSA-521) 2. The reinstatement of your survivor benefits 3. The Medicare premium collection issue Unfortunately, the Payment Processing Center is currently running 6-10 weeks behind on special transactions like yours. The good news is you should be approaching the end of that window. When your case is completed, they should automatically reinstate your survivor benefits AND issue any back payments you were entitled to during this gap period. For the Medicare premiums, once your benefits restart, you'll need to specifically request reimbursement for the out-of-pocket premiums you paid. This won't happen automatically. Keep all receipts and bring them to your local office. You'll need to complete form SSA-795 (Statement of Claimant) detailing the amounts and dates. One thing to verify - make sure they processed your withdrawal request within 12 months of your original filing date, otherwise it might not be valid.

•Thank you for such a detailed explanation! Yes, my withdrawal was definitely within 12 months (only about 3 months after filing). I didn't realize I'd need to specifically request the Medicare premium reimbursement - nobody at SSA mentioned that. I'll start gathering my receipts now. Is there anything else I should be doing while waiting for the processing to complete?

I went through almost the exact same situation when helping my mother last year. The Payment Processing Center took forever, and calling the regular SSA number just led to frustration because the reps couldn't see what was happening at the processing center. After weeks of getting nowhere, I used a service called Claimyr (claimyr.com) to actually reach an agent without the endless waiting. You can see how it works in their video: https://youtu.be/Z-BRbJw3puU The service connected me to an SSA agent who was able to send an urgent message to the payment center. That seemed to speed things up, and my mom's case was resolved within a week after that. Might be worth trying if you're getting desperate.

•Does that claimyr thing actually work? I've been trying to get through to SS for DAYS and either get disconnected or told the wait is over 2 hours! Gonna check out that video right now

THE PAYMENT CENTER IS THE WORST!!!! They've had my husbands disability reconsideration for FIVE MONTHS with no updates. Every time we call they say the same thing - "still processing" and "we can't give you any timeline" I HATE THEM SO MUCH! The local office is useless too because they just blame everything on the payment center. I'm so sorry you're dealing with this nightmare. The whole system is BROKEN!!!!!

•Five months?? That's absolutely terrible! I'm struggling just with 8 weeks. I don't understand why they can't at least give us actual timeframes instead of leaving us in limbo. I hope your husband's situation gets resolved soon.

Im in similar situation but with disability. tried changing my payment date and its been 3 months with nothing happening. every time i call they just say its "processing" whatever that means. the payment center is backed up like crazy from what i hear. also for ur medicare - they WILL reimburse u but u gotta specifically ask for it when things get fixed. dont expect them to automatically do it. my dad had to pay 3 months of medicare and got all the money back but only cause he kept bugging them about it

•this is right - my sister didn't ask for her Medicare reimbursement and they never gave it to her. definitely fill out that 795 form like someone mentioned and be SUPER specific about the dates and amounts.

Have you tried contacting your Congressional representative? That's what finally worked for me. Their office has special liaisons at SSA who can often get info and move things along when we regular people get stonewalled. Google your rep and look for "constituent services" on their website.

•I hadn't even thought of that! That's a great suggestion. I'm going to look up my representative right now. Did you have to provide a lot of documentation when you contacted them?

•Just my SS#, contact info, and a brief explanation of the issue. They had me sign a privacy release form and took it from there. Took about 10 days to get results after contacting them.

One important thing to verify - when you submitted your SSA-521 withdrawal request, did you specifically check the box indicating you wanted your survivor benefits to resume? Sometimes this isn't communicated clearly, and they might have just processed a withdrawal without the resumption of survivor benefits. Also, since it's been 8 weeks, you might want to submit a request through SSA's online Critical Case system. Any case with suspended benefits for 7+ weeks qualifies as critical. Your local office should be able to submit this for you, which flags your case for expedited handling. Regarding the Medicare premiums, when your benefits resume, you may see an "adjustment" for the premiums that should have been deducted. Make sure this doesn't create an overpayment situation where they think you owe them for missed premiums while also not reimbursing what you paid out of pocket.

•Yes, the rep filled out the form with me and we definitely checked the box to resume survivor benefits. She even wrote "URGENT - RESTART SURVIVOR BENEFITS" at the top of the form. I didn't know about the Critical Case system - that's very helpful! I'll call my local office tomorrow about this. Thank you so much for the warning about the Medicare premium adjustment. I'll make sure to clarify that I've been paying them directly so I don't end up with an overpayment issue.

•Not yet! It's been 9 weeks now. I did contact my Congressional rep's office as someone suggested here, and they've opened an inquiry. They said they typically hear back from SSA within 30 days on these inquiries, which isn't great but at least it's something. I also tried calling the payment center directly (different than the main SSA number) but couldn't get through to anyone helpful.

After reading through this thread, I think contacting your Congressional representative was a smart move. Their constituent services can often push things forward much faster than we can as individuals. Just to confirm a few technical points: 1. The form you filed (SSA-521) requests withdrawal of a claim, which is different from simply changing your month of entitlement. If you only wanted to delay by 3 months, a withdrawal might have been more complicated than necessary. 2. For Social Security retirement benefits, changing your month of entitlement can affect your benefit amount due to the monthly delayed retirement credits you earn after Full Retirement Age until age 70. 3. When transitioning from survivor to retirement benefits, there's often confusion about the Medicare premium transfers, which is why you're experiencing the issues with having to pay out of pocket. Keep detailed records of all your out-of-pocket Medicare payments. When your case is resolved, you'll need to submit Form SSA-795 (Statement of Claimant) with copies of your receipts to request reimbursement. This won't happen automatically.

•Thank you for the additional information! You're right - it does seem like the SSA-521 withdrawal might have been more complicated than necessary if I just needed to change the start date. The rep at the office insisted this was the right approach, but now I'm wondering if there was a simpler way. I've started organizing all my Medicare payment receipts and bank statements showing the payments. Hopefully that will make the reimbursement process smoother when we finally get there.
