PA UC claim stuck 'under review' after being laid off during leave of absence - can I revise my claim?

I'm super confused about my UC situation. I originally took a leave of absence in January and my supervisor specifically told me to file for unemployment and that they 'wouldn't contest it.' So I did, but my claim has been sitting as 'under review' for almost 3 weeks now. I messaged HR about returning from leave last week and got a response saying I've been officially 'laid off' due to 'lack of work' which should definitely make me eligible! Is there any way to update or revise my existing claim to reflect this new information instead of starting over? I'm worried if I file a new claim it'll look suspicious, but my current one seems stuck. Has anyone dealt with something similar? I really need these benefits to start coming through soon!

Thats sooooo frustrating! When i was on leave last year my boss said the same thing but then the company contested it anyway!! You should def call them and explain the situation. But good luck getting through - I tried for 2 weeks straight last summer and kept getting busy signals.

Ugh that's what I'm afraid of! Did you eventually get your benefits? I've been calling every day this week but no luck getting through.

almost same thing happened to me but opposite lol. started as layoff then they tried to say I took voluntary leave. What u need to do is upload that message from HR as proof. in ur dashboard theres an option to upload documents. And make sure u keep filing ur weekly claims even tho ur not getting paid yet!

Thanks, I'll try uploading the message today. And yes, I've been filing my weekly claims! I wasn't sure if I should since the initial claim is still pending, but I've been doing it just in case.

You don't need to file a new claim. Your current claim needs to be updated with the new information about being laid off. You need to speak with a claims examiner to update your separation reason from "leave of absence" to "lack of work." This is important because a leave of absence is generally considered voluntary and can result in benefits being denied, while a layoff due to lack of work is clearly involuntary and typically qualifies for full benefits. Make sure you have documentation from HR confirming your layoff status (email, termination letter, etc.). This will be crucial evidence for your claim. Continue filing your weekly certifications while this gets sorted out - you'll receive back payments once approved.

I had to wait 5 weeks for my claim to be reviewed when I got laid off in February. The system is COMPLETELY BROKEN and they don't care about us at all. My advice is to keep calling and leave messages in your dashboard every single day. Eventually someone will look at it. Make sure you have PROOF of the layoff in writing because they will try to deny you otherwise. The whole system is designed to make people give up. DON'T GIVE UP!!!

5 weeks?! That's insane. Did you end up getting backpay for all the weeks you were waiting? I'm really worried about bills piling up while this gets resolved.

I recommend using Claimyr to get through to the PA UC service center. I was in a similar situation where my status changed from temporary layoff to permanent, and I couldn't get through on the phones for weeks. I found this service at claimyr.com that got me connected to a UC rep in about 40 minutes instead of calling for days. They have a video showing how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2 Once I got through, the rep was able to update my separation reason immediately and my payments started processing within a few days. For a situation like yours where you need to speak with someone directly to explain the status change, getting through on the phone is really the fastest solution.

Thank you! I'll check this out today. At this point I'd try anything to get this resolved. Did they backdate your payments to when you first applied?

Yes, they backdated all my payments to my initial filing date. The rep told me it's actually common for status to change from leave to layoff, and they have a specific procedure for handling it. Just make sure you have the email or letter from HR stating you were laid off due to lack of work.

wait so u were on leave and then got laid off during ur leave? or u were laid off and told to file it as a leave? im confused

Sorry if I wasn't clear! I took a leave of absence initially (personal reasons), then when I tried to return, they told me I was being laid off due to lack of work. So it started as a leave but became a layoff.

oh ok that makes sense. ya def need to tell UC that cuz leave might not qualify but layoff will

Just to follow up on my earlier comment, there are a few more specific things you should do: 1. Upload the HR communication about your layoff to your dashboard immediately under "Provide Additional Documentation" 2. Use the messaging system in your dashboard to specifically request a "Claim Status Update Due to Change in Separation Reason" - using this exact wording can help flag your case appropriately 3. Continue filing weekly claims without interruption 4. If you manage to speak with someone, get their ID number and note the date/time of the call Your situation is actually fairly common, and there is an established process for handling it. The challenge is getting someone to actually look at your case and make the update.

This is incredibly helpful, thank you! I've uploaded the email from HR and sent a message with that exact wording you suggested. Fingers crossed this moves things along.

did u remember to do ur work search activities? even with a pending claim u still gotta do them or they'll deny u when they review it

Yes! I've been doing my work search activities and recording them each week. At least that part I knew to do.

My cousin works at the unemployment office (not in PA tho) and she says they always look at leave of absence claims with extra suspicion so definitely get that updated to layoff status asap!!!

UPDATE: I finally got through to someone at the UC office! I used the Claimyr service someone suggested here and got connected in about 30 minutes. The agent was super helpful and immediately updated my separation reason from "leave of absence" to "lack of work" based on the HR email I uploaded. She said my claim should be processed within 3-5 business days and all my weekly certifications will be paid once it's approved. Such a relief! Thanks everyone for your help and suggestions!

That's great news! Makes me happy when someone actually gets help from this broken system. Let us know when the money hits your account!

Excellent outcome. This is exactly how the process should work. Make sure you continue filing your weekly certifications while waiting for the claim to be fully processed.
