PA UC approved then denied for 'illness/disability' reasons - how to appeal this contradiction?

I'm completely baffled by what just happened with my PA unemployment claim. This morning I received notification that I QUALIFIED for benefits (was so relieved!), but then literally 10 minutes later got another email saying I was DISQUALIFIED under Section 401(d)(1) - something about illness, injury, disability, and not being able to work? This makes absolutely no sense! I was laid off from my warehouse position last month due to staffing cuts. I have no health issues and am 100% able and available to work. Never mentioned anything about being sick or disabled on my application. Has anyone else experienced these contradictory decisions? I definitely want to appeal this nonsense, but I'm not even sure where to start. Do I need to call them first or is there an online appeal process I should use?

This happened to me last year! The system is completely messed up. You need to file an appeal ASAP - you only have 15 days from the date on that disqualification notice. Log into your UC account, go to the 'Determinations and Issue Status' section, find that denial, and there should be an option to appeal. MAKE SURE to be very clear in your appeal that you are able and available to work, were never sick/disabled, and that you received contradictory decisions. The appeal form isn't very user-friendly but just fill out as much detail as possible about why the decision is wrong.

I work in HR and see this often with our former employees. This is likely an automated flag in their system. The 401(d)(1) disqualification is specifically for people who tell PA UC they can't work due to medical reasons. I'm guessing either: 1. You accidentally answered 'No' to a question about being able to work 2. Something in your separation info from your employer triggered it 3. Pure system glitch Either way, absolutely appeal this! When you do, specifically state: "I am able and available for full-time work with no restrictions or limitations. I have no illness, injury or disability preventing me from working. I was laid off due to staffing cuts, not for any medical reason." Also, make sure to continue filing your weekly claims while the appeal is pending. If you win the appeal (which you should), they'll only pay for weeks you properly certified for.

THE EXACT SAME THING just happened to me last month!!! It's absolutely RIDICULOUS how they're running things over there. I got the approval then denial notices too and spent DAYS trying to get through on the phone! The UC system is COMPLETELY BROKEN!!! I ended up waiting 3 weeks for my appeal hearing and they fixed it, but those were 3 weeks with NO MONEY coming in while I had bills to pay!!

I'm having the same issue now but can't even get through to anyone on the phone. Been calling for days with no luck, just busy signals or disconnects after waiting on hold forever! Has anyone found an easier way to actually reach a human at PA UC?

Have you tried using Claimyr? It's the only way I managed to actually speak with someone at PA UC after trying for weeks on my own. Their system calls for you and holds your place in line. This is definitely a problem with how the system is categorizing your claim. Appeal it right away and keep detailed records of everything - dates, times, confirmation numbers of any submissions. When I went through the appeal process, they asked for all these details, so start keeping track now. And yep, like others have said, don't stop filing weekly claims during this time!

@OP for your appeal hearing, gather any evidence you have showing you're able to work. If you've been applying for jobs, bring those application records. If you have a doctor's note stating you're fit for work, bring that too. The more documentation you have contradicting their claim that you're unable to work due to disability/illness, the stronger your case will be.

yes good advice i had 2 bring my job search records to my hearing. also dress nice for the hearing even if its over phone - they can tell if ur taking it serious

@concerned_claimant Yes, you absolutely must continue to complete your work search activities while appealing! The law requires you to complete at least 2 work search activities each week regardless of your appeal status. If you win your appeal but didn't do your work search, you'll still be disqualified for those weeks. Document everything!

UPDATE: I submitted my appeal online and took screenshots of everything. Now waiting for my appeal date. I also managed to get through to someone on the phone after using that Claimyr service someone suggested. The agent confirmed it was likely a system error and added notes to my case. She said to expect about 3-4 weeks for the appeal hearing but to keep filing weekly claims. Thanks everyone for your help - will update when I hear about my hearing date!
