PA UC appeal hearing scheduled - can I still file weekly claims with no open issues?
I got hit with a bombshell last week - just found out my former employer is appealing my unemployment benefits. They're claiming I was terminated for cause (totally not true, they downsized my entire department). My appeal hearing is scheduled for Monday morning, and I'm freaking out about what happens to my benefits. Here's my confusion: I currently don't have any 'open issues' showing on my PA UC dashboard. Everything looks normal there. Can I keep filing my weekly claims during this appeal process? Will payments continue until a decision is made on the appeal? Or does everything freeze once the appeal hearing starts? I absolutely NEED these payments to cover rent next month. Anyone been through this nightmare before?

Yes, you should absolutely continue filing your weekly claims even during the appeal process. The golden rule of PA unemployment: NEVER stop filing your weekly claims regardless of what's happening with your case. If you win the appeal, they can only pay you for weeks that you properly certified.

Yes I won! The judge saw right through my employer's story. I got the decision letter about 10 days after the hearing. Just be honest and you'll be fine. The burden is on them to prove misconduct, not on you to prove innocence.

slightly off topic but make sure ur doing ur job searchs every week too even during this appeal thing!!! my cousin lost benefits cuz she forgot to do this during her appeal process thinking it didnt matter cuz of the appeal but they are seperate requirements!!

One more bit of advice for your hearing: if your employer brings up any new accusations during the hearing that weren't part of their initial appeal, you can request a continuance (basically a postponement) so you have time to prepare a response to these new allegations. Judges will typically grant this if the employer tries to introduce completely new reasons for termination during the hearing.
