I'm trying to figure out which would give me higher weekly payments - staying on disability or switching to unemployment benefits through NYS Department of Labor. I've been on disability for 8 months after a workplace injury but my doctor says I can do light work now. My disability pays $420 a week but I'm not sure what unemployment would be. Does anyone know how NYS Department of Labor calculates weekly benefit amounts? I made about $52,000 last year before my injury. Would it be worth switching or should I stay on disability until I find something?

With $52k annually, you're probably looking at around $450-500 per week in unemployment benefits, but you'd need to be able and available for work. The maximum weekly benefit in NY is currently $504. You can't collect both disability and unemployment at the same time since disability means you can't work and unemployment requires you to be actively seeking work.

be careful about this - if youre still getting disability payments you cant file for unemployment. i made this mistake last year and had to pay back money to NYS Department of Labor. you have to be completely off disability first

honestly the unemployment system is such a mess anyway. even if you qualify for more money with unemployment good luck actually getting it paid out on time. disability at least comes regularly
