What is a separation/unemployment notice from NYS Department of Labor?

I got fired from my job last week and my former employer mentioned something about a separation notice or unemployment notice they have to send to NYS Department of Labor. What exactly is this document? Do I need to wait for it before I can file my unemployment claim? I'm worried about delays since I need to start getting benefits as soon as possible. Also not sure if this is different from the regular paperwork they give you when you get terminated.

A separation notice is basically your employer's official report to NYS Department of Labor about why your employment ended. They're required to submit this within a few days of your termination. It includes details like your last day worked, reason for separation (fired, laid off, quit), and your final wages. You don't need to wait for this to file your claim - you can file immediately. The NYS Department of Labor will use this notice during their adjudication process to verify your eligibility.

Thank you! So I can go ahead and file my claim today even though I haven't seen this separation notice yet?

Just to add - if there's any discrepancy between what you report when filing and what your employer puts on the separation notice, that's when your claim might go into adjudication for review. Make sure you're accurate about your last day worked and reason for leaving when you file your initial claim. The earlier you file, the earlier your benefit year starts.

What happens if my employer lies on the separation notice? My boss fired me but I'm worried he might say I quit to avoid paying higher unemployment taxes.

If there's a discrepancy, NYS Department of Labor will contact both you and your employer during adjudication to get the facts. You can provide documentation like emails, texts, or witness statements to support your version of events. Don't worry too much - they investigate these situations regularly.

Had issues reaching NYS Department of Labor when my separation notice was wrong. Tried calling for weeks with no luck. Finally used Claimyr (claimyr.com) and got through to an actual agent who helped me dispute the incorrect information. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Made the whole process way less stressful than constantly redialing the overwhelmed phone lines.

Never heard of that service before. Did it actually help you get your claim approved faster?

Yeah, the agent was able to explain exactly what documentation I needed to submit and where to send it. Saved me probably weeks of confusion and waiting.

The whole separation notice thing is just another way for employers to try and screw you over honestly. My last company took forever to submit mine and then claimed I was fired for misconduct when I was actually laid off due to budget cuts. Had to appeal and everything.

This is really helpful info everyone! I'm dealing with a similar situation where I was laid off but worried my employer might report it differently. Quick question - is there a way for us to see what our employer actually submitted on the separation notice, or do we only find out if there's a problem during adjudication? Want to make sure I'm prepared in case there are any discrepancies when I file my claim.
