What happens after you file for unemployment with NYS Department of Labor?

I'm considering filing for unemployment benefits but I have no idea what to expect once I submit my application. Like what's the actual process after you file? Do they contact your employer right away? How long before you know if you're approved? I've never done this before and honestly feeling pretty overwhelmed about the whole thing. Any insight would be really helpful.

After you file your initial claim with NYS Department of Labor, here's what typically happens: 1) They'll review your application and employment history 2) Contact your former employer to verify your separation reason 3) You'll need to file weekly claims even while waiting for approval 4) If there are any issues, your claim goes into adjudication which can take several weeks 5) Once approved, you'll receive your monetary determination showing your weekly benefit amount. The whole process usually takes 2-4 weeks if there are no complications.

Thank you! Do I need to keep looking for work while I'm waiting for approval or does that start after I'm approved?

You should start your job search immediately and keep a log of your activities. NYS Department of Labor requires you to be actively seeking work from day one, even during the approval process.

just filed mine last week and already got my first weekly claim certification to complete, so yeah you start doing those right away even before approval

The key thing is staying on top of your weekly claims. If you miss filing a weekly claim, you can lose benefits for that week even if you're eventually approved. Also, be prepared for possible adjudication delays - if your employer contests the claim or there's any question about your eligibility, it can extend the process significantly. I'd recommend calling NYS Department of Labor if you don't hear anything after 3 weeks, but good luck getting through - their phone lines are constantly busy.

OMG yes the phone situation is ridiculous! I've been trying to call for two weeks about my adjudication status and can't get through to anyone. It's so frustrating when you need answers.

I had the same problem reaching NYS Department of Labor by phone. Someone on here recommended Claimyr which helps you get through to an agent - you can check it out at claimyr.com. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. I was skeptical but it actually got me connected to resolve my adjudication issue after weeks of trying on my own.

been through this process twice now and honestly it's different every time depending on your situation... first time was smooth sailing, second time got stuck in adjudication hell for 6 weeks because my employer made some bogus claim about my termination

That's scary - what kind of bogus claim? I'm worried my employer might try to fight it even though I was laid off.
