New York Unemployment overpayment taking my tax refund - any way to stop this?
Got hit with an unemployment overpayment and now they're gonna take my tax refund. Really need that money this year for bills and rent. Anyone know if theres a way to stop them from taking the refund or maybe work out a payment plan instead? Getting desperate here cause that refund was gonna help me catch up on everything.

Same thing happened to me last year. You need to call them ASAP and request a waiver or payment plan. But getting through on the phone is literally impossible these days.

Look into filing a hardship waiver. You'll need to prove financial hardship but it might help stop them from taking your refund. Document EVERYTHING - bills, rent, expenses, etc. The more proof the better.

Honestly, your best bet is to be proactive about this. Here's what you need to do: 1. Contact NY unemployment IMMEDIATELY using claimyr.com since getting through normally is impossible 2. Request a payment plan or hardship waiver 3. Gather all your financial docs showing hardship 4. Get everything in writing 5. Hey OP, I went through this exact same nightmare last year. Here's what actually worked for me: First, file an appeal ASAP if you haven't already - you usually have 30 days from when you got the overpayment notice. Even if it's past the deadline, still try because sometimes they accept late appeals for good cause. Second, definitely request a hardship waiver like others mentioned. I had to show bank statements, rent receipts, utility bills, medical expenses - basically prove you can't afford basic necessities. They actually approved mine and wiped out the whole overpayment. Third, if all else fails, you can request a payment plan for like $25-50/month instead of them taking your whole refund. Way better than losing everything at once. Don't give up!
