NYS Department of Labor unemployment under review how long does this usually take?

My unemployment claim has been showing 'under review' status for almost 2 weeks now and I'm starting to get really worried. I filed my initial claim on January 8th and everything seemed fine at first - I was able to certify for my first week without any problems. But then when I tried to certify for my second week, the system told me my claim was under review and I haven't been able to get any payments since. I've been checking my.ny.gov account every day but there's no explanation of what they're reviewing or how long it might take. Has anyone else dealt with this 'under review' status? I really need to know how long this process usually takes because I have rent due next week and I'm getting desperate.

The 'under review' status usually means NYS Department of Labor is conducting an adjudication on your claim. This typically happens when there's a question about your separation from employment, your availability for work, or your job search activities. The review process can take anywhere from 2-6 weeks depending on the complexity of the issue and their current workload. You should continue filing your weekly claims even while under review - if you're approved, you'll get back pay for all the weeks you certified.

Thank you! Should I be doing anything specific while I wait? I've been applying for jobs but I'm worried they might think I'm not actively searching.

same thing happened to me in november, took exactly 3 weeks and then everything got approved at once. just keep filing your weekly claims and don't panic yet

That's somewhat reassuring. Did they ever tell you what they were reviewing or did it just suddenly get approved?

never got an explanation, just woke up one day and saw all my payments posted to my account

If you need to speak with someone about your review status, I'd recommend checking out claimyr.com - they help people get through to NYS Department of Labor agents by phone. There's a demo video at https://youtu.be/qyftW-mnTNI that shows how it works. I used it last month when my claim was stuck in adjudication and was able to get connected to someone who explained exactly what documents they needed from me.

Is this like a paid service? I'm already struggling financially and can't afford to pay extra fees just to talk to someone at NYS Department of Labor.

They do charge for the service but honestly it saved me weeks of trying to get through on my own. The regular NYS Department of Labor phone lines are basically impossible to reach right now.

THE WHOLE SYSTEM IS BROKEN!!! I've been waiting 5 WEEKS for my review to finish and still nothing. Meanwhile my landlord is threatening eviction and I can't even get a human being on the phone to explain what's taking so long. This is absolutely ridiculous - people need their benefits to survive and NYS Department of Labor just leaves us hanging with no communication.

I feel your frustration but getting angry won't help. Have you tried contacting your local assembly member's office? Sometimes they can help push things along.

Keep in mind that reviews often happen when there's conflicting information between what you reported and what your former employer reported. Make sure you have documentation ready - pay stubs, termination letter, any emails about your separation. If they determine you were terminated for misconduct or quit without good cause, you could be disqualified. But if it's just a routine verification, you should be fine once they complete the review process.

I went through this exact same situation last year and it's definitely nerve-wracking. In my case, the review took about 4 weeks and turned out they were just verifying my employment dates with my former employer. The good news is that once it was resolved, I received all the back payments for the weeks I had certified during the review period. My advice would be to keep documenting your job search activities thoroughly - save screenshots of applications, keep a log of contacts with employers, etc. This will be helpful if they ask for proof of your work search efforts. Also, don't stop filing your weekly certifications even though you're not getting paid yet - this is crucial for getting your back pay once the review is complete. Hang in there, it's frustrating but most reviews do get resolved eventually.

Thank you for sharing your experience - it's really helpful to hear from someone who went through the same thing. I've been keeping track of my job applications but I wasn't saving screenshots, so I'll start doing that right away. Did they ever contact you directly during the review process or did it just resolve on its own? I'm worried I might miss some important communication from them.

I'm going through this exact same thing right now - my claim has been under review for about 10 days and I'm also really anxious about it. From what I've been reading online and hearing from others, it seems like most reviews are just routine verification processes where they double-check information with your previous employer or verify your eligibility. The waiting is definitely the worst part because they don't give you any updates or timeline. I've been continuing to file my weekly certifications as everyone recommends, and I'm trying to stay patient even though it's really hard when bills are piling up. One thing that's helped me is knowing that if the review goes in your favor, you'll get all the back pay for the weeks you certified during the review period. Hopefully both of our reviews get resolved soon!

I'm in the exact same boat - filed on January 10th and been under review for about 10 days now. It's so stressful not knowing what's happening or when it might get resolved. I keep checking my account multiple times a day hoping for some update but nothing changes. At least we're not alone in this situation! I'm also continuing to file my weekly certifications and keeping detailed records of my job search just in case they ask for it later. Fingers crossed we both hear something soon - the uncertainty is almost worse than knowing there's a problem.
