NYS Department of Labor unemployment eligibility after termination - what are my chances?

I got terminated from my retail job last week and I'm trying to figure out if I can get unemployment benefits through NYS Department of Labor. My manager said I was late too many times but I had legitimate reasons (car trouble, family emergencies). I've been working there for 8 months and this is my first time being fired. Does anyone know if you are fired are you eligible for unemployment in New York? I'm really stressed about paying my rent next month and need to know if I should bother applying or start looking for other options immediately.

You can still apply for unemployment even if you were fired, but NYS Department of Labor will review your case during adjudication to determine if the termination was for misconduct. Being late repeatedly could be considered misconduct, but if you had valid reasons and can document them, you might still qualify. The key is whether your actions were willful or beyond your control. File your claim as soon as possible and provide all documentation about your reasons for being late.

Thanks! I do have some documentation like towing receipts and hospital records. Should I upload all of that when I file my claim online?

I was fired for attendance issues too and NYS Department of Labor approved my claim after about 3 weeks of adjudication. The trick is proving your absences weren't willful misconduct. Make sure you have documentation for every incident and explain the circumstances clearly in your initial filing. Don't give up - even if you think you might not qualify, let them make the decision.

How long did the whole process take once you submitted your documentation? I'm in a similar situation.

If you're having trouble reaching NYS Department of Labor to check on your claim status or provide additional information, I used a service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really helped when I was stuck in adjudication for weeks and couldn't get anyone on the phone to explain what documents they needed.

That sounds helpful, I'll check it out if I run into issues with my claim. Thanks for the tip!

honestly the whole system is a joke, they make you jump through hoops even when you have legitimate reasons for everything. I got denied twice before finally getting approved and it took MONTHS. but definitely still apply because you never know

File ASAP! The longer you wait the longer it takes to get your first payment. Even if there's adjudication you want to get in the system.
