NY unemployment benefits end date August 9th text message - anyone else get this?

Has anybody received a text or an email saying their NY unemployment benefits will end on August 9th, 2025? I just saw something about this on my account but wasn't sure if it was legit or not. Will they send out the text messages next week to confirm? Kinda freaking out since I was counting on at least another month of benefits based on what the calculator told me when I first applied.

I got this notification last week. Called NYSDOL and after waiting for almost 2 hours, they told me it's because we're reaching the end of our benefit year. If you started claiming around August last year, your benefit year ends after 52 weeks, regardless of whether you've used all available weeks or not. You might need to file a new claim if you're still unemployed after August 9th.

Ugh that makes no sense! My original letter said I had 26 weeks of benefits and I've only used like 18 of them. How can they just cut it off?

It's confusing but there are two different limits - the maximum number of weeks (26) AND the benefit year (52 weeks from when you first applied). You hit whichever comes first. So even if you haven't used all 26 weeks, if your benefit year ends, that's it. You would need to reapply for a new benefit year.

This is a standard notification that goes out to claimants approaching their benefit year ending (BYE) date. The benefit year is 52 weeks from when you first filed your claim, regardless of how many weeks of benefits you've actually collected. If you haven't used all 26 weeks of benefits but your benefit year is ending, you need to file a new claim. There's no waiting period between benefit years, but you will need to meet the earnings requirements for the new base period. You'll need to have earned at least 30x your weekly benefit rate in the last 18 months, with earnings in at least two calendar quarters. If you haven't worked since your last claim, you might not qualify for a new claim.

Thank you for explaining! So I did work for about 3 months between claims - from September to December 2024. Would that be enough to qualify for a new claim?

It depends on how much you earned during those months and what your weekly benefit rate was. If you earned at least 30 times your weekly benefit rate during those three months, you might qualify. The system will automatically calculate this when you file your new claim.

THIS IS WHY THE SYSTEM IS BROKEN!!! They don't explain ANY of this when you sign up. First they tell you 26 weeks then suddenly cut you off at a random date. Then expect you to somehow get through to an agent to figure it out. I spent DAYS trying to reach someone when this happened to me last month.

I had the same frustrating experience trying to reach someone at NYSDOL. What worked for me was using Claimyr.com - it got me through to an agent in about 20 minutes when I'd been trying for days. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE The agent explained that the benefit year ending is separate from your total weeks available. Even though it seems unfair, it's actually built into the law that unemployment claims expire after 52 weeks.

Thx for the tip! Will check that out cause I actually need to call them again about my 1099-G form that still hasnt come

The August 9th end date is completely normal and expected. Here's how unemployment benefits work in NY: 1. You get a MAXIMUM of 26 weeks of benefits 2. Your claim expires after 52 weeks (your benefit year) 3. Whichever limit you hit first applies So if your benefit year ends before you use all 26 weeks, you lose the remaining weeks. You need to file a new claim after your benefit year ends, but you must have worked and earned enough during your previous benefit year to qualify. This isn't them cutting anyone off early - it's exactly how the program is designed to work. Check the NYSDOL handbook that explains all this in detail.

But why wouldn't they tell us this CLEARLY when we first apply?? The online system just says '26 weeks' and makes it seem like thats guaranteed! Super misleading imo

Update: I called NYSDOL this morning and finally got through. The rep confirmed what everyone's saying - my benefit year is ending on August 9th. She said I should file a new claim online starting August 10th. Apparently I did earn enough at my temp job last fall to qualify for a new claim, but my weekly amount might be lower. Thanks everyone for the help!

Glad you got through! Good luck with the new claim. Just remember to keep certifying weekly while your new claim is processing - if it gets approved, they'll backpay you for those weeks.

does anyone know if we have to submit all our work search records when we refile? i haven't been keeping great track the past few months tbh

Yes, you should be prepared to provide work search records if requested. They don't always ask, but they can request them at any time. You're required to keep records for one year, so start documenting properly now in case they audit you.
