How much unemployment will I get if I get fired from my job in NY?

I'm worried my boss might fire me next week and I have no idea what to expect if I file for unemployment. I make $28 an hour working full time at a warehouse job in Rochester. Does anyone know how NYS Department of Labor calculates the weekly benefit amount? I've never filed for unemployment before and I'm trying to figure out if it'll be enough to cover my rent and bills while I look for another job. Also does it matter why I get fired? My supervisor has been giving me a hard time lately but I haven't done anything wrong that I know of.

The NYS Department of Labor calculates your weekly benefit based on your highest earning quarter from the past 4-5 quarters. At $28/hour full time you're probably looking at around $350-450 per week maximum, but it depends on your exact earnings history. As for getting fired, you can still get benefits unless it was for misconduct or willful violations of company policy. The key is whether you were terminated for cause or just let go for business reasons.

That would actually help a lot, my rent is $950 so with some savings I could probably make it work. When you say misconduct, what exactly counts as that?

i got fired last year and got like $380 a week, made about the same as you. took forever to get approved though, they had to do some investigation thing called adjudication. be prepared to wait

How long did the adjudication take? And did you have to prove anything specific about why you got fired?

like 3 weeks i think? they called my old boss and asked questions. just be honest about what happened

If you're having issues reaching someone at NYS Department of Labor about your claim status or have questions during the adjudication process, I found a service called Claimyr that helps you get through to an actual agent. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. I was stuck in adjudication for weeks and couldn't get anyone on the phone until I used their service. Much easier than sitting on hold for hours.

Interesting, never heard of that. How much does something like that cost?

They focus more on the value of actually reaching someone rather than the cost. When you're waiting weeks for benefits, it's worth checking out their demo to see if it makes sense for your situation.

The NYS Department of Labor unemployment system is so messed up honestly. They make you jump through hoops to get money you already earned and paid into. And don't even get me started on their job search requirements - you have to apply to 3 jobs every week and keep detailed logs or they'll cut you off. It's like they want to make it as difficult as possible.

yeah the job search thing is annoying but at least you can do it online now

Just want to add that if you do get fired and they claim it was for misconduct, you have the right to appeal their decision. The NYS Department of Labor will schedule a hearing where you can present your side of the story. Don't just accept a disqualification if you think it's unfair - appeal it within 30 days of getting the determination letter.
