Can my daughter claim NY unemployment benefits she missed filing for 2 weeks ago?

My daughter started receiving NY unemployment in January but she forgot to claim benefits for 2 weeks in March because she was in the hospital (nothing serious, just a procedure). She's back to claiming regularly now but is wondering if there's any way to go back and get those 2 missed weeks? She really needs the money and it was about $1100 she missed out on. The website doesn't seem to have any option for claiming past weeks. Does she need to call someone? Is there a form? Or is that money just lost forever? She's been stressing about this for days.

Yes, she can absolutely request backdate payments for those missed weeks! In NY, it's called requesting a "retroactive certification." She needs to call the NYSDOL directly at their claims center - this can't be done through the website. Make sure she has her NY.gov ID and PIN ready, plus the exact dates of the weeks she missed filing for. Just be prepared that the phone lines are incredibly difficult to get through. It might take many attempts.

Thank you for this info! Do you know if there's a time limit for how far back she can request these missed weeks? It's been about 2 months since she missed those certifications.

The time limit is actually 30 days from the end of the week she's trying to claim for. So technically she's already past that window, but NYSDOL does make exceptions for good cause, especially for medical reasons like a hospital stay. She should still try calling and explain the situation.

Oh no, if it's 30 days then she's definitely past that. But she does have documentation from the hospital. I'll tell her to call and explain the situation.

My sister went through something similar last year when she was in a car accident and missed filing for 3 weeks. She got a doctor's note explaining she was incapacitated and they approved her backdated claims even though it was like 6 weeks later. So there's definitely hope!

I tried calling them for a similar issue last month and spent THREE DAYS trying to get through. Kept getting the "we're experiencing high call volume" message and disconnected. NYSDOL phone system is a complete joke. I finally got through using this service called Claimyr that connects you to an unemployment agent. Costs money but saved me like 8 hours of redialing. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE The NYSDOL rep was actually really helpful once I got through and approved my backdated certification because I had a legitimate reason (also medical). Just make sure your daughter has her hospital paperwork ready when she calls.

I've never heard of this service before. Did you have to give them personal information? I'm always a bit worried about these third-party services.

They just need your phone number so they can call you back when they get an agent on the line. You don't give them any unemployment info or anything like that. It's basically just a service that does the calling and waiting for you. Then they connect you directly with NYSDOL and you handle everything yourself from there.

wait i'm confused does she still get paid if she doesnt certify every week???

No, you must certify each week to receive benefits for that week. That's why OP's daughter needs to request retroactive certification for the weeks she missed - otherwise she won't get paid for those weeks.

Your daughter needs to submit form TC-403E "Request for Backdated Claim Credit" along with her proof of hospitalization. My cousin works for NYSDOL and tells me they're generally understanding about medical situations, but she will need to speak with an actual agent who can process this request. The 30-day limit can be waived for "good cause" - and hospitalization definitely qualifies. Also, when she calls, have her specifically ask for a "backdated certification due to medical circumstances" rather than just asking about missed weeks. Using the right terminology helps get to the right department faster.

Is this a real form number? When I had to backdate a claim last year they just took the information over the phone. I don't remember filling out any forms...

i missed a week last year cause i was on vacation and completely spaced on doing my weekly claim. called them and they were like sorry too bad. but i think hospital is different maybe?

Correct. Vacation isn't considered "good cause" for missing certifications, but hospitalization or serious illness is. The NYSDOL has discretion on what constitutes good cause, and medical issues are generally accepted.

Thanks everyone for the advice! She's going to try calling tomorrow morning when they first open. I told her to be prepared for a long wait but to be persistent. I'll let you know how it goes if anyone's curious.

Good luck!! The early morning strategy sometimes works but honestly it's a total crapshoot with their phone system. If she can't get through, maybe try that Claimyr thing someone mentioned above?

UPDATE: She couldn't get through this morning after trying for 2 hours. She's going to try the Claimyr service tomorrow. I'll update again when we know something!
