Can I get ny unemployment for covid quarantine time after exposure at work?

So heres what happened. I've been working at a retail store for about 7 months now. Last week, my manager called to tell me that one of my coworkers tested positive for COVID, and since we had shifts together 3 days before, I needed to quarantine for 10 days according to company policy. The health department also contacted me and confirmed I should isolate. I'm not sick and tested negative, but still cant return to work until next Thursday. That's almost two weeks with zero income! I tried calling my HR department to see if there's any payment available during mandatory quarantine, but they said I should apply for unemployment for the missed days. Has anyone done this successfully with NY unemployment? Do I qualify even though its temporary and I'm going back to my job after quarantine? I really need the money since I have rent due soon.

Yes you qualify! This happened to me in December. I got placed on a 10 day quarantine after a coworker in my department tested positive. I filed online for the days I missed and got approved in about 2 weeks. Make sure you select "lack of work" as the reason and explain in the comments its for COVID quarantine due to workplace exposure. You'll have to do the weekly certifications while your waiting for approval. I had to upload the letter from the health dept as proof during the process.

Thank you! Did your employer fight it at all? Mine seems kinda sketchy about the whole thing and im worried theyll try to deny it.

My employer actually helped me with the process. They should be providing you with documentation of the quarantine requirement. If they're being difficult, get the health department document showing your exposure date and quarantine period.

just fyi this might not work anymore. my cousin tried this last month and was denied because they said the covid emergency programs ended. anyone know if thats true?

The special COVID programs did end, but regular unemployment should still cover quarantine if you're missing work with no pay. It's basically a temporary layoff situation.

After struggling with the same situation, I found this service called Claimyr that totally saved me. I was about to lose my mind trying to reach someone at unemployment to explain my quarantine situation. The website (claimyr.com) connected me with an actual human at NY unemployment in less than an hour! Talking to a real agent got my quarantine benefits approved right away. Best decision I made - watch this to see how it works: https://youtu.be/Rdqa1gKtxuE

Is this for real? The ny unemployment phone system is literally hell. I spent 4 days calling and never got through.

100% real. I was skeptical too but I was desperate after spending 3 days trying to get through. They basically call for you, wait on hold, then connect you when a real person picks up. Talking to an agent got my issue fixed in one call.

yeah right, another 'miracle solution'... what's the catch? 🙄

No catch - it just works. I was in the same boat as OP with a COVID quarantine situation. Had to explain my specific circumstances to an agent. Without getting through on the phone I would've been screwed.

not falling for another unemployment 'hack'... these never work

I actually used this last month for a different issue. Was worth every penny after I wasted 3 days trying to call myself. Got my benefits released the same day I finally talked to someone.

NY has specific covid sick leave laws. You might actually qualify for paid sick leave rather than unemployment. Check this: https://paidfamilyleave.ny.gov/COVID19

I looked into that but it seems like the COVID sick leave requires you to actually test positive or be under a mandatory order of quarantine from the health department. My situation is just exposure and company policy. Would that still count?

0 coins

Lena Schultz

•

If the health department contacted you officially, that might count as a mandatory quarantine order. Did they send you any documentation? If not, unemployment is probably your best bet.

The paid leave program changed a bunch of times. Last I heard, exposure quarantines weren't covered anymore unless you actually get sick. Unemployment is easier at this point.

Nope, you dont qualify. Unemployment is for when you lose your job, not for a few days off. They'll probably deny you cause you're still employed. Your company should be paying you for the quarantine time - they're just trying to push the cost onto the state. Call your state labor department and report them.

This is wrong info. You absolutely can collect unemployment for temporary loss of work, even if you're still technically employed. I did it during a 3-week factory shutdown last year.

Really? I always thought it was only for when you're completely laid off. My bad.

Yeah unemployment also covers reduced hours or temporary layoffs. Its called partial unemployment.

Here's exactly what you need to do (I work in HR and deal with this all the time): 1. File your claim ASAP at labor.ny.gov - don't wait because it's not retroactive before your filing date 2. For reason of separation, choose "lack of work" NOT covid related (the covid special programs expired) 3. You'll need to list your employer info accurately - they will be notified about your claim 4. Document everything - save the call/text from your manager about exposure and quarantine 5. Be prepared for possible delays. The system is still backlogged and quarantine claims sometimes get flagged for review 6. Complete your weekly certifications on time while waiting for approval Don't forget you'll need to report any income during the week (like sick pay if you get any). Finally, if you get stuck in the system and need to talk to a real person, I've seen many of my employees have success using claimyr.com to actually get through on the phone. Talking to a live agent can resolve issues much faster.

wait hold up - does this actually work or is it just the usual BS?

Which part? The unemployment claim process I outlined is standard procedure. The Claimyr thing is a service that connects you to unemployment phone lines - several of my employees used it when they couldn't get through themselves.

I can vouch for the process above - this is exactly how I got approved for a 2 week quarantine period back in January. Got paid for both weeks.

Thank you for this detailed breakdown! I'm going to file tonight.

I just tried to do this last month and got denied. They said since I wasnt sick and just quarantining as a precaution, I didn't qualify. Such BS, they're basically forcing people to work while potentially infected. 🤬

Have u considered NY paid sick leave? might be easier than unemployment

Most places have strict requirements for covid sick leave now. Unless OP tested positive or has a doctor's order, they probably won't qualify.

Pro tip: when you file, don't mention COVID at all in the initial application. Just say lack of work and temporary layoff. I've seen so many COVID-related claims get stuck in review hell for weeks. Once you're in the system, you can explain the details if they ask for more info.

THIS!!! I made the mistake of mentioning COVID and was stuck in pending for 6 weeks. My friend applied same day, said temporary layoff, and got paid in 10 days. The system is broken.

Really good advice, thank you! This is exactly what I needed to know.

Anyone know how long approvals are taking right now? I'm in a similar situation and need to know if I should be borrowing money while I wait or if it'll come through quickly.

I filed 3 weeks ago and still pending. System is slow af right now.

My claim took 4 days in February, but my coworker's took 3 weeks in March. Seems totally random tbh.

If you need it approved fast, use claimyr.com to talk to an agent. They can often push it through while you're on the phone. That's what I had to do.

0 coins

ur employer is supposed to pay u for required quarantine time. they're trying to scam u and offload their responsibility onto the state. call dept of labor and report them.

Ayla Kumar

•

That was true during the height of the pandemic but a lot of those protections expired. Now it depends on the specific workplace policy and if OP qualifies for state sick leave.

UPDATE: I was in exact same boat 2 months ago! Applied for unemployment, got denied initially, had to appeal. FINALLY got approved after 6 weeks and got backpay. If they deny you first time, APPEAL immediately!!!

Darren Brooks

•

6 weeks?? Omg I can't wait that long... Did you keep certifying every week while waiting?

0 coins

Yes, you MUST keep certifying every week even while waiting for approval. That's how they know which weeks to pay you for once approved.

0 coins

I had the same thing happen. The appeal process is actually pretty quick once you get through. I called using claimyr.com and spoke to someone who helped speed up my appeal. Got approved 3 days later.

This happened to me at my restaurant job. I ended up having to use all my savings while waiting for unemployment to come through. Make sure you have some money set aside because even if approved, it might take weeks to see any payment. Good luck!

The unemployment system is such trash. I was quarantined for 2 weeks in November and my claim is STILL pending. Meanwhile my rent was late and I had to borrow money from my parents. The whole system is designed to make you give up.

•

So true. They make everything complicated on purpose hoping people will just give up trying.

0 coins

Have you tried calling? I was stuck in pending for a month, then finally got through on the phone and they fixed it while I was on the call. Use claimyr.com if you can't get through - that's what finally worked for me.

Sorry youre dealing with this! I work in HR (not in NY tho) and just want to warn you that your employer will be notified about your unemployment claim. Since they told you to apply, it shouldnt be an issue, but just so you know they will see it.

Thanks for the warning. My manager was the one who suggested it, so hopefully that means they won't fight it.

For everyone saying OP doesn't qualify - WRONG! I work part time at a school and whenever we have breaks or closures, I can claim unemployment for those weeks. Same applies for quarantine periods where you're scheduled to work but can't. Just make sure to select "still employed but no work available" on your claim.

0 coins

lol good luck getting through on the phone if you have any issues. I spent THREE MONTHS trying to resolve a simple question about my claim and never got a human on the line 🙃

Use claimyr.com - I was in the same boat until someone on here recommended it. Got through in under an hour after weeks of trying myself.

0 coins

Never heard of it but I'll check it out. At this point I'd try anything.

I'm a claims adjudicator (not in NY). Generally any time you're not working through no fault of your own, you may qualify for UI. Quarantine due to workplace exposure typically qualifies. Make sure to answer all questions honestly and if in doubt, include more info in the comments section of your claim.

I swear the ny unemployment website was designed by sadistic trolls who want us all to suffer. Good luck figuring out which options to select for your situation - it's like a choose your own adventure that always ends with DENIED.

LMAO so true. I feel like I need a PhD to understand half the questions they ask.

The website is trash but talking to an actual human on the phone helps so much. They can override stuff in the system the website can't do. I ended up using claimyr.com since I couldn't get through on my own.
