Can I file new NY unemployment claim while working part-time for Uber Eats?

I worked as an inventory specialist for a transit contractor for almost 8 years until they shut down operations in December 2023. I was approved for regular unemployment benefits and collected until the end of my benefit year. I recently started doing Uber Eats deliveries this month to make some income, but it's not enough to cover my expenses. My question is: Can I file a new unemployment claim in 2025 based on my previous full-time job while still doing Uber Eats part-time? Or would I have to completely stop the delivery work to qualify for benefits? I'm really confused about how part-time gig work affects a new claim. Does anyone know if NY unemployment allows partial benefits with gig income?

Yes, you can absolutely file a new claim while working part-time for Uber Eats! NY unemployment does allow partial benefits when you work less than 30 hours per week and earn under your benefit rate. When you certify weekly, you'll report your hours worked and earnings from Uber Eats. The system will automatically calculate any partial benefit you're eligible for. They use a formula where they deduct 25% of your benefit rate for each day you work (even if just an hour), but you can still receive partial payment for the days you don't work. Since your previous full-time job ended in 2023, you should have enough wages in your base period to qualify for a new claim. The key is being honest about your Uber Eats work during weekly certification.

Thank you so much! This is really helpful. Do you know how I report my Uber Eats earnings since they vary a lot day-to-day? And do I report when I earned the money or when it gets deposited to my account?

i was in same situation last yr. u definitely CAN work uber eats while collectin benefits but u gotta report ALL ur earnings each week when u certify. they ask u how many days u worked (even partial days count as full days) and how much u made BEFORE expenses. dont try 2 hide anything, not worth it!

Thanks for the info! Quick follow-up - do miles driven or gas count as deductions when reporting to unemployment, or do I just report the total earnings shown in the Uber app?

You need to report your GROSS earnings to unemployment, not your net earnings after expenses. For Uber Eats, this means the total amount you earned including tips before any deductions for gas, wear and tear, etc. For your question about when to report, you report earnings for the week you WORKED, not when you got paid. So if you did deliveries Tuesday and Thursday, you report those earnings for that certification week even if Uber doesn't deposit the money until the following week. Also important - each day you work even ONE HOUR counts as a full day of work according to NY unemployment. So if you did deliveries for 2 hours on Monday, 3 hours Wednesday, and 1 hour Friday, that counts as 3 days worked and will reduce your benefits accordingly.

This is why the whole system is BROKEN! If you work just 4 days a week at Uber for even just 1 hour each day, you get ZERO unemployment even though you might only make $50 total! They should calculate based on actual hours or earnings not this ridiculous "day" system. SMH.

I'm in a similar situation and struggling to get answers from NYSDOL. I've been trying to call about partial benefits with DoorDash income for TWO WEEKS and can't get through to anyone!!! The phone system just disconnects me after 20+ minutes on hold. Has anyone found a way to actually speak to a human being there? This is so frustrating!

I was in the same boat last month! After days of trying, I finally got through using Claimyr.com - it's a service that basically waits on hold for you then connects you when an agent answers. Saved me hours of frustration. Their video explains how it works: https://youtu.be/Rdqa1gKtxuE Once I got through, the agent confirmed I could keep doing gig work while claiming partial benefits. Just make sure you're reporting accurately each week to avoid any overpayment issues down the road.

To answer your original question more directly - yes, you can file a new claim in 2025 based on your previous transit contractor job. Since you worked there for 8 years and only lost that job in December 2023, those wages will still be in your base period for a 2025 claim. One important thing to understand is that NY uses your highest paid quarter during your base period to determine your weekly benefit amount. So your benefit rate will be based on your full-time job earnings, not your Uber Eats earnings. Then each week, you'll certify and report your Uber Eats work, and receive partial benefits according to the formula others have mentioned.

This makes so much more sense now. I was worried they would calculate my benefits based on my Uber earnings only, which wouldn't be much. Glad to hear they'll use my previous full-time wages instead.

Just want to add my experience - I was on unemployment last year while doing Instacart part time. The key thing that helped me was keeping SUPER detailed records. I created a spreadsheet where I tracked: - Exact hours worked each day - Total earnings each day including tips - Screenshots of my weekly earnings summaries This saved me later when they did a review of my claim and I had to verify my reported earnings. Better safe than sorry!

smart! wish i'd done that. they audited me n i had 2 go back thru all my uber records which was a PAIN

Watch out with Uber income!!! My friend got hit with a HUGE overpayment bill because he didn't report correctly. The NYSDOL wants to know about ALL hours you're logged into the app waiting for orders, not just actual delivery time. And you need to report even PENDING tips that haven't been finalized. The whole system is designed to trip you up and make you pay everything back!!!

This isn't entirely accurate. You only need to report hours when you're actually working (available and accepting orders), not just logged in but not accepting work. And for earnings, you report what you earned for work performed that week, even if it hasn't been paid out yet. The system isn't designed to trip people up, but it does require careful attention to the certification questions. The DOL handbook explains this clearly, and there's a specific section about gig work.

One thing nobody has mentioned yet - when you file your new claim, make sure to check the box indicating you're currently working part-time. This helps set up your claim correctly from the start. Also, when you're answering the availability questions during your application, indicate that you ARE available for full-time work despite your current part-time gig. That's important because you need to be available for full-time work to qualify for benefits. You might need to verify your Uber Eats income with documentation, so have those records ready in case they ask for them during the application process.

Thank you for pointing this out! I wouldn't have known to check that box. And I appreciate the tip about indicating I'm available for full-time work even though I'm doing the Uber Eats gig.

btw u need 2 report ur gross earnings EACH DAY on uber not just the weekly total. this tripped me up at first

This is a really important point. The daily tracking matters because NY unemployment reduces benefits based on days worked, not just total earnings. Keep a daily log of your Uber activity to make certification easier.

Does anyone know if there's a certain amount I can earn per week before unemployment benefits get reduced? Like is there a threshold where they don't count small earnings?

New York doesn't have an earnings threshold where they don't count income. Every dollar earned needs to be reported. What they do instead is reduce your weekly benefit amount by 25% for each day you work (even partial days). So if you're eligible for a $400 weekly benefit: - Work 1 day = $300 benefit (25% reduction) - Work 2 days = $200 benefit (50% reduction) - Work 3 days = $100 benefit (75% reduction) - Work 4+ days = $0 benefit (100% reduction) This is regardless of how much you actually earned on those days. That's why many people try to concentrate their gig work into fewer days to maximize benefits.

Thank you everyone for all this helpful information! Based on your advice, I'm going to: 1. File a new claim and indicate I'm working part-time 2. Set up a daily tracking system for my Uber Eats hours and earnings 3. Make sure I report gross earnings on the days I actually worked 4. Try to concentrate my Uber work on fewer days to maximize benefits I feel so much better knowing I can still get some unemployment help while doing delivery work to make ends meet. This forum has been incredibly helpful!

You're welcome! Sounds like you have a good plan. One last tip: if you do have any issues with your claim or questions while certifying, document when you call NYSDOL (date, time, who you spoke with). This documentation can be really helpful if there are any disputes later. Best of luck with your claim!

Great advice from everyone here! I just wanted to add that when you file your new claim, you might also want to consider the timing strategically. Since you're doing Uber Eats part-time, try to plan your delivery schedule around your weekly certification days if possible. For example, if you certify on Sundays, you could potentially do most of your Uber work on Friday-Sunday and then focus on job searching Monday-Thursday. This way you're maximizing your unemployment benefits while still earning some income. Also, don't forget that you're still required to do job search activities even while working part-time gig work. Keep track of your applications and interviews because they may ask for that information during certification too. Good luck with your claim! The fact that you're asking these questions upfront shows you're being responsible about following the rules correctly.

This is really smart strategic thinking! I hadn't considered timing my Uber work around certification days. That Friday-Sunday schedule idea could really help maximize benefits while still bringing in some income. And thanks for the reminder about job search requirements - I definitely don't want to forget that part. This whole thread has been so educational for someone new to navigating unemployment with gig work!

Just want to echo what everyone's saying about being completely honest with your reporting! I did DoorDash while on unemployment for about 6 months last year and it worked out fine as long as I was accurate with everything. One thing I learned the hard way - when you're doing deliveries, NY considers you "self-employed" for that work, so make sure you answer the self-employment question correctly during weekly certification. They ask if you worked for yourself or did any freelance/contract work, and Uber Eats definitely counts. Also, save all your weekly earnings statements from Uber because if they ever audit your claim (which they do randomly), you'll need to provide documentation. The Uber app lets you download these pretty easily. The combination of partial unemployment + gig work really helped me stay afloat while job hunting. Just be patient with the system and keep detailed records of everything!

This is such valuable insight about the self-employment question! I definitely wouldn't have thought to categorize Uber Eats as self-employment, but that makes total sense since we're independent contractors. Thanks for the heads up about downloading those weekly statements too - I'll make sure to save everything from day one. It's reassuring to hear from someone who successfully navigated this for 6 months. Did you find that the partial benefits plus gig income was enough to cover your basic expenses while job hunting?

@Zainab Ahmed This is incredibly helpful! I had no idea about the self-employment question - that definitely would have tripped me up. I m'going to start downloading those weekly statements right away. One quick question: when you were doing DoorDash, did you find it better to work longer hours on fewer days, or shorter hours spread across more days? I m'trying to figure out the best strategy to maximize my unemployment benefits while still making some decent delivery income.

@Zainab Ahmed This is exactly the kind of real-world experience I needed to hear! The self-employment question detail is gold - I would have definitely answered that wrong and potentially caused issues with my claim. I m'curious about your audit experience too. When they randomly audited your claim, how long did that process take and was it stressful? I want to be prepared mentally for what that might involve if it happens to me. Also, did you find any particular day patterns worked better for maximizing both your delivery earnings and unemployment benefits? I m'trying to balance making decent money from Uber Eats while not working too many days that would kill my partial benefits. Really appreciate you sharing your 6-month journey - it gives me hope that this can actually work!

@Zainab Ahmed This is so reassuring to hear from someone who successfully did this for 6 months! I m'definitely going to be extra careful about that self-employment question - thanks for that crucial detail. Quick question about the audit process - roughly how long after you started claiming did they audit you, and was it just a matter of providing those weekly statements or did they ask for other documentation too? I want to make sure I m'keeping everything they might need. Also, did you find that doing gig work actually helped or hurt your job search? I m'worried potential employers might think I m'not serious about finding full-time work if they see I m'doing deliveries, but I really need the income to survive while looking.
