VA refund offset for deceased spouse's child support - Will federal refund also be taken?
Filed taxes as married filing joint and just found out my VA refund is being offset for deceased spouse's back child support. Husband passed in October. Injured spouse form wasn't filed like it shouldve been. Already called child support to report his death and close the case. Need to know if my federal refund is also getting offset?

Your federal refund is at risk of being offset too if the injured spouse form (Form 8379) wasn't included. You should immediately file Form 8379 separately - you can do this even after filing your return. Also file Form 1310 (Statement of Person Claiming Refund Due a Deceased Taxpayer) if you haven't already. The child support agency should update their records and release any holds once they process the death certificate.

•Generally 8-14 weeks for injured spouse claims, but could be faster since its involving a deceased taxpayer. Make sure to mark 'DECEASED' on all paperwork.

Make sure to get multiple copies of the death certificate. Youll need to send it to everyone - IRS, VA tax office, child support office, etc. Keep records of everything you send and who you talk to!
