Injured Spouse Form 8379 with EITC - Any DDD Yet? Filed 01/25, Accepted 02/10
Has anyone who filed Form 8379 (Injured Spouse Allocation) with Earned Income Credit received a deposit date yet? My return was e-filed on 01-25-2024 and received IRS acceptance notification on 02-10-2024. Currently at processing day 43 according to my calculations. I've been monitoring transcript updates daily and comparing processing timeframes with previous tax years. Per Internal Revenue Manual 21.4.6.5.11.1, injured spouse claims should be processed within 11 weeks of filing date, but EITC inclusion often extends this timeline. Does anyone have empirical data on current processing times for this specific combination? Anyone experiencing similar timeline who has received their DDD?

Injured Spouse claims with EITC are currently experiencing extended processing times. According to IRM 21.4.6.5.11.1 and IRM 25.18.5.7, the standard 11-week timeframe is frequently extended when refundable credits are present. Per Notice 2023-36, the IRS implemented additional verification protocols for all EITC claims this season, adding approximately 4-6 weeks to standard processing times. Your acceptance date of February 10th puts you in the category that should see movement by mid-April to early May, assuming no additional verification is required.

This matches what I've observed in my accounting practice. Last tax season, I had six clients with Injured Spouse + EITC combinations. Their processing times ranged from 14-17 weeks from acceptance date. Two clients who filed in early February 2023 didn't receive their refunds until late May. The system seems to route these returns through additional verification queues, especially when the non-liable spouse is claiming a significant portion of the EITC.

Oh my goodness, the waiting is the WORST part! 😫 I went through this exact situation last year and it took FOREVER! I finally broke down and used Claimyr (https://youtu.be/_kiP6q8DX5c) to get through to an actual IRS agent. I was so emotional by that point! The agent confirmed my return was in the Injured Spouse processing queue and gave me an estimated completion date. It was such a relief to know what was happening! Sometimes just having that confirmation makes the waiting easier. Sending you patience and good vibes! 💕

Based on my analysis of the current filing season, it appears that returns with Form 8379 and EITC are generally following a 14-16 week processing timeline, which is somewhat longer than the standard processing time. Your return, having been accepted on February 10th, would likely see movement approximately between May 18th and June 1st, assuming there are no additional verification requirements or discrepancies that might trigger manual review.

How does anyone plan financially with these kinds of timelines? I remember when refunds came within 21 days like clockwork. Now we're talking months? I appreciate your detailed breakdown though - at least now I know what to expect for my similar situation.

Not to hijack the thread, but does anyone know if the processing queue is different if you e-filed the 8379 with your original return versus mailing it separately? I've heard rumors that paper submissions take even longer, but is there actual data on this? 😅

I was in your exact situation on March 15, 2023. Filed injured spouse with EITC on January 30th last year and waited 16 weeks for processing. What helped me tremendously was using taxr.ai to analyze my transcript once it finally updated on April 22nd. The tool explained all those confusing transaction codes and gave me a realistic timeline. My 846 code (refund issued) appeared on May 2nd, exactly when taxr.ai predicted. For 2024 returns with your filing date, I'd expect transcript updates to begin appearing between April 18-25 based on current IRS processing patterns.

Did you receive any 971 codes on your transcript? Have you checked for a 570 freeze code? What cycle code appears on your most recent transcript? Any CP05 notices in the mail?

Have you considered filing separately next year? I was in a similar situation after my divorce and switched to filing separately even though it cost me a bit more in taxes. The headache of waiting 4 months for my refund just wasn't worth it! My ex had back child support that kept triggering offsets, and I got tired of filing the injured spouse form every year. This year I filed separately on January 15th and had my refund by February 2nd - way less stress even though my refund was about $800 less than it would have been filing jointly. Just something to consider for next year?

Be extremely cautious about checking your transcript too frequently. The IRS Identity Protection System sometimes flags accounts with excessive access attempts as potential identity theft risks. This can trigger an IP PIN requirement or account lock, further delaying your refund processing. I experienced this during the 2022 tax season when my Injured Spouse claim was delayed an additional 8 weeks due to identity verification requirements. The IRS representative specifically mentioned that daily transcript access triggered the security protocols. Consider limiting checks to once weekly, preferably on Thursdays when most transcript updates are processed.

Your return is currently in what's known as the Injured Spouse Processing Queue (ISPQ). Based on current processing metrics, returns accepted on February 10th, 2024 with Form 8379 and EITC are showing average processing times of exactly 112 days. The EITC verification adds precisely 23 days to standard injured spouse processing. The earliest DDD I've observed for a similar situation this season was for a return accepted on January 29th that received a DDD of May 8th - approximately 100 days from acceptance. Your estimated DDD would be June 1st, 2024 if following the same pattern.
