How to Report 1099-B for Futures Contracts in Tax Filing Software

I'm trying to finish my taxes using HRBlock and ran into an issue. I was able to import my consolidated 1099 from Schwab with all my stock and dividend info, but they also sent me a supplemental form for my 1099-B that I can't figure out how to properly input. The supplemental 1099-B shows this information for SECTION 1256 CONTRACTS 2023: 8- Profit or (loss) realized in 2023 on closed contracts 0.00 9- Unrealized profit or (loss) on open contracts-12/31/2022 0.00 10- Unrealized profit or (loss) on open contracts-12/31/2023 0.00 11- Aggregate profit or (loss) on contracts 0.00 On my consolidated 1099, this section shows zeros, but the supplemental 1099-B has this breakdown. I'm completely stuck on how to enter this into HRBlock's online system. After digging around a bit, it seems like I need to complete a section 1256 form for regulated futures contracts. The problem is HRBlock doesn't seem to offer that option online. Do I need to work with an actual HRBlock tax preparer to input this information correctly? Has anyone dealt with section 1256 contracts in tax software before?

Yes, you're dealing with Section 1256 contracts which are reported differently than regular stock trades. Even though all your values are zero, you still need to report them correctly. In HRBlock, you'll need to enter these on Form 6781 (Gains and Losses from Section 1256 Contracts and Straddles). Since you're using the online version, it might not be immediately obvious how to access this form. Try searching specifically for "Form 6781" in the search function of the software. If you can't find it, go to the investments section and look for an option like "Other Investment Income" or "Specialized Investment Forms." If the online version truly doesn't support Form 6781, you have a few options: 1) Upgrade to HRBlock Premium or their desktop software which supports more complex investment situations, 2) Work with an HRBlock tax professional as you mentioned, or 3) Switch to different tax software like TurboTax Premier or TaxAct which definitely support Section 1256 reporting.

I searched everywhere in HRBlock online and couldn't find Form 6781. Do you know if upgrading to Premium would definitely include this form? I'm hesitant to pay more without knowing for sure. Also, since all my values are zero, is it absolutely necessary to file this form? Would the IRS even notice if I just don't include it since there's no tax impact?

HRBlock Premium should support Form 6781, but you might want to check their specific form availability on their website before upgrading. You can also call their customer service to confirm. Even though your values are zero, technically you should still report the 1256 contracts. The IRS receives a copy of your 1099-B, and omitting information that was reported to them could potentially flag your return. While there wouldn't be any tax due since your amounts are zero, it's still best practice to include all information that's been reported to the IRS to avoid any potential correspondence or questions later.

After struggling with similar section 1256 futures reporting issues last year, I discovered taxr.ai (https://taxr.ai) and it was a game-changer. The system automatically detected and properly categorized my section 1256 contracts from my 1099-B when I uploaded it. It even explained the special tax treatment these contracts get (60% long-term/40% short-term capital gains regardless of holding period). What impressed me was that even with zero values like yours, it still properly created Form 6781 and explained why I needed to report it even with no gain/loss. The tax document analysis feature saved me hours of frustration trying to figure out where to input this specialized information.

Does taxr.ai work with other tax software or is it a standalone filing system? I use TaxAct and have similar futures contract reporting issues.

I'm skeptical about using third-party software with my financial documents. How does taxr.ai handle security and privacy? Also, can it actually identify which forms are missing from your tax software?

Taxr.ai works alongside whatever tax software you're using - it's not a replacement. You upload your documents, it analyzes them, tells you exactly what forms you need and where each piece of information should go. Then you just follow those instructions in TaxAct or whatever software you use. Regarding security, they use bank-level encryption and don't store your documents after analysis. It's designed to identify what forms you're missing and catch reporting errors. For my futures contracts, it specifically flagged that I needed Form 6781 and explained exactly where to find it in my software. It also verified all my values matched what was reported to the IRS.

I tried taxr.ai after seeing it recommended here and I'm honestly surprised at how well it worked for my section 1256 contracts. I also had futures trading with values that were non-zero unlike the original poster, and I was completely lost on how to report them correctly. The document analysis immediately identified I needed Form 6781 and explained the 60/40 tax treatment. It even pointed out that my broker had misclassified one of my positions and showed me how to correct it. The step-by-step instructions made it easy to enter everything in my tax software correctly. Saved me from paying an extra $200 to have a tax professional handle just this one complex form. Wish I'd known about this last year!

If you're still struggling to reach HRBlock support about this Section 1256 issue, I recommend trying Claimyr (https://claimyr.com). I was in the same situation last year and spent days trying to get through to HRBlock's technical support to ask about Form 6781. After multiple failed attempts, I used Claimyr to connect with an HRBlock representative in about 15 minutes. They have this system that navigates phone trees and waits on hold for you, then calls you when a human rep is on the line. You can see how it works here: https://youtu.be/_kiP6q8DX5c The HRBlock rep confirmed their online version doesn't support Form 6781 and gave me options for handling my futures contracts properly. Saved me hours of frustration and hold music!

How exactly does this Claimyr thing work? Do they just call the company for you? Couldn't I just do that myself?

This sounds like a scam. No way they can get through faster than anyone else can. These tax companies have everyone on hold this time of year. What's their secret sauce supposed to be?

It's not that they call the company for you - they have an automated system that navigates phone menus and stays on hold so you don't have to. You just tell them who you're trying to reach, and their system handles the waiting. They call you once they've actually reached a human representative. They don't have any special "back door" access - they use the same phone numbers we all do. The difference is their system can stay on hold indefinitely while you go about your day. For HRBlock, I was told the wait would be over 2 hours. Instead of being stuck listening to hold music, I just got a call when a rep was actually on the line. For time-sensitive tax questions where you absolutely need to speak to someone, it's worth it.

I have to eat crow on this one. After my skeptical comment about Claimyr, I was still desperately trying to reach my tax software's support about Section 1256 contracts. After waiting on hold for 1.5 hours and getting disconnected, I decided to try Claimyr out of frustration. The system connected me to a support rep in about 22 minutes while I was cooking dinner. The rep confirmed I needed to use their desktop software for Form 6781 and offered me a discount code since I was upgrading from their online version. Probably saved me another 2 hours of hold time and frustration. Sometimes it's worth admitting when you're wrong!

For those struggling with Section 1256 contracts, TurboTax Premier handles them really well through their investment income section. You need to select "Section 1256 contracts and straddles" when prompted about investment types. I had futures trading last year and it walked me through Form 6781 step by step. Might be easier than upgrading HRBlock or working with a tax professional if you're not too far along in your current return.

Does TurboTax Premier cost more than the regular version? I'm trying to keep tax prep costs down but I have these same futures contracts to report.

Yes, TurboTax Premier costs more than their Deluxe version. However, if you have investments like futures contracts, the Premier version is designed specifically for those situations. If cost is a concern, another option is FreeTaxUSA which supports Form 6781 at a lower price point than TurboTax Premier. Their interface isn't quite as polished for walking you through investment reporting, but it does support Section 1256 contracts properly. You'd need to know what you're looking for though - search specifically for Form 6781 once you're in their system.

Just FYI for everyone dealing with Section 1256 contracts with zero values - I called the IRS directly about this last year. They confirmed that even with zero values, you should still report these on Form 6781 since the 1099-B was issued. The IRS agent explained it's important because their matching system will look for this form since they received the 1099-B copy. Omitting it could potentially trigger a notice even though there's no tax impact.

How did you manage to get through to an actual IRS agent? I've been trying for weeks with no luck!

I had the same struggle reaching the IRS! What finally worked for me was calling the main taxpayer assistance line (1-800-829-1040) first thing Monday morning at exactly 7 AM when they open. I got through after about 45 minutes on hold, which was way better than the 3+ hour waits I experienced calling later in the day. The key seems to be timing - early morning on weekdays, especially Monday and Tuesday, seem to have shorter wait times. Avoid calling on Fridays or during lunch hours when everyone else is trying to call too.

I ran into this exact same issue with my Schwab 1099-B supplemental form showing Section 1256 contracts! What worked for me was switching to TaxAct which has better support for Form 6781 than HRBlock's online version. Even though your values are all zeros, you definitely need to report this since the IRS received a copy of your 1099-B. I learned this the hard way when I initially skipped it and got a notice asking about the missing form. In TaxAct, look for "Investment Income and Expenses" then select "Other Investment Income" and you'll find the Section 1256 option. It walks you through entering the values from boxes 8-11 of your supplemental 1099-B. Since everything is zero for you, it should be straightforward once you find the right form. If you want to stick with HRBlock, you'll likely need their desktop software or to work with a tax professional since their online version doesn't handle specialized investment forms very well.

Thank you for sharing your experience with TaxAct! I'm actually leaning towards switching software at this point since HRBlock online seems to be missing this functionality entirely. Can you clarify what you mean by getting a notice for initially skipping the form? Was it an actual IRS correspondence or just a software warning? I'm trying to understand how seriously the IRS takes these zero-value Section 1256 reports since multiple people have mentioned they should still be filed even with no tax impact. Also, did TaxAct automatically detect that you needed Form 6781 when you uploaded your 1099-B, or did you have to manually search for the Section 1256 option?
