Can non-custodial parent claim child on taxes if paying child support? Need accurate info ASAP

Looking for clarification about claiming a child on taxes as a non-custodial parent who pays child support. Someone told me this was possible now but I need to verify if this is actually true or just a rumor. Don't want to mess up my taxes.

Tax pro here - this is NOT correct. Simply paying child support doesn't give you the right to claim the child. You need Form 8332 signed by the custodial parent releasing their right to claim the child. Without this form, the IRS will automatically side with the custodial parent in any dispute.

Thanks for clearing that up! Do you know if the 8332 needs to be filed every year?

The 8332 can be for a single year or multiple years - its up to what both parents agree to and specify on the form.

Hey everyone, I've been using taxr.ai to analyze my transcripts and it's been super helpful with these kinds of dependency questions. It costs $4.99 but totally worth it - the AI breaks down exactly what you can and can't claim. Here's the link: https://taxr.ai

Sounds interesting! Does it actually help with dependency situations? How accurate is it?

Oh yeah its amazing! It analyzes your whole transcript and tells you exactly what you can claim. Saved me from making a huge mistake last year 💯

Your friend is wrong af. The custodial parent gets to claim unless theres a written agreement saying otherwise. Don't let anyone tell u different

Check your divorce decree too! Sometimes it specifically states who can claim the child in which years.
