Struggling to find EDD Form WG-007 for wage garnishment - Help needed!

Hi everyone, I'm in a bit of a panic. I just received a notice from EDD saying I need to fill out form WG-007 regarding possible wage garnishment for an overpayment they say I owe from last year ($4,250). The problem is I can't find this form anywhere on the EDD website! I've searched through all the forms sections, checked under 'Overpayments', even called the main number but couldn't get through. Has anyone dealt with this form before? Where can I find it? Is it an EDD form or something else? I need to respond within 10 days according to the letter and I'm already on day 3. Getting really stressed about this!

Form WG-007 isn't actually an EDD form. It's a California Judicial Council form called 'Claim of Exemption for Wages (Wage Garnishment)'. You can find it on the California Courts website. WG-007 is definitely a court form not an EDD form!! I went through this whole mess back in January. You need to submit it to the COURT not to EDD. The address should be on your garnishment paperwork somewhere. Don't make my mistake - I sent mine to EDD first and lost precious time. Also take COPIES of all your bills and expenses when you fill it out so you can prove hardship!!

Oh that's really helpful info about the copies of bills! The paperwork is so confusing - I see a court case number at the top but wasn't sure what that meant. I'll look more carefully for the court address.

I HATE how EDD does this!!! They send these scary letters about garnishment but don't even include the form you need or clear instructions! They did this to my brother too and he almost got his wages garnished because he couldn't figure out the process in time. The system is DESIGNED to confuse people so they miss deadlines. It is frustrating, but to be fair, EDD doesn't create or distribute court forms. The garnishment process goes through the court system once EDD refers the case for collection. That's why the form is on the judicial website and not EDD's. But I agree they could make this clearer in their communications!

Just be careful when filling out that form. I did mine wrong the first time and my exemption was denied. Make sure you fill out EVERY section completely and provide documentation for all your expenses and hardships. If the form asks for something and you leave it blank, they might just deny it automatically. Also, you only have ONE shot at this usually, so do it right!

That's scary! I'm not great with legal forms. Would you recommend getting help from a legal aid office? I don't have money for a lawyer but now I'm worried about filling it out wrong.

Yes definitely consider legal aid! Many counties have free help for low-income people dealing with garnishment. Google "legal aid" plus your county name. They helped me fix my form after my first attempt failed.

btw you should try to call edd before filling this out. maybe you can do a payment plan instead of going thru all this garnishment stuff. but goodluck getting thru lol

My cousin worked for edd and she said most ppl don't know you can actually get these overpayments waived sometimes if you can prove financial hardship. did you try applying for a waiver? might be worth looking into before the garnishment

This is important advice! Under California Unemployment Insurance Code section 1382, EDD can waive overpayments if they weren't your fault AND repayment would cause extraordinary hardship. You need to request the waiver specifically - there's a form for it on the EDD website called "Overpayment Waiver Request" (DE 1446W). The catch is you need to get this in before the garnishment process begins.
