How to set up payment plan for EDD overpayment notice - need advice ASAP
Just received an overpayment notice from EDD for $4,750 and there's no way I can pay this all at once! I was on UI for about 3 months last year after my restaurant closed, and apparently they're saying I reported my hours wrong for some part-time gig work I picked up. The letter mentions I can set up a payment arrangement, but doesn't really explain HOW to do that. Has anyone gone through this process before? Do I call them? Is there a form online somewhere? What documentation will I need? My anxiety is through the roof right now because I'm barely making ends meet with my new job.

I just went through this last month. You need to call EDD and specifically ask for the Collections Division. They're the ones who handle payment arrangements. Be prepared with your financial information because they'll ask about your income, expenses, and ability to pay when determining your monthly payment amount. The number should be on your overpayment notice (usually different from the main EDD line).

•Thanks! Do you remember what kind of financial info they asked for exactly? Like did you need to have tax returns handy or just general monthly budget stuff?

•5 calls?? That's actually better than I expected lol. I've been trying all morning and keep getting the "we're experiencing high call volume" message and then it hangs up.

You have several options for handling an EDD overpayment: 1. Call the number on your notice and request a payment plan. They'll ask about your financial situation to determine what you can reasonably pay monthly. 2. You can also appeal the overpayment if you believe it's incorrect - you have 30 days from the notice date to file. 3. In some cases, you can request a waiver if repayment would cause extraordinary hardship and you didn't intentionally provide false information. Before calling, gather your monthly income information, expense details (rent, utilities, food, etc.), and have your notice handy. They'll work with you to establish a reasonable monthly payment.

•Thank you! This is super helpful. I don't think I can appeal since I probably did make a mistake with reporting hours, but I'll definitely ask about payment plans. Any idea how long they typically give you to pay it all back?

i had an overpayment from 2022 and they let me do $75/month payments. just depends on what u can afford really. they dont want to take all ur money they just want it back eventually lol

•$75 is WAY better than what they wanted from me!! They tried to make me pay $200/month at first and I had to argue with them that I literally couldn't afford that with my rent being so high

I struggled for WEEKS trying to reach someone at EDD about my overpayment. The regular line was useless - always busy signals or disconnections after waiting for an hour! I finally found a service called Claimyr that got me through to an EDD rep in about 20 minutes. Cost a little bit but saved me days of frustration. They have a demo video at https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km that explains how it works. Once I got through, setting up the payment plan was pretty simple - they asked about my income and expenses and set up a monthly amount I could manage.

Everyone is giving you advice about payment plans, which is good, but don't forget you can also REQUEST A WAIVER if the overpayment was not your fault! If EDD made the mistake or if you had no way of knowing you were being overpaid, you might qualify for a waiver so you don't have to pay anything back. They don't advertise this option much because they want their money back. You might need to specifically ask about it.

•This is partly true, but waivers are really hard to get approved. You have to prove both that it wasn't your fault AND that repayment would cause extraordinary hardship. The standard is pretty high. Definitely worth trying if you qualify, but don't count on it as a sure thing.

my friend had an overpayment and just ignored it. DO NOT DO THIS!!!! they ended up garnishing his wages and taking his tax refund. was way worse than if he'd just set up a plan. they don't mess around with collections.

•Yikes, that's scary! I definitely want to handle this properly. The last thing I need is wage garnishment when I'm already struggling.

To answer your earlier question, they mostly wanted to know my current monthly income, major expenses (rent/mortgage, utilities, car payment, insurance, etc.), and other debt payments. I didn't need tax returns, but having a rough monthly budget was helpful. They use this to determine what you can reasonably pay each month. Most plans range from 12-24 months, but can be longer for larger amounts. They're generally willing to work with you as long as you're making a good faith effort to repay. The most important thing is to address it promptly rather than ignoring it.

•That's super helpful, thank you! I'll put together my budget info tonight so I'm prepared when I finally get through to someone. I tried the Claimyr service another commenter mentioned and have an appointment to speak with EDD tomorrow morning.

•Haha good advice! I'll definitely be super polite. I know it's not their fault anyway, they're just doing their job.
