If I get fired can I get unemployment through California EDD?
So I got let go from my job last week and I'm honestly still in shock about it. My manager called me into the office on Tuesday and said they were letting me go, gave me some vague reason about 'performance issues' but never actually wrote me up or gave me any formal warnings before this. I've worked there for almost 4 years and never had a disciplinary meeting or anything like that. Now I'm trying to figure out if I can even collect unemployment benefits or if being fired automatically disqualifies me. I went to the California EDD website and started reading but honestly the language is so confusing, it keeps talking about 'misconduct' and I don't know if what my employer claims counts as misconduct. Do I still apply and let them sort it out? Or is there even a point if I got fired? Has anyone gone through this and actually gotten approved after being fired?

Yes you can definitely still apply! Being fired doesn't automatically disqualify you from California EDD unemployment. The key thing is WHY you were fired. If it was for what they call 'misconduct' - like intentionally violating company policies, dishonesty, stuff like that - then you could be disqualified. But if it was more of a performance issue or just not being a good fit, that's usually not considered misconduct under California unemployment law. You should file your claim right away because there's a waiting period and you don't want to delay it any further.

AuthorThat's actually really helpful, I wasn't sure if I should even bother filing. My situation sounds like it might fall into that gray area since they said performance but couldn't point to anything specific.

agree with this 100%, i got fired for 'not meeting expectations' and got approved no problem. the burden is actually on the employer to prove misconduct not on you

This is correct. Under California UI Code, termination for poor performance is generally not considered misconduct. The employer would need to demonstrate willful or wanton disregard for the employer's interests to get a disqualification upheld.

File IMMEDIATELY. Like today. Every day you wait is potentially money you won't get back. California EDD unemployment has a one week unpaid waiting period after you file and they calculate your benefit year from when you file, not from when you lost your job. I waited two weeks thinking I'd find something quick and that was dumb.

same mistake I made. filed 3 weeks late and lost out on a bunch of payments that i couldnt go back and claim

One thing nobody mentions - when you file your California EDD claim after being fired, EDD is going to contact your former employer and ask for their side of the story. Your employer will have a chance to contest your claim and explain why they fired you. This is where the whole misconduct question gets decided. Based on what you described - 4 years with no write-ups and a vague 'performance' reason - you have a solid case. Make sure when you fill out your claim you explain exactly what happened. Be honest and specific. Don't guess or assume what they'll say.

AuthorThis part worries me a little. My old manager wasn't exactly fair and I could see them exaggerating. Is there anything I can do to prepare?

Document everything you can remember right now while it's fresh. Dates, what was said, who was in the room. If you have any emails or texts relevant to your last few weeks you might want to save those too. If EDD disputes the claim you'll have an opportunity to appeal and present your side.

Also request a copy of your personnel file. In California you have the right to see it and it can show definitively whether there were formal write-ups or disciplinary actions on record.

when i got fired i spent like three days trying to call california edd just to ask basic questions about my claim and kept getting the busy signal or getting hung up on after waiting forever. someone on a different forum mentioned Claimyr which is this service that basically gets you through to an actual EDD agent without you having to sit on hold yourself. I was so desperate at that point I tried it and got through to someone within a couple hours. they were able to tell me exactly where my claim stood and answer all my questions. site is claimyr.com and theres a video showing how it works at https://youtu.be/JmuwXR7HA10 - honestly wish I found it sooner

AuthorOh wow I didn't know something like this existed. I've been dreading the whole calling EDD part because I've heard horror stories about the phone system.

the edd phone system is genuinely one of the worst things I have ever experienced in my life. if this actually works that's huge

used it too, got through to a real person after getting hung up on twice the old fashioned way. worth it

To give you a fuller picture of how California EDD evaluates fired claimants: They look at whether your actions showed a substantial disregard for your employer's interests or your job duties. Simple mistakes, poor performance, inability to do the job, or personality conflicts - none of those rise to the level of disqualification. What DOES disqualify you is things like theft, deliberate insubordination, intentional policy violations, or dishonesty. Four years of employment with no documented disciplinary history is actually strong evidence in your favor if this goes to adjudication.

This is the info I needed when I got fired lol. I just assumed I couldn't get it and didn't even file. Big mistake.

wait so even if they fired you for like being late all the time does that count as misconduct? asking for a friend

Chronic tardiness can potentially be considered misconduct IF the employer gave clear warnings and the employee continued anyway. Context matters a lot. EDD looks at the totality of circumstances.

I went through exactly this situation about 8 months ago. Got fired after 3 years, employer claimed performance issues. Filed my California EDD claim the same day. It went into adjudication which honestly freaked me out - my portal showed 'pending' for like 2.5 weeks and I thought I was doomed. Then I got a notice that my claim was approved and the back pay came through. Your situation sounds even cleaner than mine was, you have a really good shot.

Ava Williams
AuthorThis is genuinely reassuring. How long did the whole process take from filing to getting your first payment?
0 coins
GamerGirl99
From filing to first payment was about 5 weeks total. The adjudication period was the nerve-wracking part but once it cleared, payments came every two weeks as long as I kept certifying.

5 weeks is pretty typical from what I hear. mine was similar

WAIT. did they ask you to sign anything when they let you go?? like a severance agreement?? if you signed something that says you won't file for unemployment or that you agree the termination was voluntary THAT IS A TRAP. employers try to sneak that language into severance paperwork. california edd doesn't care what you signed but if you agreed the separation was voluntary it makes your claim way harder
0 coins
Ava Williams
AuthorOh no I did sign some paperwork. It was a standard separation agreement I think? I didn't see anything about voluntary resignation but now I'm panicking a little.
0 coins
Raj Gupta
Read it carefully. What you're looking for is language that says you 'voluntarily resigned' or 'agree that termination was not employer-initiated.' That's very different from just a general severance/release of claims. Most standard severance agreements don't affect your UI eligibility.
0 coins
TechNinja
Correct. You cannot legally waive your right to file for California unemployment benefits in a severance agreement - it's unenforceable under California law. However, the voluntary vs involuntary framing does come up in EDD's investigation so it matters how things are characterized.

just here to say don't let them gaslight you. companies fire people all the time for made up reasons and then try to claim misconduct to avoid paying into UI. you deserve the benefits you paid into through your paychecks. fight for it

so true. i worked at a place that did this regularly. would make up misconduct claims and most employees just accepted it and didn't file

question - do you have to do job search stuff while on unemployment even if you just filed and are waiting to be approved? I thought you only had to search once you start getting paid but my friend said you have to start immediately
0 coins
Raj Gupta
You technically need to be able, available, and actively seeking work from the date your claim is effective, not just once approved. California EDD requires at least 3 job search activities per week that you have to log. Missing this could create problems if you're ever audited.

Amina Diallo
oh shoot. okay good to know thanks

yes start your job search log NOW. keep records of every application, every contact, every job you look at. EDD can and does audit this randomly

Also wanted to flag - when you certify your first time you'll be asked to verify your identity through ID.me if you haven't already. This tripped a lot of people up because if you don't complete ID.me verification your payments get held up even if your claim is approved. Do this step as soon as you file, don't wait for a notice.
0 coins
Ava Williams
AuthorI actually already have an ID.me account from something else. Does it just automatically link up?
0 coins
Yara Assad
It should connect during the UI Online registration process. You may still need to go through the verification steps again specifically for EDD purposes but having the account already makes it way faster.

not gonna lie the weekly certification questions are kind of confusing at first. especially the ones about whether you refused any work or were you able and available every day. just answer honestly. the questions sound like traps but they're not that complicated once you do it a couple times

Ava Williams
AuthorWhat if I did some freelance work during the week? Do I have to report that?
0 coins
Lena Müller
YES report all earnings every week. you only get deducted for what you actually earned, you don't get cut off completely. hiding earnings is how people end up with overpayment notices which are a nightmare to deal with
0 coins
TechNinja
This is important. California EDD has data sharing agreements with various agencies. Unreported income will usually get caught during audits and result in overpayment demands plus potential fraud flags. Always report everything.

Update for anyone who hits a wall trying to reach EDD - if your claim goes into adjudication and you need answers, calling is really the only way to get real information because the online portal doesn't tell you much. I mentioned Claimyr earlier but just want to second it again since I know how stressful the waiting is. claimyr.com really does work for getting through to an agent. The video demo at https://youtu.be/JmuwXR7HA10 shows exactly what you're signing up for before you commit to anything.

adjudication is when you really need to talk to someone. the online portal just sits there saying pending forever and doesn't tell you why

Connor O'Brien
the whole adjudication process confused me when I went through it. I kept thinking adjudication meant I did something wrong or was being investigated. can someone explain what it actually means because OP might go through it
0 coins
TechNinja
Adjudication just means EDD needs to look more closely at your claim before approving it. It happens automatically when there's any question about the reason for separation - like being fired vs quitting. It doesn't mean you're accused of anything, it's just their review process. Most adjudicated claims do get approved.

Connor O'Brien
okay that's way less scary than I thought. I spent two weeks convinced I was about to get denied or charged with fraud or something
0 coins
GamerGirl99
same, the word adjudication sounds so ominous but it's mostly just bureaucratic review. the hard part is that EDD doesn't communicate with you much during it so you just sit there refreshing the portal

HOW MUCH will you actually get?? people always ask if they qualify but forget to ask how much. your weekly benefit amount is based on your highest earning quarter in your base period - roughly the first 12 of the last 18 months before you filed. California EDD max benefit right now is around $450 a week. use the EDD calculator on their website to get a ballpark before you get your official award letter
0 coins
Ava Williams
AuthorI was making decent money so I'm hoping it'll be enough to cover my rent at least for a few months while I look. Is the max really only $450?
0 coins
Isabella Costa
yeah it's not a lot. most people get somewhere between $200-450 depending on what they earned. it's designed to be about 60-70% of your prior weekly wage up to that cap
0 coins
Malik Jenkins
california's max UI benefit is embarrassingly low compared to cost of living here. but it's something and you need to claim it
0 coins
Olivia Clark
One more thing worth knowing - California EDD benefit year lasts 52 weeks from the date you file but you can only collect a maximum of 26 weeks of actual payments during that year. After that if you still need help you'd need to look into extended benefits programs if they're available. Hopefully you find work way before that point but it's good to understand the limits upfront.

Author26 weeks is about 6 months right? That feels like enough time to find something, hopefully. My industry moves pretty fast.
0 coins
Olivia Clark
Yes exactly, 26 weeks. And remember you don't have to use them all consecutively - if you get a short term contract or part time work you can pause certifying and potentially come back to your claim within the benefit year.
0 coins
Keisha Thompson
the partial claim thing is underused. you can work part time and still collect a reduced benefit as long as you report your earnings accurately. great option while you're job hunting

I got fired from my job of 6 years about a year ago under pretty shady circumstances and I want you to know I was TERRIFIED to file. thought for sure they'd side with my employer. I filed anyway and went through adjudication and got a letter two weeks later saying I was approved. my employer contested it and I won. the process works better than you'd think when you're sitting there convinced everything is against you
0 coins
Ava Williams
AuthorThis is exactly what I needed to read. Did your employer give a reason for contesting?
0 coins
Freya Andersen
they claimed I violated some policy but when EDD asked for documentation they couldn't produce anything concrete. my clean record spoke for itself
0 coins
Raj Gupta
This is a really common pattern. Employers threaten to contest but when EDD actually requests documentation they often can't back it up. Your 4 year record with no write-ups is your strongest asset here.

Natasha Petrov
side note but does anyone know if there's a time limit on appealing if you DO get denied? I ask because a friend of mine got denied months ago and is just now finding out she might have had a case
0 coins
TechNinja
Appeals must be filed within 30 days of the denial notice date. Unfortunately if that window has passed there are very limited options - you'd need to file a new claim if eligible or contact an employment attorney about other remedies. This is why it's so important to act on denial notices immediately.
0 coins
Natasha Petrov
yeah she's definitely past 30 days. that's really unfortunate. hopefully OP doesn't end up in that situation
0 coins
Raj Gupta
If you miss the appeal deadline you can sometimes request a late appeal and explain why it was late, but it's a high bar to clear and success is rare. Don't sit on denial notices.
