Back to California Unemployment

Alicia Stern

How many days of unemployment can you get on OPT with California EDD?

So I finished my master's degree back in May and I'm currently on OPT (Optional Practical Training) while job hunting in the tech sector. I started a contract position in June but it ended abruptly after about 11 weeks when the company lost a major client and had to cut the whole team. Now I'm wondering if I even qualify for California EDD unemployment benefits while still on OPT status and if so, how many days of unemployment am I actually entitled to collect? I've been reading conflicting things online. Some sources say OPT workers can file for UI benefits if they had qualifying wages, others say immigration status makes it complicated. I worked legally the whole time with valid employment authorization, paid into the system through payroll deductions, and my employer definitely withheld California state taxes. My contract ended officially on August 29th and I haven't had any income since then. The tricky part is I'm not sure if collecting unemployment while on OPT could somehow affect a future visa application or green card process. Also genuinely unsure whether California EDD even looks at your visa/immigration status when you file or if they just look at wages and work authorization. Has anyone been in this exact situation? How did the claim go and how many days of unemployment benefits did you end up receiving?

This is a really specific situation and honestly there's a lot of confusion around it. Let me break down what I know about OPT and California EDD eligibility. The key factors EDD looks at are: 1) whether you had valid work authorization during the period you worked, 2) whether you earned enough qualifying wages in your base period, and 3) whether you're currently able and available to work AND have valid work authorization right now to accept new work. That third point is where OPT gets complicated. If your OPT is still valid and you're authorized to work, you can potentially collect. Standard UI in California is up to 26 weeks (about 182 days). But if your OPT expires before you find work, that's where things can unravel with EDD.

Thank you, this is really helpful. My OPT authorization is valid through next April so I definitely have runway there. The 26 weeks figure is what I was hoping to hear - that's enough breathing room to seriously job search without panicking.

0 coins

wait so does edd actually ask for your visa type when you file? i thought they just ask if youre authorized to work in the US

0 coins

They ask if you're legally authorized to work in the US and if you have documentation to prove it. They don't specifically ask what visa category you're on. But the documentation has to be current and valid for the entire time you're claiming benefits.

I went through almost this exact situation last year, F-1 OPT in engineering. Filed with California EDD after my employer's project funding dried up. The claim went through fine actually - EDD approved it within about 2 weeks. I collected for around 18 weeks total before landing another position. Never had any issues with immigration authorities because of the unemployment claim. The thing that matters most is your EAD card has to be valid the whole time you're certifying for weeks. As soon as your work authorization lapses you have to stop claiming.

0 coins

This is incredibly reassuring to hear from someone who actually did it. 18 weeks is solid. Did you have to show your EAD card as part of the filing process?

0 coins

They didn't ask me to upload it during the initial filing online, but I kept it ready because I'd read that EDD can request documentation at any time especially during identity verification. Keep everything handy.

0 coins

same here, filed on OPT two years back, never had an issue. just make sure you keep doing your job search activities every week and document them properly in your UI Online account

0 coins

Okay so I want to address the immigration impact question because this causes a lot of anxiety and there's some misinformation floating around. Collecting unemployment insurance does NOT automatically count as a "public charge" under current immigration rules as of 2025. USCIS updated the public charge rule and unemployment insurance is NOT listed as a public benefit that factors into public charge determinations for most visa categories. It's different from things like Medicaid or food stamps. That said I'd strongly recommend consulting an immigration attorney before filing if you're worried about a future green card application - rules can change and individual situations vary. But historically UI benefits have not been an issue.

0 coins

This was literally my biggest concern, thank you for clarifying. I'll still probably do a quick consultation with an immigration attorney but this makes me feel a lot better about moving forward.

0 coins

THIS. People panic about this all the time but unemployment insurance is a contributory program - you paid into it. It's not charity. The public charge analysis is totally different.

0 coins

i heard something different from a friend who works in immigration law but idk maybe rules changed recently. OP definitely get professional advice just to be safe

For what it's worth I tried calling California EDD directly to ask about OPT-specific eligibility before I filed my own claim and spent literally 4 hours across two days trying to get someone on the phone. Kept getting the automated system and disconnected. Eventually I found a service called Claimyr - you can check it out at claimyr.com - they basically get you through to an actual EDD agent without the nightmare hold times. There's a demo video at https://youtu.be/JmuwXR7HA10 that explains how it works. Got through to an agent in under an hour and she confirmed my OPT situation was fine to file. Sometimes you just need to talk to a real person to stop second-guessing yourself.

0 coins

Four hours is insane. I've already tried calling once and got disconnected after 45 minutes. I'll check out Claimyr, might be worth it just to get a definitive answer from EDD directly before I file.

0 coins

does claimyr actually work? sounds too good to be true tbh

0 coins

I was skeptical too honestly. But yeah it worked for me. The video demo on YouTube explains the process pretty clearly. Saved me from losing my mind on hold again.

0 coins

Can second this - used it when my claim went into adjudication and I needed to actually speak to someone. Way better than trying to call at 8am and getting a busy signal.

0 coins

ok so genuine question - if youre on OPT and your authorization expires while youre still collecting do you have to pay back the unemployment you already received or does it just stop going forward? asking for a friend lol

0 coins

Going forward only - you're supposed to stop certifying as soon as you're no longer authorized to work. As long as you were authorized during the weeks you certified for, you don't have to repay. If you accidentally certified for weeks after your authorization expired that could create an overpayment situation.

0 coins

okay that makes sense, so its really on the claimant to self-report basically

0 coins

Exactly. You're certifying under penalty of perjury each week that you're able, available, and authorized to work. It's your responsibility to stop certifying if that changes.

0 coins

Something nobody mentioned yet - check if you qualify for 26 weeks carefully because that's the MAXIMUM but not everyone gets the full 26 weeks. Your weekly benefit amount and the total maximum benefit amount (MBA) depend on what you earned in your base period. EDD will send you an award notice showing your weekly benefit amount and your total MBA. Divide MBA by your weekly benefit amount to see how many weeks you actually get. For a lot of people especially on short contracts it can be less than 26 weeks.

0 coins

Oh this is a really important point I hadn't thought about. My contract was only 11 weeks so my base period wages might not be super high. I'll have to actually calculate this.

0 coins

Yeah the base period in California is generally the first four of the last five completed calendar quarters before you filed. So if you only worked 11 weeks of that period your qualifying wages might limit your total benefit amount. EDD has a UI benefit calculator on their website you can use to estimate.

0 coins

This is accurate. Also worth knowing that the minimum weekly benefit in California is $40 and maximum is around $450 per week as of 2025. Most people land somewhere in the middle depending on their earnings.

I work in HR and we've had several OPT employees go through the California EDD process over the years when projects ended. In every case the claims were processed normally as long as the work authorization was valid. The one thing I'd flag is that EDD's identity verification process through ID.me can sometimes be tricky for international students because the system prefers US-issued IDs. If you have a California driver's license or state ID that's much smoother than trying to verify with a foreign passport. Just be prepared for possible delays if your ID verification gets complicated.

0 coins

I do have a California driver's license thankfully. I got it right when I started my program so I've had it for a couple years. Good to know that'll make the ID.me process easier.

0 coins

the id.me thing tripped me up for like two weeks when I filed. had to do a video call with a live agent to verify. worth knowing that option exists if the automated verification keeps failing

0 coins

Yeah the video verification through ID.me is actually pretty painless once you book the appointment. Much better than being stuck in identity pending limbo indefinitely.

0 coins

Jumping in here because I was in a similar spot - OPT, tech sector, contract ended, filed for unemployment. One thing I want to emphasize is the job search requirement. You need to do 3 job search activities per week minimum and log them through your UI Online account. This is non-negotiable. I got a questionnaire from EDD asking me to verify my job search activities a few months in. Make sure your logs are detailed - date, company name, position title, method of contact, outcome. Vague entries will get flagged.

0 coins

3 activities per week - noted. I've been casually tracking applications in a spreadsheet anyway but I'll make sure to log everything properly in the EDD system too.

0 coins

Your personal spreadsheet is great for your own records but EDD's official log in UI Online is what matters for compliance. Keep them both but make sure the UI Online one is thorough.

0 coins

do virtual career fairs count as job search activities? asking because I went to one last week

0 coins

Yes, attending career fairs (including virtual ones) counts as a qualifying job search activity. So does submitting applications, doing interviews, meeting with a recruiter, or contacting employers directly.

0 coins

WAIT. Does anyone know if there's a difference between how many days you can collect if youre on OPT vs a regular citizen? Like does EDD give you fewer days because of the visa status? Seems like it could be a thing

0 coins

No difference in the number of weeks/days of benefits based on visa type. Eligibility and benefit duration are determined by wages earned and work authorization status - not by citizenship or visa category. If you qualify, you get the same 26 weeks maximum that any other claimant gets.

0 coins

okay good to know, i honestly wasn't sure

0 coins

California EDD doesn't differentiate between citizens and work-authorized non-citizens when it comes to benefit duration. Equal treatment is the standard as long as work authorization is valid.

0 coins

just want to add that i was terrified to file for unemployment as an international student because i thought it would mess up my future immigration stuff. finally filed after getting really desperate and honestly nothing bad happened, got approved, collected for about 14 weeks, then found a new job and stopped claiming. nobody from immigration ever contacted me or anything. i know everyones situation is different but i wish someone had told me earlier it would be okay

0 coins

Stories like this really help. Thank you for sharing. I think a lot of international students in the US are scared of this exact scenario and don't realize that UI is something they paid into and are entitled to.

0 coins

exactly!! we pay taxes and unemployment insurance contributions just like everyone else. theres no reason to feel like were doing something wrong by using a benefit we paid for.

0 coins

Another angle to consider - if you're not getting clear answers from the EDD website (and honestly their FAQ is pretty thin on OPT-specific situations), don't underestimate the value of just calling and talking to an agent. I mentioned Claimyr earlier but seriously the peace of mind from getting a real human at EDD to confirm your situation is eligible is worth it. Their number alone gets you nowhere fast but using a tool like Claimyr (claimyr.com) can get you through. Especially useful before you file because you want to make sure you're not setting yourself up for a disqualification or an overpayment situation down the road.

0 coins

yeah I tried calling EDD last Tuesday at like 8:05am and got a message saying they were experiencing high call volume and to call back. this was 5 minutes after they opened lol

0 coins

Ha, classic EDD. That's exactly why I stopped trying to time my calls and just used Claimyr instead. Life's too short to hit redial 40 times.

0 coins

I'm going to try Claimyr before I submit the actual claim. Just want verbal confirmation that my OPT situation is clean before I go through the whole filing process.

0 coins

One more practical thing - once you file and EDD processes your claim, you'll receive a Notice of Unemployment Insurance Award (DE 429Z) in the mail. This will show your weekly benefit amount AND your maximum benefit amount. That max benefit amount divided by your weekly rate tells you exactly how many weeks you're eligible for. Keep this document safe because it's your reference point for everything.

0 coins

Good to know the specific form number. I'll watch for the DE 429Z in my mailbox. Do they also send this electronically through UI Online?

0 coins

Some documents appear in your UI Online message inbox but physical mail is still the primary method for award notices. Make sure your mailing address in your EDD account is current.

0 coins

Also keep in mind that even after you receive your award notice, EDD can still audit your claim. Save all your job search records and any documentation related to your separation from your employer for at least two years.

0 coins

something people dont mention enough - when you certify for weeks make sure you answer the earnings questions correctly. if you did any gig work or freelance coding or anything during a week you need to report those earnings. reporting them doesnt necessarily disqualify you from that week, EDD uses a formula where you can earn up to 25% of your weekly benefit before it starts reducing your payment. but NOT reporting earned income is fraud and could get your whole claim disqualified and trigger an overpayment.

0 coins

Really important point. I haven't done any freelance work since the contract ended but I want to make sure I understand the rules if I do some small projects while job hunting.

0 coins

yeah just report everything honestly and let EDD do the math. the partial benefit calculation usually works in your favor for small amounts of gig income. hiding income is never worth it.

0 coins

wait so if i make like $50 doing a one-time thing i have to report that?? ugh

0 coins

Yes, you report it. But if your weekly benefit amount is say $400, you can earn up to $100 (25%) without any reduction. So a $50 payment in that scenario doesn't reduce your benefit at all, you just report it and collect the full amount that week. The reporting is what's required - the math often works out fine.

0 coins

Can we also just validate how stressful this whole situation is?? Being on OPT with a visa clock ticking AND being unemployed AND trying to navigate California EDD is genuinely one of the more anxiety-inducing combinations I can imagine. OP you're doing the right things by asking questions and figuring this out proactively. The system exists to support you - use it.

0 coins

Thank you genuinely. This whole thread has been way more helpful than anything I found through googling. I feel like I have an actual roadmap now.

0 coins

solidarity 💙 the OPT + unemployment combo is rough but you're definitely not alone in having gone through it

0 coins

seriously EDD needs better resources for international workers. the info is so scattered

0 coins

random question slightly off topic but does being on OPT affect which day of the week you have to certify? like my friend had to certify on specific days based on her last name

0 coins

The certification schedule is based on the last digit of your Social Security number, not your immigration status. It has nothing to do with OPT. Look up the EDD certification schedule based on your SSN's last digit and stick to that window.

0 coins

oh okay that makes sense, definitely not OPT-specific then. thanks

0 coins

And to add - certify on time! Missing your certification window can pause your payments and require you to call EDD to have it reinstated. Just another headache to avoid.

Quick clarification on something I saw debated upthread: CalJOBS registration. If you're filing for California unemployment benefits you are generally required to register with CalJOBS (California's job seeker portal) as part of fulfilling work search requirements. This is separate from logging activities in UI Online. Some claimants on OPT have asked if they're exempt - generally you are not exempt just because of OPT status. Register with CalJOBS, upload your resume, and treat it as part of your job search infrastructure even if you're also using LinkedIn and other platforms.

0 coins

I had not even heard of CalJOBS before this thread honestly. Is it actually useful for tech job searching or is it more of a compliance checkbox thing?

0 coins

Mostly a compliance requirement honestly - the tech job listings on CalJOBS aren't as comprehensive as LinkedIn or Indeed. But you need to be registered to satisfy EDD requirements, and some EDD notices will specifically reference your CalJOBS account. Set it up, keep it active, don't ignore it.

0 coins

EDD can and does check CalJOBS registration during audits. It takes 20 minutes to set up and creates zero problems if you do it. Just do it.

0 coins

I had my claim go into adjudication when I filed on OPT because EDD flagged my employment as contract/temporary and wanted to verify the separation was legitimate and not just a contract expiring as expected. Had to wait about 3 weeks before it resolved. Just flagging this because OP mentioned a contract position - you might hit the same speed bump. Not a huge deal but be prepared for possible adjudication if EDD wants to verify the circumstances of your separation.

0 coins

This is really useful to know in advance. My contract ended because the company lost a client and cut the team - there's a clear business reason. I have emails confirming the termination. Would having documentation of that ready help speed things up?

0 coins

Having that documentation ready is definitely smart. During adjudication EDD may contact you by mail or phone asking for more info. Respond FAST - like within the timeframe they give you - and have your documentation ready. Delays in responding can drag the whole thing out weeks longer.

0 coins

Also worth noting - if your claim does go into adjudication, that's another situation where being able to actually reach an EDD agent by phone makes a huge difference. I used Claimyr (claimyr.com) when mine was in adjudication and speaking to an agent directly helped me understand exactly what documentation they needed rather than just waiting and hoping. That YouTube demo at https://youtu.be/JmuwXR7HA10 explains it well.

0 coins

Good to know about Claimyr as a backup if I hit adjudication. I'm going to compile all my separation documentation now just in case.

Thread summary for anyone who finds this later in google: OPT workers CAN collect California EDD unemployment benefits as long as they have valid work authorization the entire time they're claiming. Maximum is 26 weeks (same as everyone else). Collecting UI does not trigger public charge issues. You need to do 3 job searches per week and log them. Register with CalJOBS. Report any earned income. Watch out for adjudication delays if you had a contract position. Keep your EAD valid and stop claiming if it expires. Hope that helps someone.

0 coins

This is the summary I wish I'd found in the first 5 minutes of searching. Thank you to everyone in this thread - going to file my claim tomorrow.

0 coins

Good luck!! Come back and update us when it goes through

0 coins

Great summary. One small addition: make sure to verify your identity through ID.me as soon as you file - that's often the first bottleneck. Having a California driver's license makes this easier.

0 coins

rooting for you OP! 🤞
