EDD claim confusion - report gig work (DoorDash) or entertainment industry as last employer?
I've been working in wardrobe design for TV productions since 2022, but my last entertainment job ended in April when the industry strikes started affecting productions. My California UI benefits ran out in July, and I've been scraping by doing DoorDash deliveries (averaging about 18-22 hours weekly) while living with my sister in Nevada to save on rent. I'm planning to file a new UI claim since it looks like production might not resume for me until February. My question is: when filing this new claim, do I list DoorDash as my most recent employer, or should I list the production company from April as my last employer? I don't want to mess this up and get stuck in pending hell. The DoorDash earnings are 1099 work, not W-2, if that matters. Thanks for any help!

You absolutely need to report BOTH. The production company as your W-2 employer AND your gig work with DoorDash. California EDD requires you to report all employment, including independent contractor/1099 work. If you don't report everything correctly, you could end up with an overpayment notice down the road, which is a nightmare to deal with.

•Ugh, I was afraid of that. Will my DoorDash earnings make me ineligible though? I'm making way less with deliveries than I was in productions.

•This is terrible advice that could get the original poster in serious trouble. EDD cross-references with tax records, and unreported income is one of the main reasons people get hit with overpayment notices and penalties. Please don't spread misinformation that could harm others financially.

Entertainment industry worker here who also dealt with this! You need to list the production company as your last employer, but you MUST also disclose your DoorDash work on your application. The key issue isn't so much who your last employer was, but being fully transparent about all income sources. Here's something important many people miss: living out of state complicates things. Since you're physically in Nevada while filing a California claim, you need to indicate that on your application. California can still pay your benefits based on your work history there, but you need to meet their requirements for filing an interstate claim.

•Thank you! That's super helpful. I didn't even think about the interstate claim aspect. Do you know if I need to do anything special to initiate that?

When I filed my claim after the writers strike, I listed EVERYTHING - my studio job, plus the TaskRabbit and Etsy side hustles I was doing to survive. EDD asked more questions about my gig work during my eligibility interview, but ultimately they approved my claim because I was making significantly less with gigs than my regular job and was still available for full-time work in my industry. BUT YOU ABSOLUTELY HAVE TO REPORT THE DOORDASH INCOME DURING CERTIFICATION. If you're approved, you'll need to report any earnings each week when you certify. They'll reduce your weekly benefit amount based on what you earn, but you can still get partial benefits if you earn under a certain threshold.

•This is exactly my situation! Thanks for sharing your experience - makes me feel less alone in this mess. So they did approve you even with the gig work? That's reassuring.

•Yes, they did! The key thing they wanted to know was that I was still looking for work in my regular industry and that the gig work was just temporary. Make sure you emphasize that on your application.

•I was in the same boat trying to resolve an issue with my claim last month. After days of failing to get through on the regular line, I used a service called Claimyr (claimyr.com) that got me connected to an EDD representative in about 20 minutes. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km. Saved me so much frustration since I needed to explain my entertainment industry work situation to someone who actually understood the rules.

To address your specific question about DoorDash: it's considered self-employment. When you file your claim, you'll list your production company as your last employer. Then, in the section that asks about self-employment or additional income, you'll report your DoorDash work. The EDD will then determine your benefit amount based primarily on your W-2 wages from the base period (usually the first 4 of the last 5 completed calendar quarters before filing). Your DoorDash earnings will mainly affect your weekly certifications, not necessarily your initial eligibility. Also, since you mentioned you're living in Nevada now - make sure you're filing an interstate claim correctly. You'll file with California since that's where your wages were earned, but you'll need to follow California's rules while physically being in Nevada.

•This is 100% accurate. When I had my eligibility interview, they were very interested in my job search efforts within the industry. Make sure you keep records of any applications, networking, or industry-specific job searching you're doing.

Just to be clear on an important distinction: 1. When you FILE a new claim, you must report all employers, including self-employment like DoorDash. 2. When you CERTIFY for benefits each week after being approved, you must report any income earned that week, including DoorDash. Failure to do either can result in an overpayment determination. The EDD regularly cross-references with tax records and other databases, so unreported income is likely to be discovered eventually. For the interstate aspect, you'll need to indicate on your application that you're physically residing in Nevada. Your monetary eligibility will be based on your California wages, but you'll need to meet Nevada's work search requirements. Make sure you document all work search activities thoroughly.

•Thanks for breaking it down so clearly! Question about the work search requirements - do you know if I need to be looking for jobs in Nevada, or can I still focus on entertainment jobs in California since that's my industry and I plan to return?

•Since entertainment is your established field, you can focus your job search on that industry. However, you should include some Nevada-based opportunities if they exist in your field. The key is demonstrating you're making reasonable efforts to find suitable work based on your skills and experience, not necessarily just any job in your current physical location.

•Unfortunately, unemployment rules ARE complicated, especially for entertainment industry workers with multiple income sources and interstate claims. Getting it wrong can lead to serious financial consequences, including having to repay benefits plus penalties. It's better to understand the process correctly from the start.

Thank you all so much for the helpful advice! To summarize what I'm understanding: 1. List my production company as my last employer BUT also disclose DoorDash work 2. Be clear that I'm living in Nevada but filing based on California work history 3. Make sure to report DoorDash earnings during weekly certifications 4. Document my job search efforts in the entertainment industry I'll be filing tomorrow and will make sure to be completely transparent about everything. Hoping it all goes smoothly!
