EDD appeal filed 3 months ago but still no hearing date scheduled - normal wait time?
I'm really frustrated with the EDD appeals process and hoping someone can give me some insight. I got disqualified for benefits back in March because my employer claimed I was fired for misconduct (which is completely untrue - I was laid off due to budget cuts). I filed an appeal through the CUIAB website on April 12th, got the confirmation letter about a week later saying they received my appeal... and then nothing. It's now July and I haven't heard a single thing about a hearing date. Is this normal? How long does it typically take to actually get scheduled for a hearing? I've called the appeals office twice but just get voicemail. I'm running out of savings and really need to get this resolved. Has anyone gone through this recently and know what the current timeline looks like?

The current backlog for appeal hearings is running 4-6 months in most California offices. Unfortunately, this is fairly normal for 2025. A few things you should be doing while you wait: 1) Make sure your address and contact info are up-to-date in both your UI Online account AND with the appeals board directly 2) Gather all documentation that proves you were laid off due to budget cuts (emails, termination letter, etc.) 3) Keep a log of all your attempts to contact the appeals office 4) Continue certifying for benefits every two weeks even though they're showing as disqualified When you do get your hearing date, you'll typically only get 10-14 days notice, so stay vigilant checking your mail and email.

For documentation, I have the initial layoff letter but my supervisor also verbally told me about the budget cuts. Would it help to get a statement from coworkers who were laid off at the same time?

I waited almost 7 months for my hearing!!!! EDD is the WORST. When I finally got the hearing date, it was scheduled for when I was going to be out of town and they refused to reschedule it. I lost my appeal because I couldn't make it. The system is completely rigged against us!!!!

•Actually, you have the right to request one postponement for good cause. The Notice of Hearing includes instructions on how to request a postponement. For future reference, travel plans can sometimes qualify as good cause if you notify them immediately after receiving the hearing notice and have documentation of pre-arranged travel.

Wait I'm confused... are you talking about an EDD appeal or a disability appeal? Because those are totally different systems with different timelines. My SDI appeal only took 3 weeks to get scheduled.

•This is an unemployment (UI) appeal, not disability. From what everyone's saying, they take much longer unfortunately.

One more tip - while you're waiting for your appeal hearing, you might want to try contacting your former employer directly. Sometimes if you can get them to submit a correction to EDD stating you were laid off rather than fired for misconduct, you can potentially get the disqualification reversed without waiting for the full appeal process. It's a long shot, but worth trying.
