Appealing CalFresh denial with SSDI income - anyone win their hearing?

Just got denied for CalFresh last week and I'm beyond frustrated. I receive SSDI ($1,950/month) and they're calculating my income in a way that makes no sense. The worker counted my entire disability payment without any deductions, which pushed me over the limit by just $75. I've read that there should be a 20% earned income deduction plus medical expense deductions for disability recipients over the standard $155. When I tried explaining this to my worker, she just kept repeating 'the computer calculates it automatically' and wouldn't listen. Has anyone successfully appealed a CalFresh denial when it involves disability income? How long did the hearing take? I've already requested the appeal but I'm wondering if it's worth the stress or if I should just give up. I can barely afford groceries with these insane 2025 prices.

I appealed my denial last year and won! The key thing you need to know is that SSDI (Social Security Disability Insurance) is actually considered UNEARNED income, so you don't get the 20% earned income deduction - that's only for wages from work. However, you're absolutely right about the medical expense deduction! If you have more than $35 in monthly out-of-pocket medical expenses, you can deduct anything above that amount. Do you pay for any medications, doctor visits, medical equipment, or transportation to medical appointments? Even Medicare premiums count. List ALL of these expenses in your appeal paperwork with documentation. That might bring you under the limit.

Omg thank you for clarifying! I think the worker confused me because she mentioned the 20% thing but then didn't apply it. I definitely have way more than $35 in medical expenses - I pay $225 for my Medicare Part B and D premiums, plus about $180/month in prescriptions after insurance. I also take Uber to my specialist appointments since I can't drive anymore (about $95/month). I didn't know I could count all that! Do I need receipts for everything?

I thought about reapplying but I'm worried they'll just deny me again for the same reason if I don't get them to understand the medical deduction situation. Did your cousin do anything differently on the second application?

I successfully appealed a CalFresh denial related to disability income calculation. Here's what worked for me: 1. Gather ALL medical expense receipts - they need proof of everything 2. Print out the CalFresh policy about medical expense deductions (I found it on the CDSS website) 3. At the hearing, speak clearly about each expense and how it relates to your disability 4. If you can get a letter from your doctor explaining your medical needs, that helps My hearing took about 45 minutes and I received a decision 3 weeks later. The ALJ (Administrative Law Judge) was actually very fair and understanding, unlike the county worker who denied me initially. With all your expenses, you should definitely qualify. Don't give up!

Thank you so much for the detailed advice! I didn't even think about getting a letter from my doctor, but that makes sense. How formal was the hearing? I'm getting anxious just thinking about having to argue my case. Did you have to go to a government building or was it over the phone?

THEY ALWAYS DO THIS!! The county workers don't understand their own rules half the time! I swear they're trained to deny people on the first try hoping we'll just give up. When I was on SSDI I had the EXACT same issue and had to fight for 6 months to get my benefits!!! So infuriating!!!

This is so true. I worked for a county welfare department years ago, and I can confirm that training is often inadequate. Many workers are handling 300+ cases and just don't have time to fully understand every policy nuance, especially for less common situations like disability deductions. Not making excuses, but the system is broken at multiple levels.

kinda off topic but does anyone know if the income limits changed for 2025? i heard they went up but can't find the new chart anywhere

Yes, CalFresh income limits for 2025 did increase slightly. For a single person household, the gross monthly income limit is now $2,315 and the net income limit is $1,781. They adjust these numbers every October based on the federal poverty level. You can find the updated chart on the Benefits.Cal website or call your county office for the specific limits for your household size.

I had this same problem last year and tried calling the county office for WEEKS with no luck - always on hold forever or got disconnected. Finally I used a service called Claimyr (claimyr.com) that got me through to a real person at the CalFresh office in about 15 minutes. They have this system that holds your place in line and calls you back when they reach a worker. They have a video showing how it works: https://youtu.be/eZ19FHRETv8?si=_CXnXqNXbLl26WB8. It saved me so much frustration! The worker I finally talked to was able to properly calculate my medical deductions and I got approved without having to go through the whole appeal process.

I've never heard of that service before. I've been trying to get through to my worker for days with no luck. I'll definitely check this out - appeals take so long and I need food assistance now. Thanks for the tip!

wait, i'm confused... isnt calfresh the same as calworks? or are they different things?

They're completely different programs. CalFresh is food assistance only (used to be called food stamps). CalWORKs is cash aid primarily for families with children. You can qualify for one, both, or neither depending on your situation. They have different eligibility requirements and different application processes, though you can apply for both at the same time.

UPDATE: I finally got through to a supervisor at my county office. Turns out the worker had entered my medical expenses in the wrong field in their system, so they weren't being counted in the calculation! The supervisor fixed it and recalculated my benefits on the spot. I now qualify for $281/month in CalFresh! She said I can withdraw my appeal since it's resolved. So relieved I don't have to go through with the hearing. Thanks everyone for your help and advice!

That's fantastic news! I'm so glad you were persistent and got it resolved. This is exactly why it's so important to understand your rights and the rules. Make sure you keep all your medical receipts organized going forward, as they'll likely ask for verification again at your next recertification. Congrats on getting the benefits you deserve!

Congratulations on getting it resolved! Your story is so helpful for others in similar situations. It's really telling that it was just a data entry error in their system - makes you wonder how many people get wrongly denied because of these kinds of mistakes. I'm dealing with a similar issue right now with my recertification and this gives me hope that persistence pays off. Did you have to provide any additional documentation to the supervisor, or were they able to see your medical expenses in the system once they looked in the right place?

Hi everyone! I'm new to this community and just wanted to say how helpful this thread has been. I'm currently dealing with a CalFresh application myself and reading about everyone's experiences is really eye-opening. @CosmicCadet, your situation sounds almost identical to what I'm going through - I'm also on SSDI and they initially said I made "too much" without considering my medical expenses. Did the supervisor ask you to bring in new paperwork or were they able to pull up what you had already submitted? I'm trying to figure out if I should gather more documentation before I call them. Thanks for sharing your success story - it gives me hope that there's light at the end of the tunnel!
