WV UCC search showing wrong debtor info - filing rejected twice

Been dealing with a nightmare situation for the past month. Had to file a UCC-1 for equipment financing on a construction company and the WV UCC search keeps pulling up inconsistent debtor information. Filed twice already and both got rejected because apparently the debtor name on my filing doesn't match what's in their system exactly. The company is registered as 'Mountain View Construction LLC' but the UCC search is showing variations like 'Mountain View Construction, LLC' (with comma) and 'Mountainview Construction LLC' (no space). Secretary of State office just keeps saying to check the exact name but their own search results are inconsistent. This is holding up a $180K equipment loan and my client is furious. Anyone else dealt with WV's system being this picky about debtor names? The collateral description is straightforward - just heavy equipment with serial numbers - so that's not the issue.

WV can be really strict about exact name matching. Did you try searching using the exact name from the Articles of Incorporation? Sometimes the comma placement or spacing in LLC names trips up their system.

Yeah I pulled the Articles and it shows 'Mountain View Construction LLC' without the comma but the UCC search portal sometimes returns results with commas added. Super frustrating.

Are you sure you're looking at the right entity? Sometimes there are multiple similar business names registered and you need the specific one that matches your debtor.

Double checked - only one Mountain View Construction LLC registered in WV. The issue is definitely the name formatting.

Then stick with exactly what's on the Articles. That's the official name regardless of how their search displays it.

UGH WV's system is the WORST! I spent weeks last month dealing with similar garbage. Their online portal has bugs and the staff doesn't even understand their own requirements. File exactly as shown on Articles and if they reject it AGAIN demand they explain specifically what's wrong.

The all caps response is real but honestly WV does have more filing issues than most states in my experience.

Another thought - make sure you're not including any extra characters or spaces before or after the name. WV's system is sensitive to that too.

Checked that too. Used exactly 'Mountain View Construction LLC' with proper spacing and no extra characters.

If all else fails, you might need to file a paper UCC-1 instead of electronic. Sometimes that bypasses the automated name-matching issues.

Paper filing might take longer though and this loan needs to close soon. But good backup plan.

Just for reference - WV UCC filings require exact match to the business name as registered with Secretary of State. No variations or abbreviations allowed. The search inconsistencies are just display issues.
