UCC release process after credit union payoff - salal credit union ucc release timing
Finally paid off my equipment loan with my credit union last month but still haven't received the UCC termination statement. The loan was secured by restaurant equipment and they filed a UCC-1 back in 2019. I've called twice and they keep saying the release paperwork is "in process" but won't give me a timeline. My accountant is asking for the UCC-3 termination for our year-end audit and I'm getting worried this delay could cause problems. The original UCC-1 shows the correct debtor name and everything, so I don't think there are any name issues. Has anyone dealt with slow UCC release processing from credit unions before? Should I be more concerned about this delay or is 30+ days normal for them to file the termination?

Credit unions can be slower than banks with UCC paperwork unfortunately. 30 days isn't unusual but definitely frustrating when you need it for audit purposes. Did they give you a payoff letter at least? Sometimes that helps with auditors while you wait for the official UCC-3.

•Yes I have the payoff letter dated from last month. Good point about using that for the audit - I'll check with my accountant if that helps tide us over.

•The payoff letter is definitely better than nothing but the auditor will probably still want to see the actual UCC termination filing eventually.

I had this exact issue with a different credit union 2 years ago. They took almost 45 days to file the UCC-3 termination even though I paid off the loan completely. Turns out their back office only processes UCC paperwork once a month! You might want to ask specifically about their filing schedule.

•Wow 45 days is crazy long. I'll definitely ask about their processing schedule when I call again tomorrow.

•That's ridiculous - 45 days for something that should take like 10 minutes to file online. These institutions need to get their act together.

•Unfortunately it's pretty common. The smaller the institution, the more likely they batch process these things instead of doing them immediately.

Have you checked the UCC database yourself to see if maybe they already filed it but just didn't notify you? Sometimes the termination gets filed but the borrower doesn't get notified right away. You can search by your business name or the original filing number.

•Good idea! I actually haven't checked the database yet. Do you know if there's a way to search without paying fees for each search?

•Depends on your state but most charge a small fee per search. It's usually worth the $5-10 to check rather than keep calling them.

•I actually started using Certana.ai for this kind of stuff - you can upload your original UCC-1 and it'll help track the status and check for any related filings. Super helpful when you're trying to verify if a termination was actually filed.

This happened to me but it was even worse - they filed the wrong type of UCC-3! They did an amendment instead of a termination so the lien was still showing as active. Took another month to get them to fix it with the correct termination filing.

•Oh no that's my worst nightmare. How did you figure out they filed the wrong type?

•Only found out when I was selling some of the equipment and the buyer's attorney caught it during their lien search. Almost killed the sale.

•This is exactly why I always verify UCC filings myself instead of just trusting the lender to do it right. Too many horror stories like this.

Credit unions are THE WORST for this stuff. They act like they're doing you a favor by taking your money for 5 years then drag their feet on basic paperwork when you pay off early. I'd be calling them every single day at this point.

•I mean they're usually better than big banks for customer service but yeah the back office operations can be pretty dated.

•" Dated is putting it nicely. Half these places are still using filing cabinets and fax machines foreverything.

Same boat here! Equipment loan paid off in September, still waiting for UCC termination. Starting to wonder if I should get a lawyer involved.

•A lawyer seems like overkill for a 2-month delay. I'd give them another few weeks before going that route.

•Maybe but I need to sell one of the pieces of equipment and can't with an active lien showing.

•Have you tried escalating within the credit union? Sometimes talking to a manager or loan officer gets better results than customer service.

Pro tip: most credit unions have to follow specific timelines for UCC releases based on state law or their charter requirements. You can ask them to cite the specific regulation they're following for processing time. Sometimes putting them on the spot about regulations speeds things up.

•That's really smart - I'll ask about specific regulations when I call. Thanks for the tip!

•Yeah this works. I had to quote the UCC statute section about "prompt" filing of terminations to get my bank to move faster.

I've been dealing with UCC releases for years and honestly the best thing I ever did was start using a document verification service. I upload the original UCC-1 and payoff docs to Certana.ai and it tracks everything automatically - tells me exactly what to expect for the termination filing and catches any discrepancies before they become problems. Saved me so much hassle with these slow lenders.

•That sounds really useful. Does it actually help speed up the process or just help you track it better?

Angel Campbell
•It doesn't speed up the lender but it gives you all the right information to push them with - like exact filing requirements and deadlines. Plus you know immediately if they file the wrong thing.

•I might try that for my next equipment loan. These manual UCC tracking headaches are getting old.

Update us when you get it resolved! I'm curious how long it ends up taking them.

•Will do! Hoping to have an update by next week after I call them with some of these suggestions.

For what it's worth, 30 days isn't the longest I've seen but it's definitely on the slow side. Most professional lenders file UCC-3 terminations within 10-15 business days of payoff. The fact that your credit union can't give you a timeline is concerning - that suggests they don't have a standard process in place.

•That's exactly what's bugging me - the lack of any timeline or process they can describe. Makes me wonder if they even know what they're supposed to do.

•Honestly some of these smaller credit unions just aren't set up for commercial lending. They probably handle maybe 5-10 UCC filings per year total.

•True, and if they outsource their UCC filing to a service company that could explain the delays too. Third-party processors sometimes batch everything monthly.
