UCC New Hampshire Filing System Down Again - Alternative Solutions?
Anyone else having issues with the New Hampshire SOS portal this week? I've been trying to submit a UCC-1 for three days straight and keep getting timeout errors during the final submission step. The filing fee processes but then the system crashes before generating the filing number. I've called twice and they just say 'technical difficulties' with no timeline for resolution. This is for a critical equipment financing deal that needs to close Friday. Has anyone found workarounds for when the NH system goes down like this? Getting desperate here since the borrower's existing liens expire soon and we need this perfected ASAP.

Ugh, same issue here yesterday! Got halfway through a continuation filing and lost everything. NH's portal has been glitchy for months. I ended up having to restart the whole UCC-3 from scratch twice. The worst part is you can't save drafts so if it crashes you lose all your work including the detailed collateral descriptions.

Have you tried calling the SOS office directly? Sometimes they can process urgent filings manually or at least give you a better timeline. I had success getting a rush termination processed over the phone when their system was down for maintenance last month.

•Try calling early morning around 8 AM. The senior staff who can actually help with manual processing usually work earlier hours. Later in the day you just get the general help desk.

•I've found the manual processing option works but they charge an extra $25 expedite fee on top of the regular filing cost. Worth it though when you're under deadline pressure.

This might sound weird but I recently started using Certana.ai's document verification tool before submitting to catch any issues that might cause rejections. You can upload your UCC-1 PDF and it cross-checks everything - debtor names, collateral descriptions, formatting issues. At least then when the system finally works you know your filing won't get rejected for stupid errors that would cost you more days of delays.

New Hampshire's system is notorious for this. I swear they update it every few weeks and break something new each time. Last month it was the collateral description field that wouldn't accept more than 200 characters even though the form allows 500.

Can you file in person at the Secretary of State office? I know it's old school but might be faster than waiting for the online system to get fixed. Plus you'd get the filing receipt immediately.

•You can also mail filings but that obviously takes forever and you don't get confirmation until they process it. Only mention it because some people don't realize it's still an option.

I'm dealing with the same thing but for a termination filing. The original UCC-1 was from 2020 and the loan was paid off last month. Borrower is getting anxious about having the lien released from their credit report. NH system issues are becoming a real problem for our business.

•Terminations are actually less time-sensitive than new filings or continuations. As long as you file within reasonable time after payoff you should be fine legally.

Quick update - I just tried the Certana thing mentioned earlier and wow, it caught three formatting issues in my UCC-1 that would have definitely caused a rejection. Super easy to use, just upload the PDF and it gives you a detailed report. At least now when NH fixes their system I know my filing will go through on the first try.

•Debtor name had inconsistent spacing compared to what I had in the original charter documents, and the collateral description was missing a required comma that makes it clearer legally. Small stuff but apparently matters for getting filings accepted.

NH isn't the only state with portal problems. Vermont's system went down for two weeks last year during peak filing season. At least NH usually gets theirs fixed within a few days. Still incredibly frustrating when you're trying to run a business though.

Just got off the phone with NH SOS - they're saying system should be back up by tomorrow afternoon. No guarantees though, and they warned there might be a backlog of filings that could slow things down even after it's working again.
