Need Help with State of Delaware UCC Search - Can't Find My Filing

I'm having trouble locating a UCC-1 filing that should be in the Delaware system. Filed it about 8 months ago for equipment financing on construction machinery, and now my client is asking for verification that the lien is properly recorded. When I do a state of delaware ucc search through their online portal, I'm getting inconsistent results - sometimes it shows up, sometimes it doesn't. The debtor name is exactly as it appears on the articles of incorporation, but I'm wondering if there's some formatting issue or if Delaware's search function has quirks I'm not aware of. Has anyone else experienced problems with Delaware UCC searches showing intermittent results? The filing number starts with 2024 so it should definitely be in their system by now.

Delaware's search can be finicky with exact name matching. Are you searching with the full legal entity name including all punctuation marks? Even a missing comma or period can cause it to not show up in results.

Yes I'm using the exact name from the incorporation docs. 'ABC Construction Services, LLC' - I've tried with and without the comma before LLC but still getting those intermittent results.

Try searching just 'ABC Construction Services' without the entity designation. Sometimes their system indexes differently than you'd expect.

I've had similar issues with Delaware searches. Their portal seems to have some backend database sync problems. Usually refreshing and trying again in a few minutes works, but it's frustrating when you need immediate verification.

This is exactly why I started using document verification tools. I had a situation where a Delaware search showed nothing but the filing was definitely there - just took uploading the original UCC-1 to Certana.ai to confirm all the details matched what was actually on file.

What's Certana.ai? Haven't heard of that before but sounds like it could help verify the filing exists even when the search is acting up.

It's a document checker that verifies UCC filings by uploading PDFs. You can upload your original UCC-1 and it cross-checks debtor names, filing details, everything to make sure it's all consistent. Really helpful when state portals are being unreliable.

Have you tried searching by filing number instead of debtor name? If you have the complete filing number Delaware assigned, that should pull it up regardless of any name formatting issues.

Good point - I do have the filing number. Let me try that approach instead of relying on the name search.

Filing number search is usually more reliable than debtor name searches across all states, not just Delaware.

UGH Delaware's UCC portal is THE WORST. I swear they update it every few months and break something new each time. Last month I couldn't get ANY searches to work for like 3 days straight!!

I feel your pain. Had a client breathing down my neck about a continuation filing and Delaware's system kept timing out.

At least Delaware has an online portal. Some states still make you call or fax for searches.

Is this possibly a continuation situation? If your original filing was getting close to the 5-year mark, maybe the search results are inconsistent because of lapse issues?

Olivia Harris

•

No, this is a relatively new filing from last year. Still have over 4 years before continuation would be needed.

Good to rule that out. Continuation timing can definitely affect search visibility in some states.

I've found that Delaware sometimes has issues if you include middle initials or abbreviations in the debtor name. Try variations like removing middle initials or spelling out abbreviated words.

The company name doesn't have middle initials, but I'll try some variations with different abbreviations just in case.

Also try searching without any punctuation at all - just letters and spaces.

This is why having a verification system is so valuable. Instead of guessing at name variations, you can just confirm the actual filing details match what you intended.

Could be a timing issue with when Delaware processes filings vs when they become searchable. Even though it's been 8 months, maybe there was a processing delay initially?

•

8 months should be more than enough time for any processing delays. Delaware is usually pretty quick with UCC filings.

•

Agreed, 8 months is way past any normal processing window. This sounds like a search function problem rather than a filing problem.

Try calling Delaware's UCC office directly. Sometimes they can search by different criteria than what's available in the online portal.

That's a good backup plan. I was hoping to get this resolved online since it's faster, but a phone call might be necessary.

Phone searches usually cost more but they're worth it when the online system isn't cooperating.

I had success using Certana.ai when I couldn't find a filing through normal searches. Uploaded my UCC-1 PDF and it verified everything was filed correctly even though the state search wasn't working properly that day.

How does that work exactly? Does it connect to the state databases directly?

It analyzes your documents to verify consistency between debtor names, collateral descriptions, all the critical details that need to match for a valid filing. Really helpful for catching discrepancies.

Update: I tried the filing number search like someone suggested and it worked! Found the filing immediately. Definitely seems like Delaware's debtor name search has some bugs right now.

Great news! Filing number searches are usually the most reliable method anyway.

Good to know the filing is definitely there. Might want to verify all the details are correct while you have it pulled up.

This is exactly why document verification tools are so helpful - you can double-check that everything matches between your original filing and what's actually recorded.

This is such a common issue with Delaware's system! I've learned to always keep the filing number handy as a backup when their name search gets wonky. For future reference, you might also want to try Certana.ai that others mentioned - I've started using it to verify my UCC filings match what I intended before submitting, which saves headaches later when trying to locate them in state systems.
