Montana UCC search results showing weird discrepancies - anyone else seeing this?

I've been doing UCC searches in Montana for equipment financing deals and I'm getting some really confusing results back from their system. The search I ran yesterday for a debtor name came back with 3 active filings but when I searched again today using the exact same spelling, only 2 showed up. The missing one was a UCC-1 from 2019 that should still be active since it hasn't hit the 5-year mark yet. Has anyone else noticed the Montana SOS database acting up lately? I'm worried I'm missing critical liens on this $180K equipment deal and my client is pushing to close next week. The debtor name is spelled correctly (I triple checked) and I used both exact match and wildcard searches. Really need to make sure I'm not missing any prior liens before we file our UCC-1.

I've seen this before with Montana's system. Their database sometimes has indexing delays, especially after maintenance windows. Try searching with different variations of the debtor name - sometimes a comma or middle initial throws off their search algorithm. Also check if you're searching the right entity type (individual vs organization).

Good point about entity type. This is a LLC so I've been searching under organization. Should I also run an individual search for the members?

Depends on your collateral and the loan structure. If it's equipment tied to the LLC specifically, the organizational search should be sufficient. But if there are personal guarantees involved, you might want to check the individual members too.

Montana's UCC database is notorious for this stuff. I had a similar issue last month where filings would appear and disappear randomly. Called their office and they said they were doing system updates. Maybe try calling them directly at 406-444-3665 to verify what's actually on file?

I left the date fields blank which should give me everything active. The filing that disappeared was from 2019 so it should definitely show up in an unlimited search.

Try setting specific date ranges like 2015-2025 instead of leaving it blank. Sometimes their system interprets blank fields differently than you'd expect.

Check if the missing filing might be a continuation or amendment that changed the original record. Sometimes when they file UCC-3 amendments the original filing gets updated in a way that affects search results.

That's a good thought. The original filing I'm looking for was pretty straightforward equipment collateral. How would I check for amendments without the original filing number?

Had this exact problem last year. Turned out the debtor had filed a name change with the state but hadn't updated their UCC filings. The old business name was still showing some filings while the new name showed others. Make sure you check for any DBA or name change filings.
