Louisiana SOS UCC search showing wrong debtor name - filing rejected twice

Has anyone dealt with the Louisiana Secretary of State UCC search database showing inconsistent debtor names? I'm trying to file a UCC-1 for equipment financing on a trucking company, but every time I submit the filing it gets rejected because the debtor name doesn't match exactly what's in their system. The business is registered as 'Bayou Transport Solutions LLC' but when I do a Louisiana SOS UCC search, sometimes it shows 'Bayou Transport Solutions, LLC' (with comma) and other times 'BAYOU TRANSPORT SOLUTIONS LLC' (all caps). I've tried filing the UCC-1 three different ways and got rejected twice already. The loan closes next week and I'm getting desperate. Which version of the name should I use? The borrower's articles of incorporation show it without the comma, but the Louisiana SOS UCC search results are all over the place. This is a $340,000 equipment loan and I can't afford to have an unperfected security interest because of a stupid punctuation mark.

I feel your pain on this one. Louisiana's system can be really finicky about exact name matches. Have you tried calling the Secretary of State's office directly? Sometimes they can tell you exactly how the debtor name appears in their master database.

The key is to match the EXACT name as it appears in the Articles of Incorporation filed with the Secretary of State. If the articles show 'Bayou Transport Solutions LLC' without the comma, that's what you should use on your UCC-1. The search results can be inconsistent because of how their database displays names, but the filing system should accept the exact name from the articles.

I'm surprised nobody mentioned checking the Assumed Name database. Sometimes businesses file under assumed names and that can cause confusion with UCC filings. Worth checking if Bayou Transport has any DBAs on file.

Had similar issues with Louisiana last year. Ended up having to file an amendment after I finally got the UCC-1 accepted because I used the wrong version of the name initially. Cost me extra time and fees but at least the lien was perfected.
