Zero hours reported by employer blocking my UI claim - how to fix when ESD won't respond?

I'm at my wit's end trying to get my unemployment claim approved. ESD automatically denied my claim because I apparently don't meet the 680 hours requirement in my base year. But here's the problem - when I checked my wage and hour records, I discovered my previous employer reported all my earnings but put ZERO for my hours worked! I would absolutely qualify if my actual hours had been correctly reported. I've tried everything I can think of: - Called the employer's HR department (completely unhelpful) - Attempted calling ESD multiple times (even right at 8:01am when they open) but after going through all the menu options, I just get "We're experiencing high call volume" and then "goodbye" *click* - Sent a secure message through eServices with PDFs of ALL my paystubs showing the hours I actually worked It's been 12 days with no response to my message. I can't keep filing claims that will just get automatically denied because of this hours reporting error. Does anyone know how to actually reach a human being at ESD who can fix this data issue? Is there a special number or trick to getting through? This is my first time dealing with unemployment and I'm completely lost.

You need to file an appeal right away! Don't wait for them to respond to your secure message. When your claim is denied, you have only 30 days to appeal the decision. There should be appeal instructions in your determination letter. This is actually a common issue - employers sometimes mess up their quarterly reporting and it can cause exactly this problem with hours.

Thank you! I didn't realize I should appeal rather than just trying to get them to fix the data. The determination letter came through my eServices account about 10 days ago - so I still have time? Do I need anything special for the appeal besides my paystubs showing the hours?

same thing happened to my roommate last yr. he had to fax his paystubs to some number and it took 5wks to fix. its so frustrating how they put all the burden on us when its the employers fault!!

yep! he had to keep filing every week even tho they kept gettin denied. once they fixed it he got backpay for all those weeks but it was super stressful making rent while waiting

In your appeal, specifically state this is a "wage and hour dispute" where your employer reported earnings but zero hours 3. Submit all paystubs showing hours worked during your base year 4. Continue filing weekly claims even while your appeal is pending 5. Request a "wage investigation" specifically in your appeal ESD will contact your employer during the appeal process to verify the hours. I recommend filing online for speed but ALSO sending a paper copy via certified mail with return receipt. This gives you proof of submission and the date. The appeal form is available on ESD's website. Make copies of everything you submit and keep a log of all your communications with dates and times.

This is just a paid service that charges you to wait on hold, right? Why should we have to PAY to access a government service we're entitled to? The system is completely broken if we need to shell out money just to talk to someone about our benefits.

yeah actually the agent was super helpful!! she fixed my issue right on the call. just make sure u have all ur documents ready to go cuz they cant really call u back. hope it works out for u!!

Hey just wondering did you check if your employer reported your hours to L&I correctly? Sometimes they report differently to different agencies which is STUPID but happens. You can make an SAW account and check your hours there too.

I didn't even think about L&I reporting! I'll check that right now. What's bizarre is that all my W-2 income shows up correctly in the ESD system, just with zero hours attached.

One more thing - when you file your appeal, you'll need to state whether you want a hearing or not. I STRONGLY recommend requesting a hearing with an Administrative Law Judge. This gets your case in front of someone who can actually make decisions. Prepare all your evidence ahead of time (paystubs, timesheets, anything showing your hours). The hearing will be scheduled several weeks out and can be done by phone.

They'll be invited but if they don't show up, that actually works in your favor. If you have documentation and they don't show to dispute it, the judge will typically rule based on the evidence presented (your paystubs). Just be organized, concise, and respectful during the hearing.

The ESD system is COMPLETLEY BROKEN!!! I had almost the exact same issue in January. My employer reported my wages as 1099 instead of W-2 (which was wrong, I was an employee!) and it took ELEVEN WEEKS to get it fixed!!! The worst part is that no one at ESD would even admit there was a problem for the first 6 weeks!! I sent EIGHT secure messages before someone actually responded!!!

IMPORTANT UPDATE FOR 2025: ESD has a new "Data Correction Request" form specifically for wage and hour disputes that wasn't available last year. You can find it under "More Services" in your eServices account. This is IN ADDITION to filing an appeal, not instead of it. The form allows you to upload evidence like paystubs directly tied to the quarters in question. This might help resolve your issue faster than waiting for the appeal process.

Oh! This is huge - thank you! I just logged in and found the form under More Services. It lets me select each quarter where there's a discrepancy and upload the corresponding paystubs. I'm filling this out right now. I'll still file the appeal too as a backup.
