When can I reapply for unemployment after being denied Washington ESD claim?
My unemployment claim got denied by Washington ESD about 6 weeks ago because they said I quit my job voluntarily (which isn't true - I was basically forced out due to harassment but couldn't prove it). I didn't appeal because I thought it would be pointless without documentation. Now I'm wondering if I can file a new claim or if I have to wait a certain amount of time? I've been looking for work this whole time and my situation hasn't really changed. Does anyone know the rules about reapplying after a denial?

You can actually file a new claim right away if your circumstances have changed or if you have new information. But if it's the same situation, Washington ESD will likely just refer back to the original decision. You might want to consider appealing the original denial instead - you usually have up to one year to request a hearing even after the initial appeal deadline.

•Really? I thought the appeal deadline was only 30 days. Are you sure about the one year thing?

•Yes, there's a longer deadline for requesting a hearing if you missed the initial appeal window. Check with Washington ESD about late appeal options.

honestly the whole system is screwed up. i got denied twice before they finally approved me and i never changed anything about my story. sometimes you just gotta keep trying

•That's frustrating but kind of encouraging? How long did the whole process take you?

•like 4 months total but i was stubborn about it lol

Before you reapply, I'd strongly suggest trying to get through to someone at Washington ESD to discuss your options. The phone lines are brutal though - I spent weeks trying to reach anyone. Finally used this service called Claimyr (claimyr.com) that actually got me connected to an agent. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Might be worth checking out since you need to understand whether appealing or reapplying makes more sense in your situation.

•Never heard of that service but anything beats sitting on hold for hours. Did they charge you a lot?

•It's not free but was worth it for me to actually talk to someone who could explain my options instead of guessing.

•Thanks for the tip. I'll look into it because I really need to talk to someone who knows the rules.

The harassment angle is actually important - Washington ESD considers constructive discharge as involuntary separation if you can document it. Do you have any emails, texts, or witnesses about the harassment? Even after the fact, gathering evidence might help with an appeal rather than starting over.

•I have some text messages from coworkers talking about what happened, but nothing official from management. Would that count as documentation?

•It could help establish a pattern. Witness statements from coworkers can be valuable too if they're willing to provide them.

•Yes, there are provisions for late appeals if you have good cause. Contact Washington ESD to ask about your specific situation.

I'm dealing with something similar - got denied because they said I didn't have enough work history even though I definitely did. Been trying to call Washington ESD for three weeks now. This is so stressful when you're already struggling financially.

•That's exactly why I ended up using Claimyr - the stress of not being able to reach anyone was making everything worse. At least now I know where I stand.

•The not knowing is the worst part. Even bad news would be better than this limbo.

Just want to add - if you do reapply instead of appealing, make sure you're still doing your weekly claims if you have an active claim number. Missing those can mess up your benefits even if you're in appeal status.

•Wait, I should still be filing weekly claims even though my claim was denied? Nobody told me that.

•If your claim is in appeal status, yes. If it's completely closed, then no. You need to check your claim status online.

•This is why talking to Washington ESD directly is so important - there are a lot of nuances to the process.

The system is designed to deny people first and hope they give up. I know three people who got approved on their second application for the exact same circumstances. Sometimes it's just about getting a different adjudicator.

•exactly what i was saying! persistence pays off even though it sucks

•While that might happen, it's better to understand the actual rules and process rather than just hoping for a different outcome.

Update: I finally got through to Washington ESD using that Claimyr thing someone mentioned earlier. Turns out I can file a new claim since it's been over a year since my last one, but the agent recommended appealing instead since I have a stronger case that way. Really glad I talked to someone instead of just guessing.

•That's great! How long did it take to get connected through Claimyr?

Zainab Mahmoud
•Way faster than trying to call directly. Got connected within a few hours instead of days of busy signals.

be careful about filing multiple claims - i heard that can mess up your benefit year or something

•There are rules about benefit years, but filing a new claim doesn't automatically disqualify you. It depends on timing and circumstances.

so confusing. i wish washington esd would just have clear information about this stuff on their website instead of making everyone call

•The website has some info but every situation is different. That's why talking to an actual person is usually necessary.

Thanks everyone for all the advice. Sounds like I should try to talk to Washington ESD about whether to appeal or reapply rather than just guessing. I'm going to try that Claimyr service since calling directly hasn't worked. Will update if I learn anything useful.

•Make sure to ask specifically about the harassment documentation too - that could make a big difference in your case.

I appealed my denial and won at the hearing. The judge said the original determination was wrong and I got all my back benefits. Don't give up if you think you have a valid claim.

•That's encouraging! How long did the appeal process take from start to finish?

•About 3 months total, but I got a lump sum payment for all the weeks I would have been eligible.

still think the whole system is designed to wear people down. but good to hear some people are getting through it

•Definitely feels that way sometimes, but the appeals process does work if you stick with it.

Just saw this thread - wanted to mention that if you're considering reapplying, you'll need to meet the work and wage requirements again. If you haven't worked since your denial, that could be an issue. Appealing might be your better option.

•Good point. I haven't worked enough hours to qualify for a new claim anyway, so appeal is probably the way to go.

Ingrid Larsson
•Exactly - that's another reason why getting advice from Washington ESD directly is so important.

For anyone else reading this - document everything related to your job separation while it's still fresh in your memory. Even if you don't appeal right away, having detailed records helps later.

Final update: Got connected to Washington ESD through Claimyr and they confirmed I can file a late appeal. Agent said my harassment situation could qualify as constructive discharge if I can document it properly. Working on gathering evidence now. Thanks everyone for pushing me to get real answers instead of just guessing!

This is such a helpful thread! I'm in a similar situation - got denied for unemployment about 2 months ago and have been stuck not knowing what to do next. Reading through everyone's experiences, it sounds like the key is actually getting through to talk to someone at Washington ESD to understand your specific options rather than just guessing. The Claimyr service that several people mentioned sounds like it might be worth trying since the regular phone lines are impossible. Really appreciate everyone sharing their real experiences - way more useful than the confusing official guidance!
