Understanding BYE dates during ESD appeals - need urgent advice

I'm currently going through my first-ever appeal with ESD after being disqualified for supposedly 'refusing suitable work' (which I absolutely did NOT). While I'm waiting for my hearing date, I just realized I have no idea what happens with my Benefit Year End date during an appeal. My BYE is coming up in about 5 weeks, and I'm panicking about whether I need to file a new claim or if the appeal process freezes everything. Does anyone know if my BYE date gets extended automatically while I'm waiting for the appeal decision? I can't get through to anyone at ESD to ask this question and I'm getting really worried I'll mess something up.

Your BYE date does NOT change just because you're in an appeal. The Benefit Year End is fixed at 52 weeks from when you first filed your claim, regardless of appeal status. If your appeal is still pending when you hit your BYE, you WILL need to file a new claim to establish a new benefit year. Make sure you do this right after your current benefit year ends - even one day late can cause payment gaps.

Thanks for the info. So do I just file like normal through eServices even though my appeal is still open? Seems weird to start a new claim while the old one isn't resolved yet...

when i had my appeal last yr my bye happened right in the middle of it all. complete nightmare!! i filed new claim like normal but then everything got all messed up. the system kept saying i had 2 open claims and wouldnt let me file weekly claims. took 6wks to fix

The correct procedure is to file a new claim when your BYE date arrives, even during an active appeal. Here's the important part many people miss: you must call ESD after filing the new claim to explain you have an appeal in progress. They need to manually note this in their system to prevent exactly the situation the previous commenter experienced with duplicate claims causing filing issues. The appeal decision will still apply to your old claim period, but your new weekly claims will be processed under the new benefit year. Just make sure you keep detailed records of all communications during this transition period.

If you need to reach ESD to discuss this specific situation, I'd highly recommend using Claimyr (claimyr.com). I was in a similar situation with an appeal and BYE date conflict last month and spent days trying to get through on the regular line with no luck. THE ENTIRE ESD SYSTEM IS DESIGNED TO MAKE YOU GIVE UP!!! I went through exactly what you're describing last year. My BYE date came and went during my appeal for a false "quit without good cause" claim from my ex-employer. I filed a new claim like I was supposed to but NO ONE TOLD ME I needed to call and explain about the appeal!!! Ended up with my benefits cut off for 8 WEEKS while they "investigated the conflict between claims" which was THEIR OWN FAULT for having such a garbage system that doesn't track appeals properly!!! If you don't get someone on the phone who specifically notes your account about the appeal/BYE situation, you WILL end up in benefit limbo. The appeals office and regular claims department might as well be on different planets - they DO NOT communicate with each other!

@haloqty87 Yes, I eventually got backpaid but had to fight for it after winning my appeal. They tried to say I "failed to properly file a new claim" even though I did everything by the book! The system is rigged against us!

Just to clarify some misinformation in this thread - your appeal and BYE date are two separate processes that unfortunately can overlap. The BYE date is simply the end of your 52-week benefit period, while an appeal addresses a specific determination on your claim. When you reach your BYE date: 1. File a new claim immediately 2. Continue to file weekly claims without interruption 3. Contact ESD to have them add a notation about your active appeal 4. Keep separate documentation for your appeal process vs. your new claim If you win your appeal after your BYE date, any benefits awarded from the appeal decision will still be processed and paid, even though they relate to your previous benefit year.
