ESD denied training benefits after 90-day approval - can I still qualify?

I finally won my appeal after being denied unemployment initially, but it took over 90 days to get approved. Now I'm facing another issue - I didn't know I could apply for training benefits until my regular claim was almost finished. When I called ESD about training benefits, the agent said I missed the application window and that determinations currently take up to 14 weeks! Has anyone successfully gotten training benefits approved when applying outside the normal timeframe? My claim only has about 6 weeks left, and I really need this training program to switch careers after my manufacturing job was eliminated. Any experiences or advice would be so appreciated!

I was in a similar situation last year. You need to file for a 'Commissioner's Approved Training' (CAT) immediately even if you think you're too late. This is different from the regular Training Benefits (TB) program. For CAT, the time restrictions are a bit more flexible. When I applied after my approval delay, I had to include a statement explaining why I couldn't apply within the standard timeframe. The key was documenting that I had researched training programs immediately after approval but needed time to select the right one. It worked for me, but took about 10 weeks for the determination.

Thank you so much for this! I didn't know about the CAT option being different. Did you have to submit anything special with your application? I've already enrolled in a 6-month IT certification program, hoping that would help my case.

This is terrible advice. "Just keep trying" without following proper procedures will just waste time. OP needs to specifically request consideration under the Commissioner Approved Training provisions and submit documentation showing why they couldn't apply earlier.

The 90-day standard deadline is actually more of a guideline than a hard cutoff. ESD has discretion to approve training benefits in cases where there were extenuating circumstances that prevented timely application. Your appeal process definitely counts as an extenuating circumstance. You'll need to: 1. Complete the Training Benefits Application form 2. Submit a detailed statement explaining why you couldn't apply within the standard timeframe (focus on the appeal timeline) 3. Get documentation from your training program showing enrollment 4. Include any communications with ESD that show you weren't properly informed about training options Be prepared for the long determination timeline - the 14 weeks is unfortunately accurate. If you only have 6 weeks left on your claim, you should also file for Training Benefits Extension which can provide additional weeks while in approved training.

This is incredibly helpful, thank you! I've been so stressed about this. Do you know if there's any way to expedite the determination process? My savings won't last 14 weeks without benefits.

I AM GOING THROUGH THIS EXACT THING RIGHT NOW!!! Been waiting 11 weeks for my training determination and my regular UI just ran out last week. Called ESD like 40 times and can never get through. My community college advisor said they're seeing tons of delays with training approvals. Apparently they're totally understaffed in that department. So frustrating!!

Try using Claimyr to reach ESD - that's what finally worked for me after weeks of failed calls. Their system gets you through to an actual agent instead of getting disconnected. I was skeptical but their video demo convinced me: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. It was worth it to finally talk to someone who could actually tell me the status of my training application instead of being in limbo. Their site is claimyr.com if you want to check it out.

i think you can also talk to worksource advisors about this? they helped my cousin with something similar last year when he missed some deadline. he had to do a hardship form or something...not sure what it was called exactly

You're thinking of the Training Benefits Hardship Consideration form. It's specifically for cases where someone missed application deadlines due to circumstances beyond their control. WorkSource employment specialists can definitely help with this process and sometimes have direct lines to ESD specialists.

Let me clarify some misconceptions here. There are actually TWO different training programs: 1. Training Benefits (TB) - Has stricter timing requirements, typically must apply within first 16 weeks of claim 2. Commissioner Approved Training (CAT) - More flexible timing but stricter training criteria Based on your situation, you should apply for CAT and explicitly state that your delayed appeal prevented timely application. Include ALL documentation of your appeal process. Also important: if your training is for an in-demand occupation (which IT certainly is), make that very clear in your application. The determination timeline is indeed 12-14 weeks currently, but your benefits can be paid retroactively if approved. One more critical point: You MUST continue filing your weekly claims during this entire process, even if you're not receiving benefits during training determination.

This is so detailed and helpful! I didn't realize I needed to keep filing weekly claims during the determination period. Would my weekly claims be affected since I'm in school full-time? The program requires about 30 hours a week of classwork.

Just wanted to add that you should also complete the Training Benefits Extension application now, not wait for your regular benefits to run out. The extension can add up to 26 additional weeks of benefits while you're in approved training. Having both applications in the system shows your commitment to the training path.

Update: I took everyone's advice and applied for Commissioner Approved Training yesterday. I also contacted WorkSource and they're helping me document why I missed the standard deadline. Still nervous about the 14-week determination timeline, but at least I know I'm on the right track now. Thank you all so much!

That's excellent! One more tip: While you're waiting for determination, prepare a detailed training progress report to submit monthly once approved. This helps ensure continued eligibility. Include course completion percentages, grades if applicable, and how the training is enhancing your employability. Having these ready to go will save you stress later.
