ESD denied benefits after failed drug test but had valid prescription - can I appeal?

I got fired from my warehouse job last month after failing a random drug test. Here's the thing - I immediately showed them my valid prescription from my doctor that explained the positive result. The lab even updated the test to 'negative' because of my prescription, but my employer STILL wouldn't take me back! They said the termination was for 'other reasons' suddenly. I've been applying for jobs but need some income in the meantime. Will ESD approve my unemployment claim given these circumstances? I'm worried they'll automatically deny me because drug-related terminations are usually disqualifying. Has anyone dealt with something similar? The termination letter specifically mentioned the failed test before I provided my prescription proof.

I went thru something similar last year. If u have documentation that shows the test was changed to negative AND proof they originally fired you for the drug test, you should be eligible. Make sure u upload ALL documentation when u file. The key is proving they fired u for an invalid reason.

Thanks for the quick reply! I have the termination letter which specifically mentions the failed test as the reason. And I have the updated lab results showing negative after my prescription was considered. Should I upload both when I file? My HR person was super sketchy when I showed the prescription - suddenly started talking about 'performance issues' that were never documented.

You're definitely in a good position to receive benefits. When ESD evaluates misconduct cases, they look at whether there was a willful disregard for the employer's interests. A valid prescription medication that caused a positive test is NOT misconduct since you had a legitimate medical reason. Make sure to clearly explain in your initial application that: 1. You were terminated specifically for a failed drug test (include the termination letter) 2. You had a valid prescription that explained the result (upload prescription documentation) 3. The test was officially corrected to negative (include updated lab results) If your employer tries to claim it was for performance reasons now, ESD will question why that wasn't documented or mentioned in your termination letter. The burden of proof is on the employer to prove misconduct, and your documentation contradicts their claim.

Thank you for the detailed response! That makes me feel better about my chances. So even if they try to claim it was for performance reasons during the ESD process, the fact that wasn't mentioned in my termination letter works in my favor? I'll upload everything when I file my claim this week.

u kno what... companies do this ALL THE TIME! they fire for one reason then make up other reasons when they realize they messed up. my cousin got fired for missing work for jury duty (which is illegal) and when she pointed it out suddenly she had 'attendance issues' lol. Fight this!!

That's exactly what happened! The minute I showed my prescription they started backpedaling and bringing up minor issues from months ago that were never even documented in my file. It's so frustrating.

Drug related terminations r usually disqualified BUT since u had a prescription and they changed the result to negative, ur good!!! But ESD can take FOREVER to decide complicated cases... my adjudication took 9 weeks and i almost got evicted waiting!!!!

Oh no, 9 weeks?? I can't wait that long! I've got rent and car payments coming up. Is there any way to speed up the process?

I had a similar situation last year where my claim needed additional review. After waiting two weeks with no updates, I used a service called Claimyr (claimyr.com) to get through to an ESD agent. They helped me reach an actual person who could check my claim status and flag it for expedited review. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 Their service helped me connect with ESD when I couldn't get through on my own. The agent I spoke with was able to see exactly what documentation was missing and what was holding up my claim. Definitely worth trying if you're having trouble reaching anyone.

Not to be a downer but my freind at ESD says even with prescription if the job had safty concerns (like operating machinery etc) they CAN deny u benefits cause they could argue u shouldve disclosed meds. did ur job involve dangerous equipment??

This information is not accurate. Under Washington state law, if you have a valid prescription for a medication, you cannot be terminated for failing a drug test due to that medication - even in safety-sensitive positions - unless: 1. You failed to disclose the medication when specifically asked prior to testing, OR 2. The medication observably impaired your ability to safely perform job duties, OR 3. The employer offered reasonable accommodation options that you refused Mere presence of a prescribed medication in your system is not grounds for termination or benefit denial without these other factors. The fact that the test was changed to negative after reviewing the prescription strongly supports the claimant's case.

I worked in inventory management - occasionally used a forklift but not on the day of the test. I had disclosed my medication to HR when I was hired 2 years ago, but admittedly hadn't mentioned it again recently when they changed our HR person. It's a common anxiety medication that doesn't cause impairment.

Make sure you flag your ESD application for adjudication from the beginning. Since your case involves a termination related to a drug test (even though you were vindicated), it will likely need review. In the "reason for separation" section, be very clear and chronological about what happened: 1. Terminated specifically for failed drug test (include exact date) 2. Provided valid prescription immediately (exact date) 3. Lab revised result to negative (exact date) 4. Employer refused reinstatement, changed reason for termination after the fact Upload all documentation and consider calling ESD after filing to confirm they have everything needed. Your case is strong based on what you've shared, but proper documentation is critical. If your employer contests, there will be a fact-finding interview where you can present your evidence.

This is really helpful - I didn't know about flagging for adjudication. I'll make sure to be super detailed and chronological like you suggested. Should I also mention that they never documented any performance issues before the drug test incident? I had good performance reviews up until this happened.

Absolutely mention that! The lack of documented performance issues prior to the drug test is crucial evidence. Also include dates of any positive performance reviews you received. This creates a timeline showing the employer only invented "performance issues" after realizing they couldn't legally fire you for the prescription medication. This is exactly the kind of information that helps adjudicators see through employer pretexts.

Dont wory about 9 weeks i mentioned... u probably will get approved faster since u have proof. i had a super complicated situation with multiple employers. but still call them like every day to check ur status!!

Thanks for the encouragement! I'll definitely be calling regularly to check on my claim status. I've heard the phone lines are crazy though - sometimes disconnecting people after hours on hold.

MAKE SURE u answer every phone call even from unknown numbers!!!! ESD might call u for fact finding interview and if u miss it they can deny ur claim. And check ur online portal messages DAILY - sometimes they send questions there with deadlines.

Good point - I'll keep my phone with me and answer everything. And I'll check the portal multiple times daily. My anxiety is through the roof thinking about how my employer might try to fight this.

Just wondering did u ever get a new termination letter with these so called performance reasons or is it just stuff they told u verbally? cuz if its just verbal thats sooooo sketchy

0 coins

No, they never gave me an updated termination letter! It was all verbal after I showed them the prescription. The original termination letter specifically mentions the positive drug test as the sole reason. They just verbally started bringing up other issues when I tried to get my job back after the test was revised to negative.

This detail is extremely important. The fact that your only written termination documentation cites the drug test as the reason will be very compelling to ESD. Employers who change their story during the unemployment process (especially without documentation) typically don't fare well in these cases. Keep that original termination letter safe - it's your strongest piece of evidence.
