Can you get unemployment if you get a severance package in Washington?

My company is doing layoffs next month and they're offering severance packages to people who get let go. I heard conflicting information about whether you can still file for unemployment benefits if you accept severance pay. Does Washington ESD consider severance as wages that would disqualify you from UI benefits? The severance would be about 8 weeks of pay but I'm worried it might mess up my unemployment claim.

Yes you can still get unemployment with severance in Washington! The key thing is HOW the severance is paid out. If it's a lump sum, Washington ESD treats it differently than if it's paid out over several weeks like regular wages.

They haven't told us yet how it would be paid out. What's the difference between lump sum vs weekly payments for unemployment eligibility?

Lump sum severance doesn't affect your weekly unemployment benefits at all. But if they pay it out weekly like regular wages, Washington ESD will deduct those amounts from your UI benefits during those weeks.

I got severance when I was laid off last year and it was such a pain dealing with Washington ESD about it. They kept asking for documentation and it delayed my claim for weeks.

What kind of documentation did they want? I want to be prepared if I need to file.

They wanted the severance agreement showing the amount and payment schedule, plus a letter from my employer explaining the terms. It was a nightmare trying to get through to someone at Washington ESD to clarify what they needed.

If you're having trouble reaching Washington ESD by phone, I used claimyr.com recently and it actually worked. They have this system that keeps calling until you get through to an agent. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me hours of trying to call myself.

The Washington ESD handbook says severance payments don't count as wages for unemployment purposes if they're truly severance and not vacation or sick leave payouts. But you still need to report it when you file your weekly claims.

Wait so you have to report it even though it doesn't affect your benefits? That seems confusing.

0 coins

Yeah you report all income when filing weekly claims, but Washington ESD won't reduce your UI benefits because of true severance pay. It's just for their records and to make sure everything is documented properly.

Make sure you get everything in writing from your employer about the severance terms! I made the mistake of just accepting verbal promises and when I filed for unemployment, Washington ESD wanted official documentation I didn't have.

Good point, I'll definitely ask for written details about how and when the severance gets paid.

this is why i never trust HR when they say stuff about unemployment... they dont always know the washington esd rules and sometimes give wrong info

Exactly! Always verify with Washington ESD directly or check their website. HR departments sometimes mix up federal and state rules.

So true. My old job told people they couldn't get unemployment if they took severance which was completely wrong.

I'm dealing with this exact situation right now. Got laid off 3 weeks ago with a severance package and my unemployment claim is still pending. Washington ESD keeps asking for more paperwork about the severance terms and I can't get anyone on the phone to explain what they need.

You should try that Claimyr service I mentioned earlier. I was stuck in adjudication for similar severance documentation issues and couldn't reach anyone at Washington ESD for weeks. Claimyr got me through to an agent who walked me through exactly what documents they needed.

I'll check that out, thanks. This is so stressful not knowing if my claim will get approved.

The timing of when you receive severance vs when you file for unemployment can matter too. Washington ESD looks at whether you were actually separated from employment, not just when you got paid.

•

What do you mean by that? If my last day of work is January 31st but I get severance paid in February, when can I file?

Amina Toure

•

You can file for unemployment starting from your actual separation date (January 31st in your example). The severance payment date doesn't change when you're eligible to file.

Just went through this myself. Got 12 weeks severance as a lump sum and Washington ESD approved my unemployment benefits without any issues. The key was having clear documentation that it was severance, not extended wages.

That's reassuring! Did you have to wait longer than usual for approval because of the severance?

Oliver Weber

•

Nope, my claim was processed in the normal timeframe. I think because the severance paperwork was clear and I reported it properly on my weekly claims.

washington esd is so backed up right now... even with severance documentation it took them 6 weeks to process my claim

That's awful. Did they eventually approve it though?

yeah they approved it but by then i was almost out of money... wish i had known about ways to actually reach them by phone

Pro tip: When you file your initial claim, there's a specific section where you can upload severance documentation. Don't skip that part even if it's optional - it can prevent delays later.

Thanks for the heads up! I'll make sure to have all my severance paperwork ready when I file.

One thing to watch out for - some employers try to structure severance as continuation of wages to avoid paying into the unemployment insurance fund. Make sure your severance agreement clearly states it's severance pay, not extended employment.

0 coins

How can you tell the difference? My severance letter just says 'separation pay'.

Look at whether you're still considered employed during the severance period and whether they're taking out payroll taxes. True severance usually doesn't have you on payroll.

I was so confused about this when I got laid off. Spent weeks worried that accepting severance would disqualify me from unemployment. Turns out I was worrying for nothing - got both the severance and my full UI benefits.

That's exactly what I'm worried about! Good to hear it worked out for you.

The Washington ESD website has a specific FAQ about severance and unemployment that's pretty helpful. It's buried in their resources section but worth reading if you're dealing with this situation.

I'll look for that, thanks. Sometimes their website is hard to navigate but good to know the info is there.

Another consideration - if your severance includes continued health insurance coverage, that doesn't affect your unemployment eligibility either. Washington ESD only cares about actual cash payments.

Good to know! My package includes COBRA coverage so I was wondering about that too.

just remember to keep copies of everything related to your severance package. washington esd loves their paperwork and you never know when they might ask for something again months later

Definitely will do that. Sounds like documentation is key to avoiding problems.

I used to work in HR and saw a lot of confusion about this. The bottom line is Washington state is pretty generous about allowing unemployment with severance compared to some other states. Just be honest and report everything properly.

Thanks for the HR perspective! That's reassuring to hear from someone who dealt with this from the employer side.

Agree about being honest. I tried to hide my severance thinking it would help and it just made things worse when Washington ESD found out during their audit.

Final thought - if your employer offers you a choice between different severance options, consider how each one might interact with your unemployment benefits. Sometimes the option that looks better upfront isn't actually the best when you factor in UI benefits.

That's a really good point I hadn't considered. I'll make sure to think through all the implications before choosing.
